About this file
This is a Brand Name Only Justification document for a federal contract action submitted by the Fort Apache Agency (Bureau of Indian Affairs, Western Region).
The procurement seeks two STIHL MS 400 C-M 25" bar chainsaws as a new requirement under Purchase Request Number 44055741, with firm-fixed pricing. The justification for brand-name-only procurement is based on GSAR 538.7104-4 authority. The contracting officer determined that the STIHL MS 400 C-M is uniquely qualified because it is fully compatible with existing STIHL bars, chains, maintenance tools, and support equipment already in the agency's inventory. Using a different brand would create logistical inefficiencies, increase maintenance complexity, and impose additional costs associated with mixed-brand equipment support. Market research confirmed that multiple commercial vendors are capable of supplying the required STIHL chainsaws through authorized distributors and resellers, ensuring adequate competition exists among vendors capable of supplying the specified brand-name products. The contracting officer determined the anticipated cost to the Government will be fair and reasonable based on adequate price competition among potential vendors, comparison with Independent Government Estimates, historical data, and GSA pricing. The requirement will be publicized as required by Subpart 5.201(a) as a combined Synopsis/Solicitation on SAM.gov. No sources expressed written interest in the acquisition, and no specific actions are planned to overcome barriers to competition for subsequent acquisitions.
