APPENDIX C- TECHNICAL EVALUATION FORMS
ENCLOSURE 4- SUMMARY OF EXPERIENCE FORM
Offerors shall provide information requested in the below chart, including detail for each of the 15 subtask areas identified in Section L of the Solicitation. Offerors shall provide experience for each of the 15 subtask areas separately. Do not combine years of experience for two or more functional areas to meet the minimum of 3 years’ experience per PWS/functional area.

1. Functional Area: Data Collection Support Instructions: Offerors shall demonstrate a minimum of three years of experience providing Data Collection Support in each of the six subtask areas as set forth under PWS 6.2. The minimum of three years of experience shall have been performed within the past 5 years. As part of the submission, the offeror shall include all applicable contract numbers, contract titles, identify the prime or major subcontractor that performed the effort, PWS references, and contract period of performance dates that will allow the Government to successfully evaluate the offeror’s experience volume of the proposal. In order for a contract effort to be considered, the discussion below must confirm that the prime or subcontractor that has the experience identified will support the same competency areas if the offeror receives the resultant award.
2. Functional Area: Computer Operator Support,.
Instructions: Offerors shall demonstrate a minimum of three years of experience providing Computer Operator Support in each of the two subtask areas as set forth under PWS 6.3.. The minimum of three years of experience shall have been performed within the past 5 years. As part of the submission, the offeror shall include all applicable contract numbers, contract titles, identify the prime or major subcontractor that performed the effort, PWS references, and contract period of performance dates that will allow the Government to successfully evaluate the offeror’s experience volume of the proposal. In order for a contract effort to be considered, the discussion below must confirm that the prime or subcontractor that has the experience identified will support the same competency areas if the offeror receives the resultant award.
3. (1) Have an adequate system description including policies, procedures, and purchasing practices that comply with the Federal Acquisition Regulation (FAR) and the Defense Federal Acquisition Regulation Supplement (DFARS);
(2) Ensure that all applicable purchase orders and subcontracts contain all flowdown clauses, including terms and conditions and any other clauses needed to carry out the requirements of the prime contract;
(3) Maintain an organization plan that establishes clear lines of authority and responsibility;
(4) Ensure all purchase orders are based on authorized requisitions and include a complete and accurate history of purchase transactions to support vendor selected, price paid, and document the subcontract/purchase order files which are subject to Government review;

(6) Apply a consistent make-or-buy policy that is in the best interest of the Government;
(7) Use competitive sourcing to the maximum extent practicable, and ensure debarred or suspended contractors are properly excluded from contract award;
(8) Evaluate price, quality, delivery, technical capabilities, and financial capabilities of competing vendors to ensure fair and reasonable prices;
(9) Require management level justification and adequate cost or price analysis, as applicable, for any sole or single source award;
(10) Perform timely and adequate cost or price analysis and technical evaluation for each subcontractor and supplier proposal or quote to ensure fair and reasonable subcontract prices;
(11) Document negotiations in accordance with FAR 15.406-3;
(12) Seek, take, and document economically feasible purchase discounts, including cash discounts, trade discounts, quantity discounts, rebates, freight allowances, and company-wide volume discounts;
(13) Ensure proper type of contract selection and prohibit issuance of cost-plus-a-percentage-of-cost subcontracts;
(14) Maintain subcontract surveillance to ensure timely delivery of an acceptable product and procedures to notify the Government of potential subcontract problems that may impact delivery, quantity, or price;

