About this file

This is a Request for Qualifications (RFQ) issued by the Cobb County Department of Transportation for engineering design consultant services for the Factory Shoals Pedestrian Bridge project (B2464). The project involves designing a dedicated pedestrian and bicyclist connection over Interstate 20 via Factory Shoals Road in south Cobb County, Georgia. The proposed 12-foot-wide shared-use path with 2-foot barriers on each side will connect existing sidewalks terminating approximately 210 feet north of the bridge to sidewalks at Riverside Parkway, improving pedestrian and transit access across the I-20 corridor. Engineering services required include survey database development, concept phase design, environmental documentation, preliminary design plans, right-of-way design, final design plans, and construction services through project completion. The RFQ utilizes a two-phase selection process: Phase I evaluates Statements of Qualifications (SOQs) based on project manager and key team leader experience and qualifications (30%) and resources and workload capacity (20%), with three to five finalist firms selected by a target date to be determined; Phase II requests a technical approach response (40%) and evaluates past performance (10%) from finalist firms. The SOQ submission deadline is November 12, 2026, at 12:00 p.m. through the County's eProcurement portal, with a non-mandatory pre-proposal conference scheduled for October 27, 2026, at 11:00 a.m. via Microsoft Teams. Written questions must be submitted by November 6, 2026, at 12:00 p.m., with the last addendum publication date of November 9, 2026. Final selection and contract negotiations will follow Phase II evaluation, with the contract type anticipated to be Lump Sum, Cost Plus Fixed Fee, Cost per Unit of Work, or Specific Rate of Compensation as a multi-phase, project-specific agreement remaining in effect through construction completion.

The contract amount will be determined through negotiations with Cobb DOT, with the County reserving the right to terminate negotiations with the highest-scoring finalist and begin negotiations with subsequent finalists if satisfactory terms cannot be reached. Funding sources include Federal and local appropriations, requiring compliance with Georgia Department of Transportation standards, guidelines, and the Plan Development Review Process. The prime consultant must be prequalified by GDOT in six specific area classes including Rural Roadway Design (3.01), Urban Roadway Design (3.02), Bicycles and Pedestrians Facility Design (3.13), Minor Bridge Design (4.01(a) and 4.01(b)), and Bridge Foundation Studies (6.02), with hydraulic and hydrological studies for bridges (4.04) also required. Team members must collectively hold prequalifications in an additional sixteen area classes covering environmental documentation, traffic operations, surveying, utility engineering, geotechnical studies, and erosion control. Respondents must provide notarized certification forms, Georgia Security and Immigration Compliance Act affidavits, proof of GDOT prequalifications current through the SOQ deadline, and documentation of accounting systems compliant with 48 CFR Part 31. No incumbent is identified. SOQ submittals are limited to specified page counts organized by section, submitted as single PDF documents through the eProcurement portal, with hyperlinks and embedded videos prohibited.

The Cobb County Department of Transportation (Cobb DOT) is soliciting Statement of Qualifications (SOQs) from qualified firm(s) to provide Engineering Design Consultant Services for the above referenced project.

The project consists of funding by Federal and local sources. Accordingly, the successful firm will be required to comply with all applicable Federal, State, and County rules and regulations. The funding sources REQUIRE this project to conform to the Georgia Department of Transportation’s (GDOT) Plan Development Review Process.

All engineering services shall be in accordance with all applicable guidelines of the American Association of State Highway and Transportation Officials, GDOT Standard Specifications for the Construction of Transportation Systems, Project Schedules, Plan Development Review Process, and Plan Presentation Guidelines, Cobb DOT Pre-Construction Process and Procedures Manual, and all other applicable Cobb DOT guidelines.

All project deliverables must be submitted to Cobb DOT for review and approval. Cobb DOT will coordinate all submittals to the GDOT.

I. GENERAL PROJECT INFORMATION

A. Project Overview

Project B2464 Factory Shoals Ped Bridge will provide a dedicated pedestrian and bicyclist connection over I-20 via Factory Shoals Road. This connection will improve travel for those who rely on walking and or transit to reach their daily needs.

Factory Shoals Road serves as a crucial north-south connection in the south Cobb County area. The road crosses over I-20 via a bridge (GDOT structure 067-0135-0) which was constructed in 1963; this bridge has a total length of 440 feet and is 31.2 feet wide, with a curb-to-curb width of 26.2. There are no pedestrian facilities across the bridge. On the north side of the bridge there are 5-foot wide sidewalks on the west side of Factor Shoals Road that terminate approximately 210 feet north of the bridge and connect to the Cobb County Fire Station. On the north and east side of Factory Shoals Road there are 5-foot sidewalks that terminate approximately 680 feet north of the bridge and connect to sidewalks along

Riverside Parkway and continue along Factory Shoals Road. The sidewalks south of the bridge are 5-foot sidewalks that terminate approximately 170 feet south of the bridge and are located on the east side of the road. This southern sidewalk connects to the sidewalks along Hartman Road and continues south along Factory Shoals Road.

