EXECUTIVE SUMMARY

This report presents the results of a Phase I Environmental Site Assessment (ESA) conducted on properties located along Navajo Route 7 (Main Street) in Chinle, Apache County, Arizona (Townships 5N and 32N, Ranges 10 West and 26E, Sections 16 and 29, G.S.R.M), referred to herein as the “subject properties”). The subject properties consist of six (6) separate parcels of land (A-1-1 at 50.618 acres; A-1-2 at 11.431 acres; B-1-2 at

3.930 acres; E-1 at 14.619 acres; G-1 at 1.541 acres, and P-1 at 2.137 acres). iiná bá, Inc, (iiná bá) has been retained by the Bureau of Indian Affairs (BIA) Navajo Regional Office (NRO) to perform this ESA to identify any recognized environmental conditions (RECs) on the above-referenced properties that may pose risk to human health or the environment. The subject properties are Navajo Trust Lands that are to be relinquished back to the Navajo Nation. This ESA was written in accordance with the requirements of the American Society for Testing and Materials (ASTM) Standard E 1527-21 and the United States Environmental Protection Agency (USEPA) All Appropriate Inquiry Rule

40CFR312.1.1.

Through our reconnaissance and research of the subject property, our study concluded the following:

Parcels A-1-1 and A-1-2:

The discarded sections of ACP should be tested and confirmed for the presence of asbestos fibers as they can be considered an REC.

The suspect building materials contained within the various illicit debris dump areas should be tested and confirmed for the presence of asbestos fibers as they can be considered an REC.

NAVAJO GAMING ENTERPRISE, FORMER ROLLING MESA, LLC PROPERTY, NM – UPDATED PHASE I ESA ii

The abandoned building (#135) containing building materials that are suspect for containing asbestos fibers should be tested and confirmed present or absent prior to being disturbed (demolished).

The sheet flooring product at the burned building site on Parcel A-1-2 should be tested for the presence of asbestos fibers prior to the cleanup of this structure.

The improperly abandoned NTUA natural gas distribution risers should be properly retired (abandoned) as they can be considered an REC (safety hazard).

Parcel B-1-2:

There are no RECs identified with this parcel. However, the minor occurrence of residual waste items left onsite by others should be removed and properly disposed of as applicable.

Parcel E-1:

This parcel in general is not considered an REC but should be properly and completely retired (abandoned) by clearing and grubbing and infilling to the surrounding natural land surface and compacted to restore the site to an original condition.

Parcels G-1 and P-1:

Any suspect building materials on the two (2) out-of-service (abandoned) water supply wells should be tested and confirmed to determine the presence or absence of hazardous materials (asbestos and lead).

Both of the abandoned water supply wells should be properly abandoned (with associated structures removed) in accordance with applicable regulations as they can be considered an REC.

The minor occurrence of illicit dumping on Parcel P-1 should be removed and disposed of in accordance with applicable regulations as it can be considered an

REC.

Inquiry Rule 40CFR312.

1.2 Scope of Services

A Phase I ESA is a research and reconnaissance-level review of a property and the surrounding site to identify potential environmental conditions that may indicate the presence of a release or threat of release of hazardous substances or petroleum. The assessment is largely dependent on direct observation of site conditions, inquiries into previous ownership and uses of the property, and reviews of reasonably and readily available federal, state, and local environmental records. The Phase I ESA Scope of Services for the subject properties included:

• Site history development: This entails a review of the readily available history of the subject property’s ownership, use, and potential environmental issues based on available information obtained from interviews with persons knowledgeable of the site.

• Record searches at appropriate federal, state, and local agencies providing readily available information pertaining to possible environmental conditions at or in the vicinity of the subject properties. This includes the subject property and properties within an appropriate minimum search distance.

• Review of readily available historical sources such as Sanborn Fire Insurance Maps®, aerial photographs, Beers Atlas, and the Mannings Directory.

• A site reconnaissance to observe, document, and photograph subject property operations, property conditions, and signs of potential environmental liabilities, including asbestos and lead-based painted surfaces.

1.3 Limitations and Exceptions

All of the subject properties were inspected during the site visits. There are no recognized Data Gaps associated with this document that would result in a limitation regarding the use of this report. Further discussions regarding the level of due diligence performed under this ESA effort follow in the sections below.

