All work must comply with Professional Grounds Management Society standards, National Arborist Association standards, and American Society of Landscape Architects standards. PERFORMANCE WORK STATEMENT

GROUNDS MAINTENANCE SERVICES

Cold Region Research and Engineer Laboratory

Hanover, New Hampshire

1. . DESCRIPTION OF SERVICES The Contractor shall furnish all labor, supervision, tools, materials, equipment, and other items and services necessary to ensure that grounds maintenance is performed at the Cold Regions Research and Engineering Laboratory, 72 Lyme Road, Hanover, NH in a manner that will maintain healthy grass, trees, shrubs, and plants, maintain clear and safe roads and pathways in the winter, and present a clean, neat, and professional appearance. All services shall be performed in accordance with this performance work statement and Drawings 1-3. The drawings are a general representation of the facility and do not detail every grounds maintenance area to be maintained, it is the contractor's responsibility to verify actual service area that includes the entire lawn maintenance area, all trees, all shrubs, all flower bed areas, all sidewalks, and all roads.

The Contractor shall, be responsible for obtaining any and all necessary licenses and permits and comply with any applicable Federal, State or local laws, codes or ordinances in connection with the performance of this contract.

1.1. SITE SUPERVISOR The Contractor shall designate a site supervisor in .

charge of the work being performed during the execution of the contract. The site supervisor shall be responsible for the work schedule, safety, and quality control. The site supervisor shall keep the Government's Technical Point of Contact (TPOC) or the contracting officer's representative (COR) informed of the work progress and be available to the TPOC in the event of a change in the schedule or if any problems arise. Identification of and contact information for the site supervisor shall be provided to the Government at or before the post-award conference.

During the performance of the contract, Government notification of a change in the site supervisor shall be provided to the Contracting Officer's Representative (COR) not later than five (5) business days prior to the change or as soon as possible if the change occurs within five (5) days from the implementation of a change.

1.2. . MAINTAIN GROUNDS The spring, summer and fall grounds maintenance season is seven (7) months long, from April through October. Some items such as clean-up of leaves and vegetation occur outside of this timeframe in November. Grounds maintenance shall achieve healthy grass, trees, shrubs, and plants, and present a clean, neat, and professional appearance of the installation.

1.2.1. . Mowing of Grounds Grass shall be cut for the entirety of the CRREL facility. Grass clippings shall be handled (e.g. removed or mulched) so as to avoid an unattractive appearance and/or damage to the grass. The site is broken out into two areas, the east side is the improved grounds area and the west side is the semi-improved grounds.

1.2.1.1. . Improved Grounds There are approximately seven

(7) acres of improved grounds. Contractor shall maintain the growth of grass height on improved grounds between 1.5 to 3 inches; bear in mind that the rate of grass growth varies.

1.2.1.2. . Semi-Improved Grounds There are approximately eight (8) acres of semi-improved grounds. Contractor shall maintain grass on semi-improved grounds from 2 to 5 inches in height.

1.2.2. . Edging Sidewalks, driveways, curbs, and other concrete or asphalt edges located in the improved grounds areas shall be edged during every grass cutting.

Edging shall include removal of vegetation from cracks in sidewalks, driveways, parking lots and curbs within .5 inch of the edged surface and to a depth of 2.0 inches. This work includes all sidewalks, driveways, and curbs on the facility.

1.2.3. . Trimming Grass and weeds shall be trimmed around trees, shrubs, buildings, fences, poles, posts, fire hydrants, parking lot bumper blocks, boulders, and other fixed obstacles. Trimming height shall match surrounding area grass heights. This task involves all grounds, both improved and semi-improved. All areas shall be trimmed concurrent with mowing. Damage to trees and shrubs from trimming shall be repaired by the Contractor.

If a plant should die or become unhealthy due to damage, the Contractor will be responsible for replacing the damaged plant with a plant of same size and type. Plant replacement shall occur within 15 calander days of noticed damage.

1.2.3.1. . Security/Perimeter Fence Trimming shall be performed on both sides of the fence to maintain a minimum of 5' of clearance on each side.

1.2.4. . Remove Debris/Police Grounds The Contractor shall perform general litter patrol in for the entire facility to maintain a clean and well kept appearance.

