Section C - Descriptions and Specifications
DESCRIPTION OF REQUIREMENT
Description of Requirement (DOR)
A. Overview:
The Cold Regions Research and Engineering Laboratory (CRREL), Engineer Resources Branch (ERB) requires three (3) environmental chambers, also known as temperature / humidity chambers, to conduct battery testing in a controlled environment down to -65 °F. Specifically, CRREL will be testing to MIL-STD-810H Method 502.7 and MIL-PRF-32565. The specifications are outlined below.
Technical experts at CRREL will review each quote offered to CRREL in response to this solicitation. To be considered, each quote must fulfill the required elements and specifications requested under this DOR (DOR Part A, B, and C) and structured per the anticipated award structure.

C. Onsite Service Requirements:
Installation & Training Service: The products need to be installed and tested for accuracy and functionality by the vendor prior to CRREL acceptance. During installation, the vendor’s representative shall offer any relevant onsite training of the system prior to departing. This will require onsite work at CRREL for one or more days by a US Citizen with proper identification after a security check (in Section C, Anti-Terrorism and Operational Security Requirements (AT/OPSEC).
D. General Requirements:
Delivery Location: For shipping, be aware that we require the chambers to be shipped to: CRREL, Attn Timothy Cooke, 72 Lyme Road, Hanover NH 03755 to arrive at the CRREL campus per shipping timeline requirements specified in this document under Delivery Timeline. Shipping costs should be included in your quote. FOB Destination Applies to the entire procurement.
Delivery Timeline: The items should be delivered as listed in the section “Anticipated Award Structure.”
Additional time may be granted upon vendor request if the Contracting Officer (KO) and Technical Point of Contact (TPOC) concur.
Acceptance and Invoicing: Prior to any invoice being submitted, the products need to be installed and tested for accuracy and functionality by the vendor, and an email needs to be sent by the CRREL Technical Point of Contact (TPOC) to the vendor confirming CRREL acceptance. The vendor is reminded to follow invoicing instructions in Section G of the awarded contract and email a PDF copy of the invoice to the TPOC and Invoice Receiver listed below:

Equipment Warranty: The vendor is requested to provide information explaining their equipment warranty and support policies to cover system problems or malfunctions inherent to the system (i.e., not caused by customer use). Equipment that fails to perform as expected may need to be returned to the vendor for trouble shooting; the government expects the vendor will address equipment malfunctions inherent to the system (i.e., not caused by CRREL use).

E. Anti-Terrorism and Operational Security Requirements (AT/OPSEC): This procurement requires on-site services thus the following requirements apply.
1. General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)).
Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures—this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
2. Antiterrorism (AT) Level I training: This applies to any contractor needing multi-day access onsite at ERDC, excluding contractors visiting ERDC for a short 1-day or less visit to meet with ERDC staff using standard visitor protocols. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Online AT Level I awareness training is available at https://jko.jten.mil/ (website subject to change). Upon request, the contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training by all employees and subcontractor personnel.
3. Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index (commonly referred to as “NCIC-III”) and Terrorist Screening Database (commonly referred to as “TSDB”). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed.
4. Suspicious Activity Reporting training (e.g., iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.
4. Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E- Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

INSTRUCTIONS TO OFFERORS
PROPOSALS ARE DUE BACK TO KIM.D.ROBERSON@USACE.ARMY.MIL BY 12PM (CDT) ON
FRIDAY, MAY 19, 2023.
It is the offeror’s responsibility to ensure that the proposal is submitted complete and accurate.
Corrections will not be made by the Government. The proposal must show that your product will meet and deliver the specifications outlined in Section C, Description of Requirement.
The vendor is requested to provide clear proposals showing that their products meet all the listed requirements in order to ensure the technical experts see that an offered product will meet all the required standards. Proposals that are ambiguous or are missing required information may be disqualified.
A signed copy of this RFQ shall be included in your submission. The proposal shall also address the following items:
1. A Point of Contact (POC) and alternate POC, including phone numbers and emails, who has authority to make decisions for the company.
2. Provide the company’s CAGE Code and Unique Entity Identifer (UEI) number.
3. The Offeror’s proposal must contain pricing for all items listed in Section C, Description of Requirement.
4. Provide an expected delivery schedule.

Offerors are required to have an active System for Award Management registration, no active exclusions, and BOTH FAR AND DFARS representations and certifications completed in order to receive a Department of Defense contract award. Representations and certifications should be completed by the RFQ closing to avoid any unnecessary delays in contract award. Depending on the needs of the requiring activity, the Government may or may not provide additional time to register with SAM. Ensure that all representations and certifications required by this RFQ are either included in the online FAR and DFARS report and/or included with your proposal submission.
