About this file

This document provides justification for a sole source contract award. The Naval Surface Warfare Center Panama City Division intends to award a firm-fixed price purchase order to Clean Harbors Environmental Services, Inc. to transport and incinerate approximately 1,200 boxes containing paper and less than 350 pounds of nitrocellulose film from their facility. Extensive market research found Clean Harbors to be the only service provider able to destroy classified hard copies, film, CDs and video tapes in accordance with DOD requirements, transport and destroy the materials in the presence of a government witness, and supply chemists to travel to the government facility to package the hazardous waste. Therefore, awarding this contract sole source is deemed advantageous to the government.

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.

NSWC PCD Code 1032 has a requirement to the acquire transportation and incineration of library HAZMAT. This purchase is not suitable for full and open competition for the following reason. Extensive market research was performed to find a provider that can provide all the following required services:

a. Destruction of classified hard copies, film, CD’s and Video Tapes in accordance with the requirements of DODM 5200.01 V3.

b. Transportation and destruction in the presence of a government witness.

c. Chemists who can travel to the Government’s facility to package the HAZMAT waste.

The only service provider found that can provide all of the above services is Clean Harbors;

therefore, it is considered advantageous to the Government to award this purchase on a sole source basis to Clean Harbors Environmental Services, Inc. for the items listed in paragraph 3 above.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This requirement will be synopsized on the Contract Opportunities website at sam.gov per FAR Part 5.2. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Clean Harbors Environmental Services, Inc. to provide the products.

7. Any other facts supporting the justification. None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Clean Harbors Environmental Services, Inc. is the only source that can meet the requirement.
