About this file

This is a Build America, Buy America (BABA) Certification Form required by the City of Fort Myers for the South Street Sidewalk Construction project in Florida. The project involves construction of a 6-inch thick, 5-foot wide, 3,000-foot long sidewalk on the north side of South Street extending from US 41/Cleveland Avenue to SR 739/Fowler Street (FDOT Project 438101-2-58-01). The BABA requirement applies to all federally funded projects involving construction, alteration, maintenance, or repairs, as mandated by the Infrastructure Investment and Jobs Act passed November 15, 2021. Contractors responding to this project must complete and submit the certification form with signatures, dates, company information, and contact details.

By signing this certification, contractors affirm their understanding of and commitment to comply with BABA provisions, which mandate the use of iron, steel, manufactured products, and construction materials produced in the United States. Contractors certify that they will identify domestic sources for BABA-covered products, provide verification documentation for compliance, and submit waiver documentation when needed per federal guidelines. The certification applies to all project portions, including those awarded to subcontractors. False statements on the certification form may result in rejection or termination of any contract award. Additional information regarding BABA requirements and authorizations is available on the White House Office of Management and Budget website.