Typical litter patrol includes the removal and disposal of all natural debris, (tree limbs, dry brush, rodent habitats, dead animals, etc.), and man-made debris/trash; debris such as fruit and berries that have fallen onto walkways, driveways and parking lots. Contractor shall police areas during mowing operations in order to maintain a clean and well kept appearance. The contractor shall dispose of all debris at an off-site location in accordance with existing local, state, and federal regulations.

1.2.5. . Repair Damaged Areas Areas damaged by rodents, contractor vehicles, erosion, drought and/or insects/diseases shall be seeded, sprigged, or repaired with sod to be uniform with surrounding areas.

1.2.6. . Apply Herbicide The Contractor shall perform an effective application of a non-selective herbicide to areas damaged by insects or overgrown by invasive plants, weeds and poison ivy with prior approval of the TPOC. The approved herbicide shall be applied in accordance with the manufacturer's instructions.

1.2.7 Leaf Collection and Removal

The Contractor shall rake or use other methods to collect all leaves, pine straw, pinecones, limbs, and other debris from the improved grounds and present a clean, neat, and professional appearance of the installation. Leaf Cleanup includes Leaf removal, Trash cleanup, Yard Waste removal, Limb Cleanup, blowing Lawns, Parking lots/Sidewalks, removing all Leaves/Debris from lawns, parking lots and flower beds. Contractor will remove/blow leaves from corners of buildings and out of fence lines and remove from site. All leaves shall be removed from Government property and disposed of in an appropriate and legal manner by the Contractor.

The contractor may mulch leaves as long as this method is effective in eliminating them from the grounds. Cleanups shall take place one time per year every fall and be coordinated with the

COR.

1.3. . MAINTAIN TREES/SHRUBS/HEDGES/FLOWER BEDS This work shall take place once in May and Once in August.

1.3.1. . Trimming/Pruning Contractor shall prune trees in improved and semi-improved areas. Pruning shall be accomplished in accordance with industry (ANSI Z133.1

- 1994) standards. Class II medium pruning shall be used in general on all trees. Class IV pruning shall be used only for lifting, removal, and/or cutback of branches that conflict with normal traffic or safety in the vicinity of the trees. Minimum safety clearance is 14 feet over streets, 12 feet over driveways, 8 feet over walk areas, 5 feet above fence lines, and 4 feet from buildings. Other trees shall be pruned on an as-required basis to provide safety, clearances and /or to prevent structural damage. Hedges next to buildings shall be trimmed to keep growth below window level. Topping and de-horning shall not be permitted. Trimming/pruning of trees around utility poles/power lines is the responsibility of the Contractor. The contractor shall notify the TPOC when trimming/pruning around utility poles/power lines as needed. Shrubs, small trees, and other plants shall be maintained according to the American Society of Landscape Architect's standards. They shall be pruned as required to maintain their natural growth characteristics. Hedges shall be maintained to their natural mature height and shape.

Broadleaf evergreens and flowers beds shall be pruned annually, to maintain clearances of a minimum of 3 inches from buildings, sidewalks, or other obstructions.

1.3.1.1. . Security/Perimeter Fence A minimum clearance of 5' shall be maintained above and on each side of the site security fence. Contractor shall remove any limbs or vegetation leaning or fallen on top of the fence.

1.3.2. . Maintain Flower Beds and Planter Areas Water, edge, eliminate weeds, and repair or replace damaged plants in flower beds and shrub and planter areas as identified in drawing #2 of Appendix C. All weeds shall be removed or eradicated manually or mechanically, but not chemically. This work shall take place once in May and Once in August.

1.3.2.1. . Planter Barriers Contractor shall maintain existing evergreens in planter barriers (15) located at the north and south gates. In May, the Contractor shall select and plant annual flowers in each planter and maintain them, removing dead flowers and weeds as necessary during the growing season. The Contractor shall clean out the dead plants during the fall cleanup.

1.3.3. . Mulch All flower beds, tree bases, hedges, planter barriers, shrubs and planters shall have a new layer of fine ground dark mulch applied approximately 2" thick. The contractor shall clean out old mulch when mulch thickness reaches approximately 8" thick prior to applying new mulch.