1.4 User Reliance

This report was prepared solely for the use of the BIA. The conclusions provided by iiná bá in this report are based solely on the information referenced or contained within this document. While we are unaware of any facts or circumstances that would cause us to suspect that the conclusions drawn herein are incorrect or misleading, it is possible that additional information could become available that would require refinement or

P-1: Open/vacant/undeveloped (north, east, south), Partial development (commercial) west.

3.0 USER PROVIDED INFORMATION

3.1 Title Records

EDR® conducted a property tax map search for the subject properties. The results of these searches are included in Appendix 2. Since all of the parcels are Navajo Trust Lands, there are no actual (individual) title records.

3.2 Environmental Liens or Activity and Use Limitations

EDR® conducted an environmental lien search on the subject properties to identify any cleanup liens or other activity and use limitations, such as engineering controls and institutional controls. Their search did not identify any environmental liens or other activity and use limitations on the subject property (see Appendix 2).

3.3 Specialized Knowledge

Iiná bá has not been provided with any prior specialized knowledge of the subject properties by the BIA.

3.4 Commonly Known or Reasonably Ascertainable Knowledge

Based on common knowledge, it is understood that a portion of Parcel A-1-2 was once a residential housing area for the BIA, but the structures have been demolished for some time now. In addition, it is common knowledge that Parcel E-1 was a former two-cell wastewater treatment lagoon system that is now abandoned or out-of-service.

3.5 Valuation Reduction for Environmental Issues

Iiná bá does not have any personal knowledge of any valuation reduction related to environmental issues associated with the subject properties.

3.6 Owner, Property Manager, and/or Occupant Information

All of the subject parcels are under the management and/or contained previous activities that were managed by the BIA. Other than a few residential homesites on Parcel A-1-1, there are no onsite occupants for the subject properties. Locally, the BIA Chinle Agency office located near Parcel B-1-2 manages all BIA occupied or held properties in Chinle, BIA LAND TRANSFERS, CHINLE, APACHE COUNTY, ARIZONA – PHASE I ESA 6

Arizona until such time they are relinquished back to the Navajo Nation.

3.7 Reason for Performing Phase I ESA

This Phase I ESA was performed by iiná bá, at the request of the BIA since the subject parcels are being considered for relinquishment back to the Navajo Nation once site conditions have been deemed acceptable. Should any REC be documented on a parcel, the performance of a Phase II ESA will be conducted to determine the significance of the REC and if any remedial actions are warranted. This ESA was written in accordance with ASTM E 1527-21 and the USEPA All Appropriate Inquiry Rule.

4.0 RECORDS REVIEW

4.2 Physical Setting Source(s)

In addition to a United States Geological Survey (USGS) topographic map (see Appendix 1, Figure 1), the following additional physical setting sources were consulted.

4.2.1 Geological Conditions

The subject parcels consist alluvial and eolian (wind) surficial deposits of Quaternary Age overlying the Chinle Formation, a colorful mudstone, such as in the Painted Desert, and less abundant lenses of sandstone and conglomerate, deposited by a large river system.

This unit typically is eroded into badlands topography and contains clays that are prone to shrinking and swelling. (210-230 Ma). In addition, based on the EDR® GeoCheck Report®, the average indoor radon levels in the Chinle area are 1.823 picocuries per liter (pCi/L), with 87% of homes reporting less than 4 pCi/L, which is the USEPA indoor air threshold level.

4.2.2 Soil Conditions

According to the United States Department of Agriculture (USDA) Natural Resources

BIA LAND TRANSFERS, CHINLE, APACHE COUNTY, ARIZONA – PHASE I ESA 10

4.2.3 Surface Water and Groundwater Conditions

Surface Water: The nearest mapped surface water feature to each parcel is summarized below:

Parcels A-1-1 and A-1-2: Chinle Wash (400 feet NE).

Parcel B-1-2: Chinle Wash (2,500 feet NE).

Parcel E: Nazlini Wash (600 feet SW).

Parcels G-1 and P-1: Chinle Wash (160 feet N).

