1.3 CONTRACTOR USE OF SITE
A. General: Contractor shall contain all demolition work, staging, equipment and personnel within the limits of disturbance and shall have use of the various sites during the period of the work.
B. Storage of Materials: Confine storage of materials within the limit of disturbance as shown on the drawings or as directed by the Contracting Officer.
C. Preservation of Natural Features:
1. Prevent damage to natural surroundings by keeping all work and staging within the limits of disturbance. If contractor causes damage, contractor shall restore damaged areas, repairing or replacing damaged trees and plants, at no additional expense to the
Government.
2. Contractor shall ensure that all equipment has been thoroughly washed and contains no offsite plant material and/or seeds prior to mobilizing to each site.
3. Provide temporary stakes and barrier tape to protect existing trees, plants, and root zones.
4. Do not remove, injure, or destroy trees or other plants without prior approval. Consult with
Contracting Officer and remove agreed-on roots, branches and trees that interfere with the work.
5. Do not fasten ropes, cables, or guys to existing trees.
6. Exercise caution and carefully supervise excavating, grading, filling, and performing other demolition operations and activities near trees to prevent damage.
7. Eastern Box Turtle: Between April 1 through October 31 any box turtle found within the limit of disturbance (LOD) for a project site shall be moved outside the LOD (in the direction it is going) by hand in order to avoid impacts to box turtles during demolition.
The Contractor shall provide site review sweeps prior to equipment use at the beginning of the day, after breaks and after lunch to avoid impact to the eastern box turtle. If for any reason a turtle is killed it MUST be reported to the Contracting Officer and MA Natural
Heritage and Endangered Species Program.
CACO 304727 01 11 00 - 10
8. Migratory Shore Birds: Only transient individuals are expected in the area of these sites.
No tree cutting or vegetation clearing shall occur between April 1 and July 31 unless vegetation has been surveyed for nesting birds and cleared for removal in accordance with the Migratory Bird Treaty Act to protect nesting birds.
9. Bat Habitat Limitations and Construction Sequencing – All Properties – US Fish and
Wildlife Service has not officially confirmed that the project is not likely to adversely affect the federally listed threatened Northern Long-eared Bats. The Contactor shall sequence the work following mitigations for the project as required by USF&WS.
a. State-listed bat species include the Northern Long-eared Bat and the Little Brown
Bat. Federally listed bat species include the Northern Long-eared Bat.
b. All properties were surveyed for the presence of the state listed Little Brown Bat and the federally listed Northern Long-eared Bat in July and early August 2022.
Consultation with the USFWS is required for those properties where bats were found. The outcome of that consultation may result in the issuance of conditions such as time of year restrictions. Properties where bats were not found require no consultation and there are no species-related restrictions. Requirements as a result of USF&WS consultation for the purpose of preparing a bid should be assumed to be:
1) Abatement and demolition work will occur only in the winter, November 1 through March 31.
c. For the purpose of preparing a bid, the contractor should assume no bat hibernacula are present.
d. A copy of the bat surveys performed during July/August of 2022 is available on request.
e. Trees greater than or equal to 3-inches dbh (diameter at breast height) shall be saved wherever possible. Removal of any trees greater than or equal to 3-inches dbh will occur only between November 1 and March 31 to avoid potential impacts to federally listed bat species and migratory birds. Tree removal locations are noted in the plans. If Contractor requires additional trees greater than or equal to 3-inches dbh to be removed for demolition operations removal shall be coordinated with the
CO and Park for approval to clear for bats.
f. Any found bats at any time during demolition shall be sent to a qualified wildlife rehabilitator and shall be coordinated with Geoff Sanders at the Park
(geoffrey_sanders@nps.gov).
g. If for any reason a bat is killed it MUST be reported to the Contracting Officer and
US Fish & Wildlife Service.
h. The recommendation is to avoid bats. Demolition work within the winter, November
1 through March 31, is the best avoidance for sites where bats may be present. Note that discovery of any bat during any time must be mitigated based on the above.
i. It is noted that the USF&WS northern long eared bat status is expected to change from threatened to endangered in November of 2022. Contractor shall coordinate with the CO and Park regarding any further requirements for changes to the
USF&WS 4(d) rule.
D. Phasing/Schedule: NPS has defined a representative phasing breakdown for the Contractor’s consideration in schedule development: Fiscal Year 1– Base Bid, Fiscal Year 2 – Options.
E. Driveways, Entrances & Accesses: Keep driveways and entrances serving premises clear and available to Government, Government's employees, and emergency vehicles at all times. Do not use these areas for parking or storage of materials.