1.4. . PERFORM SNOW/ICE REMOVAL Performance of snow and ice removal shall maintain clear and safe roads, sidewalks, and pathways for the entire facility. The Contractor is responsible for snow and ice removal and treatment with salt, sand and ice melt for all sidewalks and roads on the facility. Areas include all walkways, steps, driveways, parking lots, building entrances, dumpsters, propane and fuel tanks, overhead doors, emergency generator access and gates. Removal is defined as clear of ice and snow, down to bare surface or pavement. This may require multiple snow/ice removals each day. Drawing 3 is a general representation of the facility and all entire facility is included in this requirement and shall be verified by the Contractor.

Winter snow removal under this contract is five (5) months long, from November through March. In the event snow/ice occurs outside of this timeframe the Contractor shall provide the same services identified in this section and submit a Request for Equitable Adjustment (REA) for the additional time.

1.4.1. . Timing of Removal Plowing and shoveling operations shall be timed such that the Priority Area is plowed and shoveled for secure footing and safe driving conditions prior to 0700 hours, Monday through Friday. The treatment of the remaining areas shall be completed by 1200 hours. If the event begins after 0700 and/or is an ongoing storm, operations will begin and/or continue throughout the storm to prevent accumulations from exceeding one (1) inch.

On weekends and holidays, snow removal commences when accumulation exceeds two (2) inches or if icy conditions exist and completion shall be within six (6) hours. The following areas may be completed on the next normal work day; Navy Pond, Storage Pad and Hazardous Waste Area by 0900 hours, CDC fenced in areas by 0700 hours.

Bare pavement shall be achieved within 24 hours after the snow event ends.

1.4.2. . Winter Season Oversight The Contractor is responsible for keeping track of the weather during the winter snow and ice season. The Government may call the Contractor's Point of Contact in the event a localized snowfall occurs on site.

1.4.2.1. . Non-Snow/Ice Events During the winter season, snow and ice may accumulate on walkways and pavement due to wind and changes in temperature. The Contractor is responsible for walking the Priority Area daily and checking for ice and snow drifts that have formed overnight. These areas shall be treated prior to the start of normal working hours, by 0700.

1.4.3. . Supplies The Contractor is responsible for supplying all tools, equipment, salt, sand and ice melt necessary for the winter season.

1.4.3.1. . Salt Storage The Contractor shall provide, maintain, and place salt in the salt storage shed identified in drawing #3. The Contractor shall maintain a supply of salt in the storage shed for use during the winter season. No salt will be stored in the shed outside of the winter months. The Contractor shall keep the area in and around the storage shed clean and dispose of all trash and debris found in this area.

1.4.3.2. . Sand The Contractor shall use sand when temperatures are too low for salt to be effective (approx. 15 degrees F). The sand supplied shall be mixed with approximately 20% salt. The Contractor shall remove and dispose of excess accumulations of sand in the spring in accordance with subparagraph 1.5.1.

1.4.3.3. . Ice Melt The Contractor shall use Calcium Magnesium Acetate (CMA) or equivalent, for ice melt. Before every snow and ice event, Ice melt shall be spread on the walkways, building entrances, outside steps and stairways, sidewalks, handicapped designated areas, ramps and areas of heavy foot traffic from the parking lots. The Contractor shall provide, maintain, and place ice melt containers (approximately 16) in areas identified by the CRREL COR or TPOC. The Contractor shall keep the containers full of ice melt throughout the winter season. The Contractor shall keep the area in and around the ice melt containers clean.

1.4.5. . Utility/Fire Ammonia Plant Access The Contractor shall maintain all access pathways to the propane tanks (6), the fuel oil tanks (5), fire hydrants (6), fire pull stations at the Technology Information Analysis Center (TIAC) and the Ice Engineering Facility (IEF) (2), emergency generator access (3), dumpster locations (8), and Ammonia Plant.

Locations are identified in drawing #3.

1.4.6. . Gates The Contractor shall clear all snow and ice around the north and south gate entrances, ensuring free movement of the automatic gates. The boxes for the gate operators and the hydraulic units for the pop-up barriers shall be kept clear and accessible. The manual access gates to the Logistics Storage Pad, the Night Vision Lab fenced in area, and the Northwest Gate shall also be cleared of snow and ice for proper operation.

1.4.7. . Pathways The Contractor shall ensure a minimum pathway 3 feet wide on all walkways.

