Section 00 21 16 - Instructions to Proposers
APPENDIX B
1. BASIS OF PHASE ONE EVALUATION
1.1 Subject to the provisions contained herein, the Government will evaluate proposals to determine offerors that are: compliant with the solicitation requirements; and whose proposals, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, are determined to be acceptable across all non-price factors.
1.2 The Government intends to advance a maximum of five (5) of the most highly qualified offerors to Phase Two from which it anticipates awarding one firm-fixed-price contract. It may advance fewer than five offerors and will exercise discretion in determining the number of offerors to be advanced to Phase Two. The Source Selection Authority (SSA) will the Government's interest in competition and its interests in take into account awarding to a highly qualified contractor, and in preventing avoidable expenditure on Phase Two proposal preparation by offerors without realistic prospects of award.
2.0. PHASE ONE VOLUME I PROPOSAL SUBMISSION REQUIREMENTS AND EVALUATION
FACTORS
2.1. RELATIVE IMPORTANCE OF EVALUATION FACTORS
The Phase II Solicitation will include information on the relative importance of evaluation factors for purposes the best value tradeoff. For purposes of the Government's Phase I down-selection decision, the Phase I factors are listed in descending order of importance as follows:
- Phase I Factor II Past Performance
- Phase I Factor I Design Strategy
2.2. DEFINITIONS
Significant Strength. An aspect of an offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.
Strength. An aspect of an offerors' proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
Weakness. A flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.
Significant Weakness. A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.
Deficiency. A material failure of a proposal to meet a government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
See FAR 15.001.
Uncertainty. Any aspect of a non-cost/price factor proposal for which the intent of the offer is unclear (e.g., more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission or mistake).
. Past performance information that supports a less than satisfactory rating on any Adverse Past Performance evaluation.
2.3. PHASE ONE EVALUATION FACTORS
Evaluation factors may contain certain mandatory or minimum requirements to be met for evaluation. There are also contained within the described factors certain documents for submission. Failure to satisfy any mandatory or minimum requirement may result in a determination that a proposal is unacceptable. A final determination that a proposal is unacceptable means that the offeror will not be selected as a most highly qualified offeror, and the Government will not request that the offeror submit a Phase Two proposal. This does not limit the Government's discretion to exclude offerors without any "unacceptable" ratings from Phase Two because they were not found to be among the most highly qualified offerors.
All of the submission items to be evaluated pertain to the offeror and its major subcontractors. A minimum shall of twenty percent (20%) of the work associated with this project is required to be performed by the contract awardee.
Subcontractors: The Government recognizes that completion of a project is often a team effort. An offeror that intends to utilize one or more major subcontractor(s), submit a firm, unequivocal letter of commitment shall signed by each major subcontractor. A major subcontractor is defined as a subcontractor that performs twenty percent (20%) or more of the total on-site management and construction efforts or one that performs twenty percent or more of the total dollar value of the project. Offerors that propose to use a Designer of Record (DOR) are also required to submit firm, unequivocal letters of commitment signed by their DOR(s). An offeror's technical proposal will largely be diminished in the evaluation and selection process unless a required letter of commitment is provided which establishes the likelihood that the proposed subcontractor(s) will actually be available for this project. If an offeror's accepted proposal includes the use of any major subcontractors or DORs, the offeror not change major subcontractors or DORs without the Contracting Officer's approval. shall Approval will not be given unless the Contracting Officer considers the proposed substitute to be equal or better in all respects to the originally proposed major subcontractor or DOR and that the substitution is in the best interests of the Government.
Joint Ventures: A Joint Venture (JV) is defined as a legal business entity formed between two or more companies to undertake the performance activities of a contract together.
An offeror proposing as a JV provide evidence that the JV as a legal entity has been duly formed. A JVs shall offeror include a copy of its legal JV agreement signed by an authorized representative who can bind the shall entity of each coventurer, with the chief executive of each entity identified. A prospective offeror that submits a proposal as a JV may not change either/any of the joint venturers, if selected for award.
For technical factors other than Past Performance, the Combined Technical/Risk Ratings below will be used:
Table 1. Combined Technical/Risk Rating Method
Color Rating Adjectival Rating
Description
Blue
Outstanding
Proposal demonstrates an exceptional approach and understanding of the requirements and contains multiple strengths and/or at least one significant strength, and risk of unsuccessful performance is low.