The proposed project will begin just west of the Hartman Road intersection. The project will continue along the western side of Factory Shoals Road, crossing I-20 by the construction of a new pedestrian bridge adjacent to the existing roadway bridge. The new bridge will consist of a 12’-0” shared use path with a 2’-0” barrier on each side. The project will continue north of I-20 and terminate at the intersection of Riverside Parkway.

During Spring 2024, Cobb DOT kicked off a planning level scoping study (project number AR16 - Factory Shoals Pedestrian Bridge over I-20). The study was completed during the Fall of 2025. Documents relating to study are located on Cobb DOT’s website at:

https://www.cobbcounty.gov/transportation/transportation-planning/roadway-planning

X. COBB COUNTY TERMS AND CONDITIONS

A. With the submission of a SOQ, the respondent agrees that he/she has carefully examined the RFQ and agrees that it is the respondent’s responsibility to request clarification on any issues in any section of the RFQ with which the respondent disagrees or needs clarified.

The respondent also understands that failure to mention these items during the question period or in the SOQ will be interpreted to mean that the respondent is in full agreement with the terms, conditions, specifications and requirements in the therein. With submission of a SOQ, the respondent hereby certifies: (a) that this SOQ is genuine and is not made in the interest or on behalf of any undisclosed person, firm, or corporation; (b) that respondent has not directly or indirectly included or solicited any other respondent to put in a false or insincere SOQ; (c) that respondent has not solicited or induced any person, firm, or corporation to refrain from sending a SOQ.

The respondent also understands that failure to provide required information may result in disqualification. Failure to provide administrative information may not result in disqualification. At Cobb DOT’s discretion, the County may notify the respondent that administrative information is not provided or there was an error in the information provided, and the County will allow a respondent to provide an update to the administrative information. However, the exception to this is the provision of the required GEORGIA SECURITY AND IMMIGRATION COMPLIANCE ACT AFFIDAVIT which by Georgia Law requires disqualification of the response. The above changes mentioned to administrative information would be considered allowable as these would be limited to changes which do not affect the information which the evaluators use to score the respondents. Failure of a respondent to provide the specific administrative information as required in the notice will result in disqualification. Any respondent who provides changes in addition to the information requested in the notice shall be subject to disqualification. Failure of a respondent’s SOQ to provide any information pertaining to a respondent and its teams qualifications, of any type, will subject the SOQ to disqualification. The County will not allow updates to qualifications to be provided to avoid disqualification as this would allow a respondent to modify its SOQ and alter the information which evaluators would score. The above changes related to qualifications would not be allowable as these would allow changes which do affect the information which the evaluators use to score the respondents

SOQ.

The successful proposer shall be required to sign as part of the terms and conditions of their being engaged by the County the following statements regarding Conflict of Interest, Contingency Fees, and Certification of Subcontractors:

1. CONFLICT OF INTEREST -The Consultant certifies that, to the best of the Consultant’s knowledge, no circumstances exist which will cause a Conflict of Interest in performing the services required by this contract, that no employee of the County, nor any member thereof, nor any public agency or official affected by this Agreement, has any pecuniary interest in the business of the Consultant or his Subcontractor(s), and that no person associated with the Consultant or the Consultant’s Subcontractor(s) has any interest that would conflict in any manner or degree with the performance of the Agreement.

Should the Consultant become aware of any circumstances which may cause a Conflict of Interest during the term of this contract, the Consultant shall immediately notify the County. If the County determines that a Conflict of Interest exists, the County may require that the Consultant take action to remedy the Conflict of Interest or terminate the agreement without liability. The County shall have the right to recover any fees paid for services rendered by the Consultant which were performed while a Conflict of Interest existed if the Consultant had knowledge of the Conflict of Interest and did not notify the County within one (1) week of becoming aware of the existence of the Conflict of Interest.

2. PROHIBITION AGAINST CONTINGENT FEES – The Consultant warrants that the Consultant nor the Consultant’s Subcontractor(s) have not employed or retained any company or person other than a bona fide employee working solely for the consultant or Subcontractor(s) to solicit or secure this Agreement and that the Consultant nor the Consultant’s Subcontractor(s) have not paid or agreed to pay any person, company, corporation, individual, or firm other than a bona fide employee working solely for the Consultant or the Consultant’s Subcontractor(s) any fee, commission, percentage, gift, or other consideration contingent upon or resulting from the award of this Agreement.

