Shelia, Attached is the revised PWS for the heavy maintenance check on N640CS.

I have addressed the concerns from OOP as follows:

Section 2 – Discussed the benefits of utilizing a FFP contact for the known maintenance requirements in Section 11 and discussed the process to be utilized for approving non-routine discrepancy discovered during the performance of Section 11.

Section 4 4th Paragraph – Revised “The Contractor will provide the COR with an estimated cost for the repair(s) and an estimated timeline for the repair(s) on a daily basis, utilizing a status sheet (contractor format).” to “The Contractor will provide the CO with an estimated cost for the repair(s) and an estimated timeline for the repair(s) on a daily basis, utilizing a status sheet (contractor format).”

This way it clearly shows the CO will be approving the non-routine maintenance costs.

Section 4 Paragraph 12 – Deleted. The requirements of this paragraph are covered under Section 8.

Section 10.2 Paragraph 2 – Deleted. The requirements of this paragraph are covered under Section 4 Paragraph 4 and Section 8.

Let me know if you have any other questions.

12.1. Assessing Performance

1. General

The United States Marshal Service, Justice Prisoner and Alien Transportation System (JPATS) has a requirement for the accomplishment of a Heavy Maintenance Check (Service Check, 1A, 2A, 1C, and 5C) on a U.S. Marshals Service owned Boeing 737- 400 aircraft. These checks are detailed within a government owned MSG-3 Low Utilization Maintenance Program as derived from the Original Equipment Manufacturer (OEM) Maintenance Planning Document (MPD) and administered through CAMP Systems.

General requirements are as follows:

Boeing 737-4YO series aircraft; MSN 26078; Line Number 2431; Variable Number PM560, Registration Number N640CS, ACTT 63,071.3, ACTC 37,252. Reference Section 11 for the list of heavy maintenance requirements.

The aircraft maintenance and logistics efforts associated with this work must be adequately planned, staffed, and supervised by the Contractor to ensure all work schedules and maintenance activities are optimized.

1.1. Required Induction Date

The required induction date for this aircraft is July 11, 2023.

2. Contract Type

The Government anticipates awarding a firm-fixed price for the tasks listed in Section 11, Items 1 – 39. Unforeseen or Non-Routine Maintenance & Repairs will be repaired utilizing a Time & Materials basis.

3. JPATS Responsibilities

JPATS will deliver the aircraft to the Contractor’s facility on July 10, 2023.

JPATS will make available to the Contractor all applicable CAMP Systems task cards with associated Aircraft Maintenance Manual (AMM) references required for the accomplishment of the identified checks and inspections.

JPATS will make the following manuals available to the Contractor: Aircraft Maintenance Manual (AMM), Boeing issued Component Maintenance Manuals (CMM), Illustrated Parts Catalog (IPC), Wiring Diagram (WD), and Structural Repair Manual (SRM).

JPATS will provide GMM familiarization training, Required Inspection Item (RII) procedures training, Airworthiness Release procedure training, Logbook documentation training, and CAMP Task Card documentation training.

A JPATS COR will be onsite for the duration of the scheduled heavy maintenance check to ensure compliance with contractual requirements and to evaluate non-routine discrepancies.

JSimpson4

Sticky Note

What do you mean Time and Materials basis? I think this needs to be reworded to discuss any repairs and maintenance that is not outlined in the PWS and how those should be handled.

4. Contractor Responsibilities

The Contractor will perform all maintenance and inspection items as well as complete all maintenance records documentation in accordance with JPATS GMM and the Contractor’s FAA Approved Repair Station Quality Control Manual.

The Contractor will appoint a point of contact (POC) for the JPATS Contracting Officer (CO) and COR.

The Contractor will provide written notification to the JPATS CO prior to subcontracting any portion of the maintenance effort to outside organizations or individuals.

The Contractor will notify the on-site JPATS COR if a discrepancy (non-routine) is discovered during the performance of these checks and inspections. The Contractor will provide the COR with an estimated cost for the repair(s) and an estimated timeline for the repair(s) on a daily basis, utilizing a status sheet (contractor format).

After approval is obtained to correct or repair the discrepancy, the Contractor will purchase any materials, supplies, and / or parts from an FAA approved vendor (all parts must be accompanied with an appropriately completed FAA Form 8130-3).

