About this file

This document is a Justification for Brand Name Products issued by the National Park Service (NPS) for a generator replacement project. The NPS is seeking to purchase and install two generators for the FOUN headquarters building and visitor center, with a requirement for specific brand name products from a single manufacturer. The solicitation will be issued on sam.gov for acquisitions over $25,000, with competitive quotes anticipated. The justification emphasizes maintaining consistent equipment for easier maintenance, troubleshooting, and coordination with service contractors, particularly important given staffing shortages. The interested source is Martinez Propane Company Inc. in Mora, New Mexico, and the technical certification was completed by Marcus Anderson on 9/4/25, with the contracting officer James Bissaillon certifying the document on 9/5/25.

Justification for Brand Name Products

Project: FOUN Replace HQ and VC Generators (Purchase and Installation)

1. Identifications

a. Agency: National Park Service

b. Contracting Office: Nebraska Major Acquisition Buying Office

2. Description of the action being approved:

The National Park Service (NPS) is soliciting for the purchase and installation of two generators, including the removal of the existing generators. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).

3. Description of supplies and services: Purchase and installation of power generators for the FOUN headquarters building and visitor center. The contractor shall provide and install all the required equipment as listed in the SOW. The contractor shall test all installed equipment to ensure proper function and workmanship before delivery of the vehicle to NPS. The contractor shall review and demonstrate the full functionality to park personnel.

4. Authority:

a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.

c. FAR 6.302-1: The use of the name brand products are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

5. The description of the product’s unique qualifications or the unique nature of the acquisition:

A consistent brand allows maintenance personnel to become proficient in troubleshooting, reducing downtime, which is especially important with staffing shortages. It also simplifies coordination with service contractors who are familiar with the brand.

6. Efforts to obtain competition:

a. Efforts to ensure offers are solicited from as many potential sources as is practicable:

For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, sam.gov.

b. Presolicitation notice per FAR 5.2:

For acquisitions over $25,000 a pre-solicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.

7. Determination that costs will be fair & reasonable:

Competitive quotes are anticipated. If there is no competition, there are several past awards for the same/similar requirements which may be used for price analysis.

8. Description of the market research conducted:

This requirement will be solicited under commercial terms and conditions. Modification of equipment is not desired as there are COTS items that meet the required specifications, which should result in lower pricing. The customer verified their requirement specifications and obtained a quote who has an active SAM registration.

9. Other facts supporting other than full & open competition:

a. Reason why documents suitable for full & open competition have not been developed:

By procuring the same brand of generators, the park ensures greater efficiency, safety, and cost-effectiveness in the operation and maintenance of its facilities

b. Data, estimated costs or other rationale as to the extent or harm to the Government:

Maintenance requires the equipment they use to be standard/consistent for ease of use and safety. Other equipment or inconsistent equipment could potentially cause a risk to personnel.
