About this file
This document is a Build America, Buy America (BABA) Certification Form from the City of Fort Myers Procurement Services for federally funded construction projects. The form requires contractors to use iron, steel, manufactured products, and construction materials that are produced in the United States, in compliance with the Infrastructure Investment and Jobs Act passed on November 15, 2021. Contractors must certify their understanding and commitment to identifying domestic sources of BABA-covered products, providing verification documentation, and obtaining waivers as needed per current federal guidelines.
The certification form emphasizes strict compliance with domestic manufacturing requirements, with potential consequences for non-compliance including rejection or termination of awards and/or contracts. Contractors must acknowledge that false statements on the certification may result in disqualification. The form provides a template for contractors to sign, including spaces for company details, contact information, and a declaration of compliance with BABA provisions, which apply to both prime contractors and subcontractors involved in construction, alteration, maintenance, or repair projects.
