I Technical Proposal Factor 1 & Factor 2 original and two copies

II Past Performance Proposal Factor 3 original and two

III Small Business Participation Proposal

Factor 4 original and two

IV Price Proposal and Administrative Submissions

Factor 5 original and two

* The evaluation criteria and order of importance of the factors are described below in Section II, Paragraph B, Basis for Award.

2. PROPOSAL

a. Format. The submission volumes shall be clearly indexed and logically assembled. Each volume shall be clearly identified and shall begin at the top of a page.

All pages of each volume shall be appropriately numbered and identified by the complete company name, date and Request for Proposal (RFP) number in the header and/or footer.

(i) VOLUME I – Technical. The Offeror shall submit information supporting the comprehensiveness of the offeror’s technical proposal necessary for the government to determine the offeror’s technical capability and resources to perform high quality work in an efficient, and safe manner. Offerors submitting as joint ventures should provide sufficient information demonstrating each partner’s experience or role on this project.

It is the responsibility of the Offeror to identify, detail and demonstrate the technical aspects of the submitted projects to the solicitation criteria elements. The evaluation committee WILL NOT make assumptions. If projects submitted do not have a comparable scope to this solicitation and if projects do not address the minimum requirements, the proposal will still be evaluated; however, it may demonstrate a potential increased risk of unsuccessful contract performance.

The two (2) factors that will be considered under this Volume are described as follows:

(1) Section 1 – Factor 1 This factor evaluates the offeror’s Construction

Approach. The Offeror will provide information to substantiate the following:

The Offerors shall submit a narrative demonstrating a clear understanding and acceptable approach to the construction of the Togo Island Bendway Weirs as described in the solicitation specifications and plans. The Government recognizes that the proposed bendway weirs location is challenging in that the contractor is responsible for accurately placing type A stone in high currents with varying depths potentially in excess of approximately 65 feet. The contractor is also responsible for lessening impacts to navigation traffic while doing so. Therefore, Offerors are encouraged to submit thorough, detailed, and complete narratives describing their proposed construction approach to complete the project as required in the solicitation for the Government’s review.

The submitted narrative should include methods, equipment, personnel, etc.

required to successfully complete the project and demonstrating a thorough understanding of the solicitation requirements. The submitted narrative should also include methods necessary to overcome challenges anticipated with construction of the Togo Island Bendway Weirs. At a minimum, the narrative shall address the following areas:

• Continuous supply of stone to meet the placement rates stated in the solicitation including identifying the proposed stone source and the ability to sustain stone delivery to the worksite in conformance with the daily production rate. The Offeror shall also provide a statement of commitment from the stone supplier(s) proposed to use to complete this project.

• Equipment including barges, work plants, excavators, support vessels, etc. needed to meet the stone placement accuracy and rates stated in the solicitation.

The Offeror shall state what equipment is owned or anticipated to be leased for this project.

• Placement method including methods to ensure accurate placement of stone with minimal stone loss due to being out of section. Placement methods should also address the ability to adapt to changing river conditions including stages and existing site conditions as well as proposed approach to minimize impacts to commercial navigation during construction.

• Surveying capabilities to monitor and ensure accurate stone placement.

• Validation of construction approach including how the proposed approach has been successfully used on recent projects of similar scope, complexity, magnitude and schedule.

• Coordination of navigation traffic during construction including allowing the navigation queue to clear during the nighttime hours and potential standby during daytime hours to clear the navigation queue as required in the solicitation during the seasonal harvest period of September to November.

(2) Section 2 – Factor 2 This factor evaluates the offeror’s Project

Management Plan. The offeror will provide information to substantiate the following:

The Offerors shall provide a detailed Project Management Plan to include their project management philosophy. Offerors are encouraged to submit thorough, detailed, and complete narratives describing their organization’s approach to project management.

The Offeror shall include the following as a minimum in their submission:

• Details demonstrating construction and quality management plan for potentially concurrent weir placement operations.

• Surveyor and contact pilot licenses meeting the solicitation requirements.

• Sample organizational chart showing lines of authority needed to manage

• A list of anticipated subcontracted work activities and what work will be self-performed.

• Details of their corporate safety philosophy and what tools they will use to ensure no lost time accidents will occur including OSHA safety forms.

• A narrative of their use of the USACE Resident Management System

(RMS) – Contractor Mode or similar contract administration and quality control systems.

(ii) VOLUME II – Factor 3 - Past Performance.

