The project involves the installation of approximately 13,700 linear feet of 4-strand wildlife-friendly fence, with optional additional items including 1,350 linear feet of fencing, removal of existing fence materials, installation of associated bracing and gates, and site preparation work including vegetation clearing and grubbing. The work scope includes mobilization and demobilization, fence removal and disposal, and the salvage and re-installation of an existing 16-foot tubular metal gate. The pre-bid conference is scheduled for June 6, 2018, at 10:00 a.m. at the project site near Evergreen, Colorado (Mount Evans SWA, 4720 Upper Bear Creek Road, Evergreen, CO 80439). Sealed bids are due on June 13, 2018, at 1:30 p.m. The contractor must complete all work within 80 calendar days from the Notice to Proceed, with construction to be stopped prior to August 18, 2018, and resumed in spring 2019 as needed, with final completion no later than June 30, 2019. 5. A GOOD FAITH EFFORT shall be defined as an effort to seek and consider MBE's as potential subcontractors including but not limited to the following steps:
- Provide equal time for all prospective subcontractors to prepare their proposals.
- Affirmatively solicit their interest, capability and price quotations.
- Award subcontracts to MBE's where MBE quotations are competitive with other quotations received.
6. The Contractor shall document MBE participation or non-participation with the Division for all projects awarded by use of Minority Business Enterprises Contract Compliance Report form. Final project payment shall be made only after receipt by the Division of the completed report.
7. A bidder who fails or refuses to fully complete and return this document shall not be deemed a responsible bidder and will not be awarded the contract.
III. REQUIREMENTS, TERMS, AND CONDITIONS
1. Minority Business Enterprise (MBE) means, for the purpose of this proposal, a business enterprise at least 51% of which is owned and controlled by minority group member or, in the case of a publicly owned business at least 51% of the stock of which is owned and controlled by minority group members who are socially and economically disadvantaged as determined by the U.S. Small Business Administration for small businesses, which provides that persons who are socially and economically disadvantaged are those persons who have been deprived of the opportunity to develop and maintain a competitive position in the economy because of chronic social and economic disadvantage. Such disadvantage can be the result of cultural, social or chronic economic circumstances or background, or other similar cause. Eligible persons are expected to be engaged full-time in the day-to-day operation and management of the business. Minority group members are ethnic minorities including Blacks, Puerto Ricans, persons of Hispanic Origin, Asian Americans, American Indians, Eskimos, and Aleuts, and in addition, may include other categories of persons who can demonstrate such similar chronic disadvantage.
2. The percentage of minority participation will be determined by dollar value of the work subcontracted to or joint ventured with minority firms as compared to the total dollar value of the bid amount for all work bid under this contract.
A Contractor may count toward its contract goals the percentage of expenditures for materials and supplies obtained from MBE suppliers and manufacturers, provided that the MBE's assume the actual and contractual responsibility for the provision of the materials and supplies.
A. The Contractor may count the percentage of the entire expenditure to an MBE manufacturer (i.e., a supplier that produces goods from raw materials or substantially alters them before resale).
B. The Contractor may count 20% of its expenditures to MBE suppliers that are not manufacturers, provided that the MBE supplier performs a commercially useful function in the supply process.
III
3. Where a bidder intends to attain its goal for Minority Business Enterprise participation by use of joint venture, the joint venture agreement and other appropriate evidence of percentage participation must be furnished WITH THE BID.
4. The acceptance of the percentage of goal set forth herein shall be the bidder's contractual commitment to the percentage of Minority Business Enterprise utilization during the term of this contract. The bidder shall be deemed to have met its commitment for Minority Business Enterprise utilization if the Minority Business Enterprise utilization of the Contractor meets the goal established herein and such utilization is in fact performed by MBE's. Failure to meet the established goal may be excused pursuant to Paragraph 5 thereof, but the burden of proving best effort as hereinafter defined shall rest with the Contractor.
5. The bidder's commitment to the specified percentage goal for minority enterprise utilization as required by this proposal shall constitute a contractual commitment to make its best effort to meet such goal by subcontracting or by furnishing and purchasing materials or equipment from minority firms or by entering into a joint venture with a Minority Business Enterprise. If the bidder fails to meet this goal, it will carry the burden of furnishing sufficient documentation of its best efforts to justify a grant of relief from the goal set forth herein. Such documentation shall include evidence of all efforts made to secure Minority Business Enterprise participation in the project, including but not limited to the following:
A. Timely notification to trade associations, business development organizations and other minority business organizations that the bidder seeks minority subcontractor and supplier participation. Such notification should include records of the response made by such organizations.
B. Documentation of the bids requested and the bids received from Minority Business
Enterprises on the applicable project, and the action taken with respect to each such bid or proposal, and of any and all subcontracts for this project which were negotiated with any subcontractors and the procedures utilized for receiving and screening bids.

Minority Business Office, including records of the nature and outcome of such contacts. The Colorado Office of Minority Business Enterprise shall maintain a current list of available minority businesses in the construction trades. Such list may be obtained by writing to the Minority Business Office, Department of Local Affairs, 1625 Broadway, Suite 1710, Denver, CO 80202, phone (303)892-3840.
D. Evidence of any internal recruitment policy or internal affirmative action policies directed toward the utilization of Minority Business Enterprises.
E. Evidence of participation in or development of any technical assistance programs involving Minority Business Enterprises or persons.
6. Where other bidders have succeeded in meeting the established goal, it shall create a presumption that such goal was reasonably attainable by the exercise of best effort.
IV
7. After bid opening but prior to the award of this contract, the bidder shall be required to provide to the Division a list of Minority Business Enterprises, stipulating the dollar amount of each subcontract or supplier of materials.
8. The awarding agency will review the Contractor's Minority Business Enterprises utilization efforts during performance of this contract. If at any point during the performance of the contract, it becomes evident or it materializes that a Minority Business Enterprise listed in said contract is no longer available to perform the services or supply the materials therein indicated for whatever reason, the Contractor shall notify the Division of this circumstance prior to subcontracting or otherwise engaging in the work specified. Where the Contractor has failed to comply with the contract or where circumstances result in the Contractor no longer being in compliance with the contract goal, the Contractor shall immediately take corrective action or show cause why such compliance is no longer possible on this project. Failure to comply with this section shall constitute a material breach of the contract that has been awarded subject to these conditions.
9. The Contractor will retain records and documents as proof of compliance for two years following completion of this contract. These records and documents, or copies thereof, will be made available at reasonable time and places for inspection by an authorized representative of the Division or designated representatives and will be submitted to such representatives upon written request.