For any breach or violation of this provision, the County shall have the right to terminate the Agreement without liability and, at its discretion, to deduct from the price, or otherwise recover, the full amount of such fee, commission, percentage, gift, payment, or consideration.

3. CERTIFICATION OF SUBCONTRACTORS. The Consultant shall require each of the Consultant’s Subcontractor(s) to sign a statement certifying to and agreeing to comply with the terms and conditions of 1 and 2 above. Such signed statements shall be on forms provided by the County. The Consultant shall return such executed forms to the County and they shall be incorporated in and become a part of the Agreement. No compensation shall be payable to the Consultant until executed certifications are received by the County for all of the Consultant’s Subcontractors.

B. Joint-Venture Proposals, Sub-Consultants, and Vendors

Cobb DOT does not generally desire to enter into “joint-venture” agreements with multiple firms. In the event two or more firms desire to “joint-venture”, it is strongly recommended that one incorporated firm propose and maintain status as the Program Management firm with the remaining firms participating as major firms. Any joint-venture, proposed and established as a separate business entity, should have its own set of books and supporting documentation sufficient for an audit trail. Transactions should be recorded consistent with the joint-venture agreement, and care must be taken to ensure that the joint-venture bears its equitable share of the costs. Therefore, “unpopulated joint-ventures” would not have an adequate accounting system suitable for cost reimbursement contracts.

However more traditional “populated joint-ventures” are welcomed. A populated joint-venture is where an alliance is brought to life by infusing it with working capital, employees, and control systems. The alliance implements all necessary business systems, including payroll processing, purchasing, property control, etc. The alliance will develop its own indirect rate structure and calculates its own indirect cost rates, based on the direct and indirect costs it incurs.

Sub-Consultants shall generally be considered any team member which is performing any service which typically requires prequalification, which is subject to the Audit and Accounting System Requirements, and whose services are billed as costs. Sub-Consultant Team Members must be written into the resulting Agreement and are subject to all terms and conditions in the Agreement. Vendors shall be considered any team member which is performing any service which typically does not require prequalification, which is not subject to the Audit and Accounting System Requirements, and whose services are billed as direct expenses. Vendors may not be written into the resulting Agreement and may not be subject to all terms and conditions in the Agreement.

C. Section Omitted

D. Audit and Accounting System Requirements

Cobb DOT reserves the right to reject any proposal with firms that do not meet the following requirements:

1. Firm(s) should have an accounting system in place to meet requirements of 48 CFR

Part 31 and, in the case of non-profit organizations, OMB Circular A-122.

2. Any firm that currently has an aggregate contract amount exceeding $250,000 should have submitted their yearly CPA overhead audit.

3. Firm(s) should have no significant outstanding deficient audit findings from previous contracts with Cobb DOT that have not been resolved.

4. The prime is responsible for being reasonably assured that all sub-consultant(s) presented as a part of the proposed team are similarly in compliance with the above requirements.

E. Submittal Costs and Confidentiality

All expenses for preparing and submitting responses are the sole cost of the respondent submitting the response. The County is not obligated to any respondent to reimburse such expenses. All submittals upon receipt become the property of the County. Labeling information provided in submittals as “proprietary” or “confidential”, or any other designation of restricted use will not protect the information from public view. Subject to the provisions until a final award.

F. Award Conditions

This request is not an offer to contract or a solicitation of bids. This request and any proposal submitted in response, regardless of whether the proposal is determined to be the best proposal, is not binding upon the County and does not obligate the County to procure or contract for any services. Neither the County nor any respondent submitting a response will be bound unless and until a written contract mutually accepted by both parties is negotiated as to its terms and conditions and is signed by the County and a respondent containing such terms and conditions as are negotiated between those parties. The County reserves the right to waive non- compliance with any requirements of this Request for Qualifications and to reject any or all proposals submitted in responses. Upon review of responses, the County will determine the respondent(s) proposal that in the sole judgment of the County is in the best interest of the County (if any is so determined), with respect to the evaluation criteria stated herein. The County then intends to conduct negotiations with such respondent(s) to determine if an acceptable contract may be reached.

G. Debriefings

In lieu of Pre-Award and Post-Award debriefings, the County will provide the “Selection Package” at the time of the Selection Announcement (also referred to as the Announcement of Entering into Negotiations). The “Selection Package” will include the scores and comments of phases for all firms who responded and will typically be provided as a PDF file and e-mailed. All debriefing for this RFQ shall be conducted in writing.
