About this file

This document is a Sole Source Justification Memorandum for the Naval Sea Systems Command Naval Surface Warfare Center Panama City Division (NSWC PCD). The document justifies a direct award to Motion Control Systems, Inc. for evaluation and optional repair of five SDV MK8 Motor/Control assemblies. The procurement is for repairing specific motor/control units with serial numbers 010B, 013, 016A, 024A, and 025A, using simplified acquisition procedures.

The justification is based on Motion Control Systems being the original equipment manufacturer of these custom motor controllers for the SDV, with no other manufacturers vetted or approved for substitution. The government determined that identifying and evaluating alternative systems would result in prohibitive additional costs and time delays. The Contracting Officer has concluded that this sole source procurement represents the best value and lowest overall cost alternative to meet the government's needs, citing unique manufacturing specifics and potential extensive re-evaluation costs as primary rationales for the direct award.

The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.

The Naval Surface Warfare Center Panama City Division (NSWC PCD) has a requirement to procure the Evaluation of five SDV MK8 Motor/Control assemblies. This requirement is not suitable for full and open competition for the following reason(s): The motor controllers referenced in the subject purchase request were custom manufactured by Motion Control

Systems, Inc. for the SDV, and Motion Control Systems is the Original Equipment

Manufacturer. Other manufacturers of similar controllers have not been vetted or approved for substitution. The additional costs and time delays for the Government to identify and evaluate another system; perform the field-testing of the equipment; and produce the required documentation and drawings would be prohibitive. As such, Motion Control Systems is the only source capable of meeting this requirement.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Motion Control Systems to provide the evaluations.

7. Any other facts supporting the justification. None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Motion Control Systems is the only source that can meet the requirement.