Note: JPATS reserves the right to utilize JPATS owned spare parts or procure the required parts through the normal JPATS’ procurement process.

The Contractor will adhere to applicable statutes and regulations as prescribed by the Occupational Safety and Health Administration (OSHA), the Federal, State and Local Environmental Protection Agency (EPA), the National Fire Protection Agency (NFPA), and the Federal Aviation Administration (FAA).

The Contractor will provide all common tools, special tools, test sets and equipment, ground support equipment, “consumables”, and “free stock” such as grease, lubricants, rags, common hardware, etc.

The Contractor will purchase, store, use, and dispose of all hazardous materials (HAZMAT) associated with the maintenance of aircraft, support equipment, and facilities in accordance with federal, state, and local statutes.

The Contractor will perform typical logistics tasks associated with the specified checks and inspections such as material and parts receiving, receiving inspections, identifying and reporting suspected unapproved parts (SUP), packing, crating, shipping, materials handling and storage, and shelf-life management.

The Contractor will perform all maintenance documentation to include JPATS historical logbooks for the airframe, engines, auxiliary power units (APU) and appliances as applicable as well as the FAA Form 337 for major repairs / alterations.

The Contractor is required to ensure all CAMP Task Cards, Required Inspection Items (RII), Logbook documentation, and Airworthiness Release procedures are properly completed as instructed in the JPATS training outlined in Section 3.

If this is a firm fixed priced contract, we can't add work based on discoveries as that would violate CICA. So perhaps we state that once the CO approves they discrepancy they will provide approval/award to provided with the discrepancy.

The Contractor will be responsible for the repair or replacement of any JPATS equipment that is damaged or destroyed by acts of negligence by the Contractor.

The Contractor will obtain advanced authorization from JPATS prior to any single purchase over $100 or any combined purchase over $100.

The Contractor will ensure the aircraft’s airstairs are not used for maintenance personnel to enter the aircraft or exit the aircraft.

The Contractor will complete and return Section 11 to the JPATS Contracting Officer.

5. Place of Performance

All work will be performed at the Contractor’s Title 14 CFR Part 145 Certificated Repair Station located within the contiguous United States.

6. Period of Performance

The induction date is July 11, 2023. JPATS anticipates a 45-calendar day performance period with a return to service date of August 25, 2023.

7. Warranty

The Contractor will provide the Government a copy of their standard commercial warranty.

8. Contract Administration Data

Only warranted Contracting Officers are authorized to issue and modify Government contracts, approve changes in any terms and conditions in a contract, or obligate funding. If the Contractor makes any changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made to the contract to cover any increase in costs that may result.

9. Right to Inspect / Audit

The Government reserves the right to inspect / audit the Contractor’s facility along with their current maintenance processes and procedures prior to delivering the aircraft for services. The Government must ensure the Contractor is providing services in accordance with their Title 14 CFR Part 145 Repair Station Certification.

The Government may terminate the contract if it has reason to believe the Contractor is not providing services in accordance with their certificate.

They should be obtaining authorization for any costs outside the scope of this requirement. This statement is basically telling them they can obligate the Government.

Shelia, Do you have time to disc this?

I’m in a meeting now, so would 3 p.m. work?

Hi Rob, FYI- the previous procurement history shows that this requirement was typically a “FFP” type with clauses, and references to labor hour type contract. The OOP reviewer is commenting in this area ( i.e. is this FFP or LH, should the LH clause be included in the FFP etc.) We may be forced to change from FFP to LH. If so, it will definitely require additional documentation and approval (LH D&F) from us, and the line item structure may need to be edited. Just wanted to give you a heads up.

Would you happen to know why it has historically been a FFP (firm fixed price) versus a LH (labor hour)? Would there be any negative impact from a Program office perspective if it changed from FFP to LH?

Sheila

God morning Rob, The solicitation review from OOP, Julie Simpson came back 2 days ago. The small business review from OOP, Samantha Davis came back today. I am working off the review comments for both while working on the Inflight Paramedic award. They are neck in neck in terms of priority. There are a couple of comments I may need input from you. Let me work through some of that. In the mean time, I’ve attached the PWS with Julie’s comments.

We can talk through the responses or you can input a “reply” in the document where her comments are. I think at some point we will want to discuss. Let me know your idea of the best way to address the PWS comments.