Purple
Good
Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength or significant strength, and risk of unsuccessful performance is low to moderate.
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red
Unacceptable
Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is unawardable, and/or risk of performance is unacceptably high.
2.3.1. FACTOR I - DESIGN STRATEGY
2.3.1.1. Submission Requirements. The narrative shall demonstrate the offeror's proposed capabilities to perform the design-build construction effort and shall not to exceed 10 pages, that explains the offeror's intended approach to perform full design services utilizing the conceptual design to be provided by the Government The narrative should describe the offeror's understanding and plans of the following:.
- Applicable design codes and standards to be utilized.
- Design Quality Control and Independent Technical Review procedures.
- Management of design submissions, design review periods, and comment resolution and closure.
- Name of the design firm(s) proposed to perform the full design effort.
- A detailed explanation of the proposed contractual relationship(s) between the offeror and any listed design firm(s).
- Examples of previous designs by any listed design firm(s) to demonstrate proficiency with facility design.
- Describe, with specific examples, how the proposed design firm(s) have demonstrably learned from challenges encountered on prior projects of similar scope and complexity, and how those lessons will directly contribute to the successful completion of this project?
- Detail the proposed process between the offeror and the design firm(s) to ensure full compliance with all design technical requirements while proactively managing budgetary constraints. Specifically, address how Value Engineering, cost tracking, and change management will be integrated throughout the project lifecycle.
2.3.1.2. Evaluation Criteria. An offeror's design strategy will be evaluated in its entirety to determine the offeror's understanding of requirements and strength of the offeror's proposed design strategy. The Government will evaluate the design strategy and consider the level of risk the offeror's strategy presents to successful project completion. The Government may consider elements such as the following:
- The level of detail and accuracy the offeror demonstrates regarding applicable codes and standards, design processes, and Design Quality Control procedures.
- The strength of experience of proposed design firms.
- The relevance of the demonstrated capability of proposed design firms with the scope of this project.
- The extent to which design firms and/or the offeror have worked together on previous design or design-build construction projects.
A single rating will be assigned under the Design Strategy factor. In rating the offeror, the Government will focus on the strengths, deficiencies, weaknesses, risk, and uncertainties. The Combined Technical/Risk Rating in Paragraph 2.2 will be applied based on the offeror's approach as well as the offeror's demonstrated understanding of the requirements.
2.3.2. FACTOR II - PAST PERFORMANCE
The Past Performance evaluation is an assessment of an offeror's probability of meeting the solicitation requirements and results in an assignment of a single performance confidence assessment rating based on an offeror's past performance record.
For the purposes of this evaluation:
A project is defined as a project, in a , with a "relevant" "recently completed" "similar geographic region" and with to the project that is the subject of this solicitation. The "similar scope" "similar cost magnitude"
Government use any evidence of negative past performance to assign a lower past performance confidence may rating if it is determined there is a reasonable expectation that negative performance is indicative of potential negative performance on this requirement. Projects performed by the offeror as a prime contractor or by the same JV offeror may be considered more relevant than projects where the offeror performed as a subcontractor or as part of a different JV.
A project is defined as a project for which construction Substantial Completion (SC) has "recently completed" been issued within six (6) years of the proposal due date for this solicitation or is currently under construction and is at least 75% complete as of the proposal due date.
"Similar geographic region" is defined as a project constructed in the Gulf Cooperative Council (GCC) member countries that include, Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, and the United Arab Emirates
(UAE).
"Similar scope" is defined as renovation of a commercial, institutional, or military facility with replacement of 75% or more of the facility's foundation or concrete slab on grade without compromising the structural integrity of the building and one or more of the following:
- Fire suppression system installation, repair, or replacement
- Interior demolition without compromising the structural integrity of the building
- Removal and re-installation of a paint booth
Submitted facilities should be of similar size, type, and complexity of this requirement.
"Similar cost magnitude" A project will be considered of similar cost magnitude if its total contract value falls within the range defined as the "Magnitude of Construction Capacity" in SECTION 00 21 00, Paragraph 1.2.
Projects with a total contract value up to 30% above or below this range will also be considered similar in magnitude.
Offerors clearly delineate their responsibilities and associated cost magnitude for each submitted project. If shall the offeror performed work as a subcontractor, only the scope and cost magnitude for which it held responsibility as a subcontractor will be considered.
