About this file

This is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise Representation Form used for the solicitation titled "FBSU SHARP Copier Maintenance & Supply Service" (Solicitation/Sources Sought/RFI #75H70926BAO-034-SS), dated March 20, 2026.

The form serves as a self-certification document for offerors to declare whether they meet the definition of an "Indian Economic Enterprise" (IEE) with Indian ownership under 25 U.S.C. 47 (the Buy Indian Act). Offerors must certify their eligibility status at three critical junctures: when submitting an offer, at the time of contract award, and throughout the full contract performance period. Any loss of eligibility during these periods requires immediate written notification to the Contracting Officer. The form requires offerors to provide the name of the federally recognized tribal entity, the 51% owner of the IEE firm, business name, and UEI SAM number. Contracting Officers may require supporting documentation of eligibility before awarding set-aside or sole-source contracts, and awards are subject to protest if the offeror's eligibility is questioned. Successful offerors must also maintain current registration with the System of Award Management (SAM). The form explicitly warns that false or misleading information submitted with an offer violates federal law and is subject to penalties under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
