About this file

This document is a Build America, Buy America (BABA) Certification Form issued by the City of Fort Myers Procurement Services for a Community Development Block Grant-Disaster Recovery (CDBG-DR) Staff Augmentation project. The form requires contractors to certify compliance with federal regulations mandating the use of iron, steel, manufactured products, and construction materials produced in the United States, as stipulated by the Infrastructure Investment and Jobs Act passed on November 15, 2021.

The certification requires respondents to verify that they will identify domestic sources of BABA-covered products, provide verification documentation for BABA compliance, and submit waiver documentation when necessary. Contractors must acknowledge that false statements on the certification may result in rejection or termination of any award or contract. This requirement applies to the entire project, including subcontracted portions, and is part of the City of Fort Myers' procurement process for a $1.1 billion HUD allocation to Lee County, with potential projects spanning critical infrastructure, public facilities, affordable housing developments, and planning opportunities.
