This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, using Simplified Acquisition Procedures under FAR Part 13, as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on both Beta SAM Contract Opportunities.

The RFQ number is 140P8121Q0065. This solicitation documents and incorporates provisions and clauses in effect through FAC 2021-05 03-10-2021. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at these addresses: https://www.acquisition.gov/far/ and. The NAICS code is 325998 – Other miscellaneous chemical manufacturing and the Small Business Standard is 500 employees. This is a competitive, 100% Total Small Business Set-Aside. The Small Business Office concurs with the decision.

National Park Service intends to award an Indefinite Delivery Requirements (IDR) type contract for the following:

CLIN 0010 Potable grade 12.5% Sodium Hypochlorite See delivery instructions provided in this solicitation. See Table A provided in this solicitation for technical performance criteria.

Bulk delivery is required.

No product in a container of any size (1 gallon, 5 gallon, 55 gallon, etc.) will be accepted.

ESTIMATED MINIMUM/MAXIMUM

The estimated minimum quantity is 500-700 gallons per delivery order for this contract and funded per delivery order.

ESTIMATED ANNUAL MINIMUM/MAXIMUM

The estimated annual minimum quantity is 2000-3000 gallons.

DELIVERY INSTRUCTIONS:

The Contractor shall provide a projected yearly estimate of 2000-3000 gallons of 12.5% Sodium Hypochlorite, delivered in bulk. The estimated quantity per delivery order is 500-700 gallons.

The quantity identified in each order shall be delivered to Furnace Creek Water Treatment Plant, Death Valley National Park (see attachment for Map and location of delivery.

a) within ten (10) calendar days from the date individual order is placed.

b) A Material Safety Data Sheet (MSDS) and a certificate of shelf life shall accompany each shipment.

WRITTEN ORDERS:

If written orders are placed, they will contain the following information consistent with the terms of the contract:

(a) Date of order;

(b) Contract number and order number;

(c) Requisition number;

(d) Item number and description, quantity ordered, unit price and contract price;

(e) Place of delivery or performance (including consignee);

(f) Packaging, packing, and shipping instructions if any required;

(g) Accounting and appropriation data;

(h) Inspection invoicing and payment provisions to the extent not covered in the contract; and any other pertinent information.

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

upload copy of business invoice to IPP system when requesting payment through IPP.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation

52.216-19 Order Limitations:

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $0.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor-

(1) Any order for a single item in excess of $0.00;

(2) Any order for a combination of items in excess of $0.00; or

(3) A series of orders from the same ordering office within 07 calendar days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 07 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons.

Upon receiving this notice, the Government may acquire the supplies or services from another source.

Ordering Authority:

Any supplies and services to be furnished under this contract shall be ordered through issuance of delivery orders.

Delivery orders may be issued from the date of award through two years after award, or until all orders are complete so long as the order was made prior to the end of the ordering period. Orders may only be issued by the following activities:

*A list of individuals who have ordering authority will be provided as an attachment at the time of award and annually or otherwise as required. Only warranted individuals will have ordering authority under this contract. If an order is placed by an individual without a warrant, the contractor shall inform the contracting officer immediately and shall not fulfill the order.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Basis of Award:

Award will be made to the responsible quoter providing the best value that meets or exceeds the requirements identified below.

a) Price factor: Quote must identify per gallon cost and any costs associated with delivery of the bulk product.

A Price Schedule is provided and must be filled out with quoters response. Any bulk pricing discounts may be submitted as part of the quoters response.

b) Non-price factor:

- Documentation showing conformance with NSF and CA DWR Requirements.

- Technical Narrative describing the ordering and delivery process, including details how orders are received, plant location, dispatch procedures, and delivery equipment. Offerors with clear concise technical narrative that convey understanding of the scope will be evaluated more favorably.

c) Past performance contracting officer shall review the performance and integrity information available in the Federal Awardee Performance and Integrity Information System (FAPIIS), (available at https://www.cpars.gov ), including FAPIIS information from the System for Award Management (SAM) Exclusions and the Contractor Performance Assessment Reporting System (CPARS) when making a responsibility determination IAW FAR 9.104-6. The Government may consider past performance information obtained from other sources.

d) References: Offerors are to provide 3 client references (name, company, phone number) for similar supply products. Offerors with references that provide favorable review of ordering and delivery processes will be evaluated more favorably.

Quoters shall include with their quotes the following, as well as any additional information and certifications with reference to the provisions contained herein:

1) A unit price and total price for ordering period one (1) and all ordering periods identified.

2) A point of contact, name and phone number, business size, and payment terms.

3) Each response must clearly indicate the capability of the quoter to meet all specifications and requirements identified in this solicitation.

4) A completed copy of 52.212-3. If the quoter has completed the annual representations and certification electronically via the System for Award Management (SAM) Web Site, the quoter shall only complete paragraph (b) of this provision.

5) Submit as applicable the provision identified at 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (OCT 2020)

6) Submit as applicable the provision identified at 52.204-26 Covered Telecommunications Equipment or Services – Representation (OCT 2020)
