About this file
This is a Brand Name Justification for Restricting Competition document submitted by the Department of the Interior's Interior Business Center for a simplified acquisition under RFO 12.102(a).
The National Institutes of Health's Center for Cancer Research requires replacement of an old, unreliable H&E slide stainer and coverslipper with a new model to address recurring breakdowns that have impeded pathology slide diagnoses. The procurement is restricted to Leica Biosystems brand equipment and services. The contractor must provide installation, setup, validation in accordance with College of American Pathologists accreditation requirements, training for six histology technicians in operation and technician-level maintenance, and one year of on-site maintenance following manufacturer's standard commercial practices. Required Leica Biosystems items include the HistoCore CHROMAX CV-WS (Part #14048562193), ChromaxCV Silver Service 1-5 years old (Part #9CON-S-CHRMXCV 1-5), Histocore Chromax ST instrument (Part #14048677888), ChromaxST Silver Service 1-5 years old (Part #9CON-S-CHRMXST 1-5), and two USA power cords (Part #14041157009). The performance period is 09/15/2026 through 09/14/2027. The justification cites compatibility with existing Leica equipment, existing slide staining protocols, and reagents as rationale for restricting competition. The document notes that alternative manufacturers cannot provide equivalent validation support or compatibility without introducing duplication of effort, support gaps, accreditation risk, and operational disruption. Leica will accept trade-in of the old equipment and provide additional discounts beyond trade-in value.

BRAND NAME JUSTIFICATION FOR RESTRICTING COMPETITION
UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
AUTHORITY: RFO 12.102(a), 41 U.S.C. 1901
SOL # 140D0426Q0862
1. Contracting activity/agency. Department of the Interior, Interior Business Center, Acquisition Services Directorate, U.S. Department of Health and Human Services, National Institutes of Health (NIH), Center for Cancer Research (CCR).
2. Description of supplies or services required to meet agency needs.
This request is to replace an old undependable H&E slide stainer and coverslipper with a new model. This instrument is heavily used, and reoccurring brake-downs have impeded pathology slide diagnoses. The Government requires installation, setup, validation, training, and on-site maintenance of a brand-name H&E slide stainer and coverslipper. The contractor shall provide all labor, materials, and equipment to: (1) install and set up the instrument; (2) validate in accordance with College of American Pathologists accreditation requirements; (3) train six histology technicians in proper operation and required technician-level maintenance; and (4) provide one year of on-site maintenance in accordance with the manufacturer’s standard commercial practices.
The Independent Government Estimate (IGE) is with a Period of Performance (PoP) of 09/15/2026 – 09/14/2027.
3. Identification of the limited source(s) to be solicited.
This acquisition is restricted to the Leica Biosystems brand of manufacturer labor, material and equipment necessary to install and set up an H&E slide stainer and coverslipper. The acquisition will be issued as an open market utilizing the Government Point of Entry (GPE) for Federal Acquisitions through SAM.gov. Offerors will be required to be approved resellers. Below are the brand name items with the description and part numbers required for this procurement.

4. Detailed Rationale
RFO 12.102(a), 41 U.S.C. 1901 – The contracting officer must justify restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer).
H&E slide stainer and coverslipper are manufacturer-specific services that are delivered in direct support of Leica Biosystems currently being used at NIH CCR.
Acquiring the latest model of H&E slide stainer and coverslipper is needed to integrate and maintain the existing slide staining protocols and reagents to ensure continuity with patient diagnosis.
Because these are directly tied to Leica Biosystems equipment and maintenance, they cannot be reasonably substituted by equipment from other manufacturers without introducing duplication of effort, support gaps, or compatibility risks.
Alternative brands do not provide the required validation support or compatibility, and substituting another brand would introduce unacceptable duplication of effort, risk to accreditation, and operational disruption. Purchasing the latest model of H&E slide stainer and coverslipper is therefore the most efficient and lowest-risk approach for meeting the Government’s ongoing requirements. Limiting consideration to the brand name ensures continuity of care and compliance. In addition, Leica will accept a trade-in of their old equipment and provide discounts on top of the trade-on discount.