(16) Notify the Government of the award of all subcontracts that contain the FAR and DFARS flowdown clauses that allow for Government audit of those subcontracts, and ensure the performance of audits of those subcontracts;
(17) Enforce adequate policies on conflict of interest, gifts, and gratuities, including the requirements of 41 U.S.C. chapter 87, Kickbacks;
(18) Perform internal audits or management reviews, training, and maintain policies and procedures for the purchasing department to ensure the integrity of the purchasing system;
(19) Establish and maintain policies and procedures to ensure purchase orders and subcontracts contain mandatory and applicable flowdown clauses, as required by the FAR and DFARS, including terms and conditions required by the prime contract and any clauses required to carry out the requirements of the prime contract, including the requirements of 252.246-7007, Contractor Counterfeit Electronic Part Detection and Avoidance System, if applicable;
(20) Provide for an organizational and administrative structure that ensures effective and efficient procurement of required quality materials and parts at the best value from responsible and reliable sources, including the requirements of 252.246-7007, Contractor Counterfeit Electronic Part Detection and Avoidance System, if applicable;
(21) Establish and maintain selection processes to ensure the most responsive and responsible sources for furnishing required quality parts and materials and to promote competitive sourcing among dependable suppliers so that purchases are reasonably priced and from sources that meet contractor quality requirements, including the requirements of 252.246-7007, Contractor Counterfeit Electronic Part Detection and Avoidance System, and the item marking requirements of 252.211-7003, Item Unique Identification and Valuation, if applicable;
(22) Establish and maintain procedures to ensure performance of adequate price or cost analysis on purchasing actions;
(23) Establish and maintain procedures to ensure that proper types of subcontracts are selected, and that there are controls over subcontracting, including oversight and surveillance of subcontracted effort; and
(24) Establish and maintain procedures to timely notify the Contracting Officer, in writing, if—
(i) The Contractor changes the amount of subcontract effort after award such that it exceeds 70 percent of the total cost of the work to be performed under the contract, task order, or delivery order. The notification shall identify the revised cost of the subcontract effort and shall include verification that the Contractor will provide added value; or
(ii) Any subcontractor changes the amount of lower-tier subcontractor effort after award such that it exceeds 70 percent of the total cost of the work to be performed under its subcontract. The notification shall identify the revised cost of the subcontract effort and shall include verification that the subcontractor will provide added value as related to the work to be performed by the lower-tier subcontractor(s).
APPENDIX G
OCI CERTIFICATION
I, _____________________________________ certify that _______________________ (company name) _________________ (contractor) and any of its subcontractors do not have in existence one or more outstanding contracts with products or equipment tested at ATC. Also, the contractor agrees that during the period of performance of this contract, the contractor shall not, participate as a prime contractor, subcontractor or consultant to the prime contractor, in the development or production of any system assemblies, subassemblies, and associated equipment that undergoes test and evaluation at the Aberdeen Test Center without the prior written approval of the Contracting Officer. Furthermore, the contractor agrees to include an OCI Clause substantially the same as this one in all subcontracts.
The Contractor agrees, with respect to performance under this contract to abide by the following four (4) elements of Conflict of Interest provisions, in accordance with paragraph 5 of the PWS:
Provision 1. Proprietary Data Exclusions
a. If performance of work requires the Contractor to obtain data from another firm that is considered proprietary, the Contractor shall comply with DFAR 227.7103-7 and shall provide notification of the execution of a nondisclosure agreement to the Contracting Officer.
b. If performance of work requires the Contractor to obtain proprietary data from another firm, the Contractor shall not utilize that data outside the performance of this contract. The Contractor shall not be enriched by the utilization of competitor proprietary data in supplying any systems or components thereof, either as a prime or Subcontractor with the Government, to a prime Contractor, or as any level of Subcontractor.
c. The contractor agrees to enter into a written agreement with any firm whose proprietary data is used in connection with performance of the contract, to protect all proprietary information from unauthorized disclosure or use for as long as it remains proprietary, to furnish the Contracting Officer with executed copies of all such agreements, and to refrain from using any proprietary information in supplying to the Government goods or services, or for any purpose other than that for which it is intended. The contractor agrees that any data furnished by the Government to the contractor not generally available to other contractors shall be used only for performance under this contract, and all copies of such data shall be returned to the Government upon completion of the effort. Any data furnished by the Government containing trade secrets or commercial or financial data of other contractors shall be treated as proprietary data. Additionally, the contractor shall not disclose outside of the Government any test data, test results, or recommendations generated in the performance of this contract.
d. For the purpose of this requirement, proprietary data does not include data which is (i) known to the receiving party at the time of disclosure, (ii) in the public domain, or (iii) disclosed to the Contractor from another source without violation of the agreement required by subparagraph (a) above.
Provision 2. Performance Exclusions, Present Efforts
a. The Contractor shall not undertake performance of any contractual requirements which requires it to supply technical support regarding systems it has played any role in developing which are or will be subject to test by ATC until notice is provided to the Contracting Officer and written consent to proceed is issued by the Contracting Officer.
b. Failure of the Contractor to provide the notice required by subparagraph a may result in contract termination.
Provision 3. Performance Exclusions, Future Efforts
a. The Contractor shall not be eligible to supply to the Government any systems or components thereof which were the subject of test, evaluation or analysis under this contract for a period of two years, commencing with the date of final completion.
b. The above requirements shall be made part of any subcontract let by the Contractor for performance of this contract. The Contractor is responsible to ensure the compliance of its Subcontractor with these requirements.
Provision 4. The above requirements apply equally to all Subcontractors.
Should this contract be terminated in whole or in part at any time, then the above stated exclusions may be removed, at the discretion of the contracting officer with respect to the terminated portion.
For the purpose of this clause, the term contractor means the contractor, its subsidiaries, divisions, affiliates, joint venture involving the contractor, any entity with which the contractor may hereafter merge or affiliate, any teaming arrangement as subcontractor, or any other successor or co-signee of the contractor.
The terms of this provision are not subject to negotiation.
