4. Authority:

FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold, only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name, or industrial mobilization).

4. Reason for Authority Cited:

Autonomy Systems LLC owns the rights to Qdabra FormsViewer software, however there are multiple licensed resellers on the market which will increase competition and reduce overall costs.

a. Explain why the intended Contractor is the only reasonable source who can provide the required supplies or services. Discuss the unique capabilities, expertise, etc.

that support the lack of competition.

Authorized resellers of this license exist, and as a result, competition will exist as a Brand Name only request for quote.

b. Describe the detrimental effects/serious injury to the mission of the requiring activity or to the Government, financial or otherwise, that will result if this SSJ is not approved, and the product or service cannot be provided by the intended brand name

Over one hundred InfoPath forms will stop working if they are not converted using this product once Microsoft drops support for InfoPath. Personnel that depend on those Forms for day to day business will have their work be affected.

1) Cost Avoidance: Transitioning to an entirely new platform would require significant investment in development, training and testing. Qdabra offers a drop-in solution that mitigates cost and schedule impact to the Government.

2) Mission Continuity: The forms affected include mission-critical applications. Any interruption would directly affect operational timelines.

8. Requirements Certification:

I certify the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.

9. Fair and Reasonable Cost Determination:

I hereby determine the anticipated cost to the Government for this contract action will be fair and reasonable.

Basis for Determination: The basis of this contract action will be competition as this is a Brand Name competitive requirement. In the event only one quote is received, the Government will conduct price analysis in accordance with FAR Part 13.106-3 techniques.

10. Contracting Officer Determination:

I certify this justification is accurate and complete to the best of my knowledge and belief.
