About this file

This is a Determination to Solicit from a Single Source document authorized under FAR 13.101(b) for a simplified acquisition below the Simplified Acquisition Threshold.

The Department of Interior, Bureau of Reclamation, Interior Region 10 (California – Great Basin), Construction Acquisitions Office in Sacramento, California is awarding a non-competitive contract to Souza Construction, Inc. located at 586 S. Farmersville Boulevard, Farmersville, CA 93223 for HVAC system replacement. The work involves complete removal of a failed 12.5-ton HVAC unit and installation of a replacement system (either one 12.5-ton unit or comparable commercial-grade equivalent) to be located in the building's HVAC room. The contractor's estimated cost is $86,267.26. The award number is 140R2026P0088.

The single-source justification is based on urgent and compelling circumstances. The existing HVAC system serving approximately 2,700 square feet of office space and thirteen employees is non-functional. Summer temperatures in Friant, California routinely exceed 100 degrees, creating unsafe working conditions and risks of heat-related illness that directly impact dam staffing and operational readiness. A recent service visit identified clear signs of system degradation. The Contracting Officer determined that the time-sensitive nature and health and safety impacts preclude a full and open competitive process. Market research was conducted on SAM.gov, the Small Business Administration's Dynamic Small Business site, and the Department of Interior's IDIQ contract vehicle. Souza Construction was identified as possessing the necessary technical expertise, demonstrated past performance, and geographic proximity. The Contracting Officer, Stephanie R. Lindner, will determine price reasonableness using FAR 15.404-1 proposal analysis techniques.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Updated IAW Revolutionary FAR Overhaul 13 and DOI-AAAP-F013

Pursuant to Federal Acquisition Regulation (FAR) 13.101(b), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from a single source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). FAR Part 13 procedures may only be used if there are no commercial products or commercial services that can satisfy the agency’s needs and the supplies or services are not available from a required source.

1. Agency and Contracting Activity.

The Department of Interior (DOI), Bureau of Reclamation (BOR), Interior Region 10, California – Great Basin (CGB), Construction Acquisitions Office located in Sacramento, California.

2. Name and Address of Single Source.

Souza Construction, Inc.

586 S. Farmersville, Blvd

Farmersville, CA 93223

3. Description of Supplies/Services and Estimated Cost.

The construction work involves the complete removal of the existing failed HVAC system and installation of a replacement system consisting of either one 12.5 ton HVAC unit or a comparable commercial-grade HVAC system. The replacement unit is to be determined and will be located inside the building’s HVAC room. The contractor provided an estimated cost of $86,267.26.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.101-1(b), only one source will be solicited because of the urgency of this requirement. The work must be completed as soon as possible. The existing 12.5-ton HVAC unit serving approximately 2,700 sq ft of office space is no longer functioning properly and must be replaced to ensure safe working conditions for up to 13 employees. Summer temperatures in Friant, CA routinely exceed safe indoor limits, creating immediate risks of heat-related illness and directly affecting dam staffing and operational readiness, as discussed in prior meetings and email exchanges. Additionally, a recent service visit identified clear signs of system degradation, further reinforcing the need for prompt replacement to maintain safe and reliable working conditions.

Award Number: 140R2026P0088 Page 2 of 3

This mechanical failure directly impacts thirteen employees who occupy offices in the building. During the summer months, interior temperatures can reach up to 100 degrees, creating unsafe working conditions. Given the urgent health, safety, and mission impacts, immediate action is required. A delay in awarding this requirement through a competitive process would extend unsafe conditions and prolong operational disruptions. Therefore, a non-competitive award is justified based on urgent and compelling circumstances to ensure the timely replacement of the HVAC system and restore safe occupancy of the facility.

Given the health, safety, and operational concerns, this project is deemed urgent. Expedited approval and action are necessary. Timely award and completion of this project are essential to restoring a safe and functional work environment. The Contracting Officer (CO) has confirmed that all work described in the scope of work is both urgent and critical to reestablish the necessary power and climate control for the facility.

The urgency of this requirement does not allow for a full and open competitive process, as delays would directly affect 13 of employees, mission readiness, and the ability to sustain critical operations within the facility.

5. Determination of Fair and Reasonable Price.

The Contracting Officer will determine whether the contractor’s price is fair and reasonable based on the proposal analysis techniques listed in FAR 15.404-1.

6. Description of Market Research.

Given the urgent and compelling circumstances associated with this requirement, the Government conducted market research on SAM.gov, the Small Business Administrations Dynamic Small Business site, and under the Department of the Interior (DOI) Indefinite Delivery/Indefinite Quantity (IDIQ) contract vehicle to identify potential sources capable of performing the work near the project site. Through this research, Souza Construction, Inc.

was identified as a viable source. While the IDIQ was used to identify a potential source, this requirement was not issued as a Task Order against the IDIQ as it would have violated fair opportunity.

To evaluate the contractor's qualifications, the Government reviewed the following sites to assess Souza Construction's experience and performance on similar projects:

a) CPARS.gov

b) USAspending.gov

c) SAM.gov

Based on this review, the Government determined that Souza Construction, Inc. possessed the technical expertise, demonstrated past performance, and geographic proximity necessary to meet the Government's immediate needs. Given the time-sensitive nature of the requirement, pursuing additional sources at this stage would have introduced unnecessary delay and risked mission impact.

Award Number: 140R2026P0088 Page 3 of 3

Accordingly, the Government determined that further competition was not practicable under the circumstances. Proceeding with Souza Construction, Inc. represented the best interest of the Government, ensuring the timely and effective completion of this critical effort. The Government will continue to conduct thorough market research on future requirements to identify qualified sources and maximize competition to the extent practicable.
