About this file

This document is a Sole Source Justification for a contract with DW Omaha Sub LLC for hosting a Family Member Update (FMU) event for the Defense Prisoner of War/Missing in Action Accounting Agency (DPAA). The contract, valued at $41,251.07, will cover facilities, meeting spaces, audiovisual equipment, and support for a two-day event on June 26-27, 2025, in Omaha, Nebraska. The event will allow DPAA officials to meet with families of missing service members and provide updates on efforts to recover and identify remains from past conflicts.

The justification details extensive market research conducted between May 15-30, 2025, which found DW Omaha Sub LLC was the only vendor capable of meeting the government's specific requirements. Other hotels contacted were either fully booked or lacked necessary meeting space. The contract will be awarded under simplified acquisition procedures, with the government intending to post a Notice of Intent to Sole Source on sam.gov to invite potential competing vendors. The contract supports DPAA's congressionally mandated mission to communicate with families of missing personnel and will include provisions for breakout rooms, internet connectivity, and audio-visual equipment to facilitate briefings and one-on-one meetings.

4. AUTHORITY CITED: This action is under the procedures of under the procedures of Federal Acquisition Regulation (FAR) 13.5 under the authority of:

41 U.S.C. 1901, Simplified Acquisition Procedures

41 U.S.C. 1903, Special Emergency Procurement Authority

5. REASON FOR AUTHORITY CITED: DPAA’s mission is to offer the fullest possible accounting for our missing personnel to their families and the nation. Part of that mission is accomplished by DPAA being congressionally mandated to communicate with families, which is done through FMUs. The DW Omaha Sub LLC (Cage Code: 1S1Y5) was selected because it had the required meeting space available, could offer the government per diem rate and had enough sleeping rooms in its inventory to support a room block for this meeting. Whereas the other two hotels either didn’t have the required space available, or sleeping rooms available or could not offer the government per diem rate.

6. EFFORTS TO OBTAIN COMPETITION: The government intend to post a Notice of Intent to Sole Source on the Governmentwide Point of Entry (GPE) sam.gov in compliance with FAR 5.201 and FAR 5.207. The notice will inform the public of the government's intent to award a sole-source contract and to invite any capable vendors to express interest in the requirement.

7. FAIR AND REASONABLE COST DETERMINATION: The Contracting Officer determines that the anticipated prices will be fair and reasonable by using the techniques identified at FAR 13.106-3 “Award and Documentation” to ensure award will be at fair and reasonable prices. three (3) hotels in the Omaha, NE area. However, attempts to secure accommodations within the required timeframe were as follows:

Doubletree by Hilton Omaha Southwest: Fully booked or lacked the necessary meeting space.

The Embassy Suites by Hilton Omaha La Vista Hotel & Conference Center: Fully booked or lacked the necessary meeting space.

Doubletree by Hilton Omaha Downtown (DW Omaha Sub LLC): Confirmed availability suitable of meeting space, guest rooms, and other specific needs within the required timeframe.

Sam.gov search: The Contracting Officer conducted a SAM.gov entity search for active lodging and or hotel options under NAICS 721110 within Omaha NE 68102 yielded nine (9) potential vendor, five (5) Other than small businesses and four (4) small businesses. To support the organization's small business goals and maximize opportunities for socioeconomic participation, market research efforts were focused on engaging with small business vendors.

Requests for information were strategically limited to four potential small business vendors.

This targeted approach allows for a more efficient allocation of resources, facilitating deeper engagement with potential small business partners and increasing the likelihood of awarding a contract that contributes to achieving the organization's established small business targets. This strategy is justified as it promotes small business participation in government contracting, fostering economic growth and diversity within the supplier base, while remaining compliant with relevant regulations and policies promoting small business utilization.

However, attempts to secure accommodations within the specified yielded the following results:

City of Omaha Convention Hotel Corp: Fully booked or lacked the necessary meeting space.

Based on the market research conducted, DW Omaha Sub LLC is the only identified source capable of meeting the Government's requirements for the following reasons:

a. Availability/Capabilities: DW Omaha Sub LLC has the necessary room availability to accommodate the event. Other contacted vendors lacked sufficient availability within the

required timeframe.

b. Urgency and Mission Impact: DW Omaha Sub LLC is the only vendor capable of meeting the deliverables outlined in paragraph 3 above, on the required delivery date. Awarding to any other vendor would introduce unacceptable delays, resulting in mission failure.

Therefore, a direct award to DW Omaha Sub LLC, under FAR 13.106-1(b)(1) is in the best interest of the government. As this acquisition falls below the Simplified Acquisition Threshold (SAT), a separate Justification and Approval (J&A) is documented under A04.

d. Notice of Intent: The government intend to post a Notice of Intent to Sole Source on the Governmentwide Point of Entry (GPE) sam.gov in compliance with FAR 5.201 and FAR

5.207. The notice will inform the public of the government's intent to award a sole-source contract and to invite any capable vendors to express interest in the requirement.