1.4.8. . Snow Piles Snow pile accumulation in parking areas shall not force CRREL employees to move to remote parking areas due to loss of parking capacity or cause damage to surrounding fences. When snowfall is heavy or accumulations begin impinging traffic and/or parking areas, the Contractor must place excess snow in accumulation areas identified in drawing #3. If the accumulation areas become too full to accommodate the amount of snow collected, the Contractor shall remove the excess snow and dispose of it off-site.

1.4.9. Plowing Markers. Contractor shall install plastic or fiberglass pole markers along the CDC fence line and the TDY parking area to prevent plow damage.

1.5. . SPRING SAND CLEAN-UP

1.5.1. . Remove Sand The Contractor shall remove all winter sand accumulated on the parking lots, roadways, sidewalks and lawn areas where the sand has collected from the winter snow piles. This shall be accomplished one time in April.

1.5.1.1. . Schedule for Sand Clean-up The Contractor shall schedule the sand clean-up to take place after normal working hours to prevent dust from entering ventilation systems and to move vehicles out of parking areas. No clean-up will take place in parking lots while employee vehicles are present. A water spray shall be used to minimize the amount of dust stirred up around the buildings. The Contractor shall remove the sand from CRREL premises and dispose of it in accordance with existing local, state, and federal regulations.

1.7. . MAINTAINING PROJECT TEST SITE AREAS There are several research projects located throughout CRREL that require maintenance services. These sites and maintenance requirements may be seasonal and/or for short periods of time. These sites will be reported to the Contractor by the COR. This sites may include instrumentation, wiring and equipment. The Contracting Officer will notify the Contractor of any changes in the frequency or type of maintenance requirements.

2. . PERFORMANCE REQUIREMENTS SUMMARY The Contractor's performance requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success. [See Performance Requirements Summary (PRS).]

3. SERVICES GOVERNMENT FURNISHED PROPERTY AND The Contractor will be provided access to potable water for watering during seeding and for dust prevention during spring sand clean-up. Storage area of approximately 500 sq ft will be provided for tools and small equipment. Large equipment will not be allowed on site without prior approval of technical point of contact.

4. . GENERAL INFORMATION

4.1. . QUALITY CONTROL The Contractor shall develop, submit for contracting officer approval, and maintain a quality program to ensure grounds maintenance services are performed in accordance with established standards of Professional Grounds Management Society (PGMS), National Arborist Association, American Society of Landscape Architects, and the local county extension office. The Contractor shall develop and implement procedures to identify, prevent, and ensure quality compliance and non-recurrence of defective services. As a minimum the Contractor shall develop quality control procedures addressing the areas identified in the PRS, and a work schedule that captures all known requirements. The work schedule shall be submitted to the COR by or before the post award orientation. A revised work schedule shall be provided to the COR as soon as practical following a revision.

4.2. . QUALITY ASSURANCE The government will evaluate the Contractor's performance in accordance with the PRS.

4.3. HOURS OF OPERATION. Normal hours at USACRREL are Monday thru Friday from 0700 to 1600 excluding Federal holidays. Contract services shall be performed during normal working hours unless written otherwise specified in the contract or authorization is received from Contracting Officer (KO) or COR; or an emergency condition arises and the contractor is notified by the KO or COR. Lawn maintenance and snow plowing operations may take place outside of these hours, as long as noise is kept to a minimum so as not to disturb the neighboring residents.

4.4 . SPECIAL EVENTS. Special events may be scheduled throughout the summer and fall that require a rescheduling of the day the contractor has scheduled mowing to occur.

These events are expected to be less than 6 times in the summer. The contractor will be notified by the COR of the event dates a week in advance to allow time for rescheduling of services.

4.5. . CONTRACTOR LIABILITY Government-owned or privately owned property damaged by the Contractor's operations under this contract shall be replaced or repaired to original condition by the Contractor at no additional cost to the Government.

4.6. SECURITY REQUIREMENTS.

4.6.1. . U.S. Citizens Contractor personnel must be U. S. citizens. All Contractor personnel are required to sign in with Security to obtain and wear security identification badges. A picture ID is required. Contractor personnel shall follow all sign-in and security regulations as directed by the CRREL Security Office and the TPOC.