If an offeror is submitting Indefinite Delivery Contract (IDC) or other ordering contracts for consideration, the offeror submit each individual project, whether it is a task order or a standalone contract, ensuring it meets shall minimum requirements for cost magnitude. The total amount of the Indefinite Delivery Contract (IDC) will not be taken into account.
2.3.2.1. . Submission Requirements The offeror submit Past Performance information for at least two (2) shall projects and no more than five (5) performed by the offeror. Additional projects will not be considered for evaluation. An offeror may submit projects for evaluation for which it performed as a prime contractor, as part of a joint venture, or as a subcontractor. With each submitted project the offeror clearly identify or must describe the specific work performed by the offeror.
- Submitted Projects. An offeror may submit projects for evaluation for which it performed as a prime contractor, as part of a joint venture, or as a subcontractor. With each submitted project the offeror must clearly identify or describe the specific work performed by the offeror.
If past performance by a subcontractor is submitted for consideration as part of the proposal, the offeror should include a commitment signed by offeror and subcontractor certifying that if a contract is awarded resulting from the proposal, the parties commit to joint performance as proposed. If the signed commitment is not fully executed by both parties and provided with the Past Performance Proposal, subcontractor references will not be evaluated or considered. The offeror also identify the percentage of work to be accomplished by the must subcontractor. Past performance by a subcontractor may not be given the same weight as past performance by the offeror, and a weakness may be assigned if an offeror (the prime contractor) has no experience.
If past performance by an affiliate is submitted for consideration as part of the proposal, the offeror should include a commitment signed by offeror and the affiliate certifying that if a contract is awarded resulting from the proposal, the parties commit to joint performance as proposed. If the signed commitment is not fully executed by both parties and provided with the Past Performance Proposal, affiliate references will not be evaluated or considered. The offeror also identify the percentage of work to be accomplished by the must affiliate. Past performance by an affiliate may not be given the same weight as past performance by the offeror, and a weakness may be assigned if an offeror (the prime contractor) has no experience
2.3.2.2. . Contractor Performance Assessment Reporting System (CPARS) evaluations, Submission Format whether interim or final, be submitted for all US Government projects. For non-Government projects, Past shall Performance Questionnaires (PPQ) (ATTACHMENT H) be submitted. If the offeror is unable to obtain shall PPQ feedback from their non-Government client, the offeror complete and submit with its proposal the shall first page of the PPQ (including blocks 5 and 6). If, at time of evaluation, a contractor performance evaluation exists in CPARS, and the offeror submits a PPQ, there is no obligation to review the PPQ. Information such as awards, certificates, customer letters of commendation, and any other forms of performance recognition shall not be submitted or evaluated.
An offeror should submit recently completed, relevant projects on the following documents:
- Past Performance Overview Sheet
- Project Summary Form, and
- Past Performance Questionnaire (PPQ) (for non-Government projects) or Contractor Performance Assessment Reporting System (CPARS) evaluations (for Government projects).
On the Project Summary form the offeror include a project description with a project scope and cost shall magnitude, detailed enough to evaluate the project's relevance and recency.
Additionally, the offeror should:
- Provide details for any past performance problems encountered and the corrective actions taken.
- Provide the name and contact information of English-speaking references who have first-hand knowledge of the offeror's past performance. References should be independent, willing, and available to answer questions, and knowledgeable personnel within the contracting agency or entity that administers the contract such as the construction agent, owner, or Government representative.
References may be asked to comment on specific aspects of the offeror's performance, such as, but not limited to: quality of construction, timeliness, management of the work, subcontractor management including timely payment to subcontractors or suppliers, safety, relations between owner and designer or contractor, level of support for such elements as as-built documentation, correcting design or construction errors, and warranty work.
- Notify the reference that he or she may be contacted for the purposes of the evaluation.
- Contractor Performance Assessment Reporting System (CPARS) evaluations be submitted for all shall Government projects.
For non-Government projects, Past Performance Questionnaires (PPQ) be submitted. If the offeror is shall unable to obtain PPQ feedback from their non- government client, the offeror complete and submit with its shall proposal the first page of the PPQ (including blocks 5 and 6).
Past performance information such as awards, certificates, customer letters of commendation, and any other forms of performance recognition not be submitted, as this information will not be evaluated shall