Groundwater: The depth to groundwater beneath Parcels B-1-2, E-1, G-1, and P-1 is likely to be shallow due to proximity to nearby washes. Other properties at similar elevations along Main Street (Pic N Run Store and former Chinle Hay Sales lot) have shallow alluvial groundwater (unconfined) at a depth between 26 to 29 feet below land surface (bls).

However, this groundwater is not potable and would only be able to service livestock or irrigation uses. Deeper groundwater used for drinking such as the NTUA potable water system is from deep wells into bedrock at depths of 1,000 feet or more.

One Hundred Year Floodplain: Based on the mapped location of the subject properties and the position of the 100-year and 500-year flood zones designated by Federal Emergency Management Agency (FEMA), the following pertains to floodplains for each of the subject parcels:

Parcels A-1-1 and A-1-2: There is an area mapped with a 0.20% chance of an annual flood east of the parcels along the Chinle Wash at a distance of approximately ¼-mile. The subject parcels are not located within a 100-year or 500-year flood zone.

Parcel B-1-2: There is an area mapped with a 0.20% chance of an annual flood northeast of the parcel along the Chinle Wash at a distance of approximately 0.60 miles. The subject parcel is not located within a 100-year or 500-year flood zone.

Parcel E: The subject parcel is not located within a 100-year or 500-year flood zone.

Parcels G-1 and P-1: There is an area mapped with a 0.20% chance of an annual flood east of the parcels at an approximate distance of 100 feet.

BIA LAND TRANSFERS, CHINLE, APACHE COUNTY, ARIZONA – PHASE I ESA 12

4.2.4 Wetlands

Based on a reconnaissance of the subject properties, there were no observations of hydric soils indicative of a wetland condition. In addition, according to the National Wetlands Inventory (NWI), the following pertains to the existence of wetlands within or near the subject parcels:

Parcels A-1-1 and A-1-2: Wetlands are mapped within 150 feet NE of the parcels along the floodplain of the Chinle Wash.

Parcel B-1-2: Wetlands are mapped within ½-mile NE of the parcel along the floodplain of the Chinle Wash. Other wetlands are mapped along the channel of Nazlini Wash located approximately ¾-mile west of the parcel.

Parcel E-1: Wetlands are mapped as adjacent to or near the southwestern border of the parcel that belong to the Nazlini Wash. The wetlands along the Chinle Wash are approximately 0.60 miles NE of the parcel. A reconnaissance of this parcel during the site visit did not identify the presence of any wetlands.

Parcels G-1 and P-1: Wetlands are mapped within 100 feet north of Parcel P-1 along the floodplain of Chinle Wash.

4.2.5 Public Wells and Wellhead Protection Areas

Public Wells: There is one (1) federal drinking water well reported within 1/8 to ¼-miles of Parcels A-1-1 and A-1-2. The well is owned by the Canyon De Chelly National Monument and is cited as serving a population of 375. The well is disinfected for use by gaseous chlorination. The well specifically serves a Navajo Indian Health Service community.

Tribal Wells: There are seven (7) wells listed on the Navajo Nation Water Code Administration (WCA) database in the Chinle area. Two (2) are listed as abandoned (NTUA Chinle #1 and NTUA Chinle #3). Another well (Chinle BIA #1 North) is listed with an unknown status. The four (4) other wells are listed as active (South Well, Chinle South NTUA-1, Chinle #2 NTUA Center, and Chinle #3A NTUA South). All active wells are listed with an municipal use with completion dates between 1954 and 1971. Each well is completed as a alluvial well except for the Chinle South NTUA-1 well, which is listed as being completed into the Canyon De Chelly Formation. The alluvial wells are completed to a depth of 111 feet bgs and the Canyon De Chelly well is completed to a depth of 310 feet bgs. Static water levels ranged from 16 to 35 feet below the top of well casings. Based on the location of these active wells, the following wells are in close proximity to one (1) or more of the subject parcels (see Figures in Appendix 1 for locations):

• Chinle #2 NTUA Center Well: 825 feet NE of Parcel A-1-1.

4.4 Findings from Previous Reports

iiná bá did not identify the existence of any other previous environmental-related or other reports pertaining to the subject properties during the performance of this Phase I ESA.