4.6.2. . No Weapons Allowed All persons and vehicles entering a US Government facility are subject to inspection for firearms, explosives and dangerous weapons, per RA 190-22.

4.6.3. General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor ("Contractor") and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as "RAMs"), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.

4.6.4.Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation /facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index (commonly referred to as "NCIC-III") and Terrorist Screening Database (commonly referred to as "TSDB"). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the

RA.

4.6.5. Suspicious Activity Reporting training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.

4.6.6. Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.

4.7. . SAFETY REQUIREMENTS

4.7.1. . Safety Regulations Safety shall be in accordance with applicable provisions of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385- 1-1, available at http://www.usace.army.mil/CESO/Documents/EM385-1-1FINAL.pdf/ for review, and OSHA 29 CFR 1910 regulations, which covers personal protective equipment. All applicable state and federal safety regulations relating to protection of eyes, other extremities, and hearing protection shall be followed. Machinery and equipment shall be operated in accordance with the manufacturer's instructions and recommendations. Ensure operation of machinery and equipment does not jeopardize pedestrian safety, use.

Contractor shall prepare and submit an 4.7.2. . Accident Prevention Plan Accident Prevention Plan (APP) to the COR for approval by the USACRREL Safety Office seven (7) calendar days prior to the pre-performance meeting. The APP shall focus on the Contractor's Safety Programs and shall be site specific to the work being performed. This plan will be a statement of the company's policy concerning accident prevention and any other guidance statements normally furnished new employees. The minimum basic outline for an Accident Prevention Plan is spelled out in EM 385-1-1 and attached in Appendix C.

In order to help promote safety 4.7.3. . Employee Safety Awareness awareness, the Contractor shall insure that each employee reviews the Accident Prevention Plan prior to beginning work.

4.7.4. . Operating Vehicles Contractor personnel shall wear seatbelts at all times when driving on CRREL premises. Contractors shall obey speed limit of 10 mph.

Contractor vehicles shall be equipped with back-up alarms. Particular care shall be used while operating vehicles in the Child Development Center parking area where small children will be entering and exiting. FAR clause 52.226-8 Encouraging Contractor Policies to Ban Text Messaging While Driving is applicable to this contract.

4.7.5. . Material Safety Data Sheets The Contractor shall provide Material Safety Data Sheets (MSDS's) for any products or materials brought on the facility for use in the performance of this contract (e.g. ice melt, weed killer, etc...). No product may be used without the prior approval from the TPOC.

There is no smoking allowed in any ERDC building or 4.7.6. . No Smoking facility, or within 50 feet of any building entrance. A designated smoking shack is located by the north FE parking lot.

4.8. . Post Award Orientation Prior to beginning any work under this contract, the Contractor shall meet formally with the Contracting Officer and/or TPOC/COR at a time, date and location established by the TPOC/COR for the purpose of coordinating the initiation of work.

The Contractor and his/her Authorized Representative (if one is to be appointed) shall be present at this meeting. An Authorized Representative must be capable of making decisions on behalf of the company.

INTRODUCTION

A performance requirement summary (PRS) has been developed to evaluate contractor actions while implementing this PWS. It is designed to provide an effective surveillance method of monitoring contractor performance for each listed objective.

The PRS provides a systematic method to evaluate the services the contractor is required to furnish. This PRS is based on the premise that the Government desires to maintain a quality standard in the performance of the required services and that a service contract to provide the service is the best means of achieving that objective.

The contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract. The role of the Government is quality assurance to ensure contract standards are achieved.

In this contract the quality control program is the driver for product quality. The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a "self-correcting" contract is to ensure that the quality control program approved at the beginning of the contract provides the measures needed to lead the contractor to success.

Once the quality control program is implemented, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program.

SURVEILLANCE: Government quality assurance (QA) is performed by the COR. Contract Deficiencies will be reported to the Contractor's site supervisor, or Quality Control Inspector (if identified as different from the site supervisor), for correction. Customer complaints, although not considered a method of surveillance, will be investigated to establish validity. All valid complaints will prompt an inspection of the deficiency. It should be noted that the method of surveillance identified in the PRS table is intended to represent the primary method(s) anticipated for each requirement. However, the Government reserves the right to conduct quality assurance by any means necessary to ensure the requirements of the contract are being fully satisfied. See the following table for the further details.
