About this file

This document is a Sole Source Memorandum for procuring a chlorine generator system for the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD). The procurement involves purchasing three NEXGEN 100SM-R 120 lb/day skid-mounted pH neutral chlorine generators, three 3HP booster pumps, installation services, and factory site services from Commercial Energy Specialists, LLC (CES) for a 9-million gallon test pond. The sole source justification is based on the existing infrastructure's compatibility with CES equipment and the potential significant costs and delays associated with switching to an alternative manufacturer.

The total procurement includes specific equipment with detailed technical specifications: chlorine generators with programmable touch screens, water-cooled power supplies, automated cleaning cycles, and comprehensive warranties. The document emphasizes that CES is the only OEM authorized distributor for these items in Florida, and that alternative chlorinator brands would require extensive facility modifications. The contracting officer has determined this procurement represents the best value and lowest overall cost alternative, with the requirement to be synopsized on SAM.gov. The acquisition will be conducted using simplified acquisition procedures, with no competitive bidding expected due to the specialized nature of the equipment and existing infrastructure.

10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).

NSWC PCD currently has chlorinators manufactured by Commercial Energy Specialists, LLC (CES) in use on the approximately 9-million gallon test pond. The current chlorinators have reached end of life and are needing replacement. The items listed in Paragraph 3 will replace the currently installed items and will not require significant modifications or changes to the pond facilities for install. The size, power requirements, communication lines, supporting tanks, environmental enclosure, and structural platform are currently in place based on the current chlorine generators. If another brand of chlorinator were selected that could handle the size of the test pool, modifications to the facilities would be required as other chlorinators would be too heavy to safely be supported by the existing platform, not fit within the existing enclosure, have different power requirements, and would require replacing the existing communications lines that are currently buried underground. All of this would result in additional unplanned costs to the Government and unplanned project inaccessibility to the test pond, which would result in unacceptable project delays. Furthermore, Commercial Energy Specialists, LLC is the only OEM authorized distributor for the items listed in Paragraph 3 of this document for the state of Florida.

As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.

Therefore, it is in the Government’s best interest to award on a sole source basis to Commercial Energy Specialists, LLC for the items listed in Paragraph 3 of this document.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Commercial Energy Specialists, LLC is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry SAM.gov.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 and 6 above, Commercial Energy Specialists, LLC is the only company that can provide the design of the system as required.