4.5 Historic Use Information on Adjoining Properties

The same historic resources utilized to determine the development and use of the subject property have been utilized to determine the historic use information on adjoining properties. All adjoining properties have been utilized for what they currently are being utilized for such as open rangeland for oil & gas production, light commercial operations such as aggregate mining and concrete/asphalt production, and commercial retail sales.

This condition is unchanged since the previous ESA.

Environmental Records Search

The same Federal EPA and Arizona databases were searched for hazardous conditions on adjoining properties as on the subject property described in Section 4.1. The results of the database research for sites with possible RECs are included below. The database search results are included in Appendix 2.

The subject properties are not listed as containing any sites pertaining to any of the federal, state, or local (tribal) databases searched, with the exception of being listed on the Indian Reservation database as the Navajo Nation Reservation. The following summarizes the mapped sites reported within ¼-mile from the subject property.

BIA Building 1,000 – Chinle Agency (2)

This site is mapped as less than 1/8-mile from Parcels A-1-1/A-1-2 (75 feet north of A-1-1) as a Indian Leaking Underground Storage Tank (LUST) site. The site specifically maps at the BIA Road Maintenance yard located adjacent to Parcel A-1-1. Records indicate it was given a Navajo Nation Environmental Protection Agency (NNEPA) site ID of NAV #341.

The status of the LUST at this site is closed with a confirmed leak from an 8,500-gallon gasoline tank that was installed in 1964 and taken out of service in 1972. The current status of this site is that it received a No Further Action (NFA) status with a completed cleanup. Given the NFA status of the historic release, this site is not considered an REC with regards to any of the subject BIA parcels.

BIA LAND TRANSFERS, CHINLE, APACHE COUNTY, ARIZONA – PHASE I ESA 20

Mustang #7267 – NAV #015 (A4)

This site is mapped as less than 1/8-mile from Parcels A-1-1/A-1-2 as a FINDS site with a past RCRA enforcement action pertaining to an UST. The enforcement action was administrative which means there was something deficient in their required regulatory reporting pertaining to their UST system. Given the lack of an indication of any release, this site is not considered an REC with regards to any of the subject BIA parcels.

Garcia’s Trading Post – NAV #058 (7)

This site is mapped as less than 1/8-mile east from Parcels A-1-1/A-1-2 (250 feet east) as an Indian UST site. Records indicate historic fuel storage from a 3,000-gallon and 3,500-gallon UST that were installed in 1970. The status of this site as of 1992 was that the USTs were permanently out of use. Given that this site was granted a NAV number by the NNEPA, it was likely investigated and contained some sort of a release. However, the records do not indicate this site had a confirmed release nor that any assessment or remediation was performed. In addition, the site is approximately 200 feet west of Parcel G-1. Given the lack of information confirming any release and the location of the site at a lower topographic elevation than Parcels A-1-1/A-1-2, this site is not considered an REC with regards to any of the subject BIA parcels.

Chinle Unified School District 24 Transportation – NAV #226 (8)

This site is mapped as between 1/8 and ¼-mile south-southwest of Parcels A-1-1/A-1-2 (690 feet) as an Indian UST/LUST site. Records indicate six (6) USTs were reported onsite to store and dispense gasoline and diesel fuel for fleet and bus use. Three (3) USTS were reportedly out of use (1,000-gallon gasoline; 7,000-gallon diesel, and 4,000-gallon gasoline) that were installed in 1959. It is cited that a confirmed release was discovered during UST closure that has been given a NFA status from a completed cleanup. Three (3) additional tanks installed in 1990 when the previous USTs were removed are still active and contain 20,000-gallon gasoline; 10,000-gallon gasoline, and 10,000-gallon diesel. This site is also 650 feet southeast of Parcel B-1-2. Given the NFA status of the historic release, this site is not considered an REC with regards to any of the subject BIA parcels.

Chinle Chevron – NAV #147 (9)

This site is mapped within 1/8-mile west-northwest of Parcels A-1-1/A-1-2 (1,025 feet NW) as an Indian UST/LUST site. Records indicate eight (8) USTs were reported onsite to store and dispense gasoline and diesel fuel for commercial use. Three (3) USTS were reportedly out of use (200-gallon used oil; 6,000-gallon gasoline, and 3,000-gallon gasoline) that were installed in 1941 (used oil) and 1967.
