About this file

This memorandum provides a sole source justification for a federal contract opportunity. The Naval Surface Warfare Center Carderock Division requires the fabrication of seventy-five composite sunshields to replace the current metal sunshields aboard Navy vessels. The sunshields must be manufactured according to Naval Sea Systems Command Drawing 710-8931716 and delivered by March 2024. RE: Build Composites Resources, located in Rock Hill, South Carolina, is identified as the only approved and qualified source able to supply the composite sunshields in accordance with the required specifications. As the Office of Naval Research invested funding to develop this supplier and the required manufacturing process, pursuing additional suppliers would require significant time and resources. Therefore, this memorandum serves to justify a sole source procurement from RE: Build Composites Resources under the simplified acquisition threshold.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 3 Template Effective February 2023

MEMORANDUM FOR FILE

FROM:

CODE:

SUBJECT: Sole Source Justification

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. FAR 8.405-6(b)(1) states Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

3. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

4. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address)

The Naval Surface Warfare Center (NSWCCD), Code 619 requires fabrication of seventy-five (75) composite sunshields for Ready Service Lockers (RSLs) in accordance NAVSEA Drawing 710-8931716. These lockers will be used as replacements for current metal sunshields aboard the Navy’s DDG65. The period of performance of this task shall be six (6) months from time of award to 31 March 2024.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

3. Other Reasons:

B. SOLE SOURCE (select all that apply)

Ready Service Lockers (RSLs) are equipment that are used to store ammunition or ordnance close to the location on the deck where the material will be utilized. The NSWCCD has spent several years developing Composite Sunshield technology for the mitigation of corrosion-related maintenance on the current metallic sunshields of the RSLs. The NSWCCD has worked alongside the Office of Navy Research (ONR) Manufacturing Technology (ManTech) to develop a commercial vendor that could transition prototype sunshield development work from the NSWCCD to an efficient sunshield manufacturing method. Following this process, the only vendor qualified to offer this material is RE: Build Composites Resources. Currently no other company has submitted the required documentation required to be approved by NAVSEA for construction of Composite Sunshields. Thus making RE:

Build Composite Resources the only current approved option for fabrication of sunshields.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

RE: Build Composites Resources is the sole original equipment manufacturer and seller of the sunshields required to be in line with NAVSEA Drawing 710-8931716. From NAVSEA DWG 710-8931716 General Note 9. Source of Supply “RE: BUILD COMPOSITE RESOURCES, CAGE CODE 8W9A9, OR EQUAL AS APPROVED BY

NAVSEA”

Office of Naval Research Manufacturing Technology Center has invested significant amount of funding to stand up a supplier that provided first article composite sunshields for evaluation and demonstration. Significant amount of funding and time would be needed for an additional supplier to be stood up to fabricate the composite sunshields. If this is not sole sourced, composite sunshields will not be able to meet ship maintenance availabilities. Ship Maintenance Facility Japan has contacted NSWCCD directly and wants to purchase these sunshields for DDG 65 to install prior to the end of availability in order to reduce corrosion related maintenance.

C. LIMITED SOURCE (FAR 8.405-6):

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, Manufacturer (OEM).

IV. CERTIFICATIONS & APPROVALS

A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.