This volume shall contain past performance information regarding similar contracts. This volume shall not exceed 25 pages plus five (5) pages for each major subcontractor, excluding Past Performance Questionnaire Forms. Offerors shall submit Government and/or commercial contracts for the prime offeror and each major subcontractor. Data concerning the offeror shall be provided first, followed by each proposed major subcontractor, in alphabetical order. For the purposes of this solicitation a major subcontractor is defined as a subcontractor performing 10% or more of the work. In addition, letters of commitment shall be included for all major subcontractors for their past performance to be considered.

To be considered Recent and Relevant, Offerors shall submit their past performance on three (3) to five (5) bendway weir or deep stone placement channel improvement projects completed at $10M or greater that are similar in scope, complexity, magnitude, and schedule to the solicitation requirements.

Of the relevant projects submitted for consideration, a minimum of three

(3) projects are required where the offeror self-performed stone placement construction as either a prime or subcontractor within 10 years of the date of this solicitation with at least one (1) of the three (3) submitted projects completed within the last five (5) years or currently ongoing and at least 70% complete.

In addition, a minimum of one (1) of the three (3) relevant projects submitted for consideration shall have been self-performed by the offeror as the stone placement prime contractor within 10 years of the date of this solicitation.

The Government reserves the right to verify supplied information and references and further assess owner satisfaction and other performance information available. The Government may also use any other past performance information, from other sources, outside of the Offerors proposal in their evaluation. If more than the specified number of projects are submitted, the Government will evaluate the most recent projects submitted.

This volume shall be organized into the following sections:

(1) Section 1 – Contract Descriptions. This section shall include the following information in the following format.

(a) Contractor/Subcontractor place of performance, CAGE Code and Unique Entity Identification Number (UEI). If the work was performed as a subcontractor, also provide the name of the prime contractor and Point of Contact (POC) within the prime contractor organization (name, and current address, e-mail address, and telephone numbers).

(c) Government’s technical representative/Contracting Officer’s Representative and current email address, and telephone numbers.

(d) Government contract administration activity and the Administrative Contracting Officer’s name, and current e-mail address, telephone number.

(e) Contract Number and, in the case of Indefinite Delivery type contract, include Task Order Numbers.

(f) Contract Type (specific type such as Fixed-Price (FP), Cost Reimbursement (CR), Time & Material (T&M), etc.).

(g) Awarded price/cost.

(h) Original delivery schedule, including dates of start and completion or work.

(i) Final or projected final, delivery schedule, including dates of start and completion of work.

RFP.

The Offeror shall include the following past performance information demonstrating experience in:

(a) Placement of stone in depths exceeding 60 feet in flowing river conditions.

(b) Continuous delivery of stone to meet the placement rates stated in the solicitation.

(c) Brief description of the submitted contract scope, complexity, magnitude, and schedule including project quantities, material type(s), equipment used and underwater placement depths.

(d) The Offeror shall include the percentage of the final contract amount that was self-performed work along with a description of that self-performed work.

(f) For all cited past performance in an offeror’s proposal, the offeror shall include a Past Performance Questionnaire (PPQ). The template for this survey is provided as Appendix D - ENCL 1. The PPQ shall be filled out by the offeror’s past client. The Government may verify all past performance submitted as part of an offer and failure to include valid contact information may prevent that verification and consideration of the information provided.

(iii) VOLUME III – Factor 4 - Small Business Participation.

(1) All offerors (both large and small businesses) are required to complete a Small Business Participation Proposal Appendix E - ENCL 1: in accordance with DFARS 215.304. Offerors should propose the level of participation of small businesses (as a small business prime, joint venture, teaming arrangement, and/or small business subcontractors) in the performance of the requirement. A percentage goal of greater than 0% should be provided for all Small Business Socio-Economic Categories; if a percentage goal of 0% is provided for any Small Business Socio-Economic Category, a justification is required of why there will be no attempt made to include that category in your small business participation.

(2) Commitment to Small Business

The Offeror shall include a written statement of its established procedures to ensure timely payments to small business subcontractors in accordance with FAR 52.219-8, Utilization of Small Business Concerns (for those contracts under which it was required within the past three (3) years from the closing date of this solicitation). If not required in any recent contracts, the Offeror shall so state.

(3) Other than Small Businesses must also submit a Subcontracting Plan meeting the requirements of FAR 52.219-9 and DFARS 252.219-4003 (or DFARS 252.219-7004 if the offeror has a comprehensive subcontracting plan). Reference Appendix E - ENCL 3 DOD Checklist for Reviewing Subcontracting Plans.

Subcontracting Plans shall reflect and be consistent with the commitments offered in the Small Business Participation Proposal.

Large business contractors may achieve the small business participation goals through subcontracting to small businesses. Small business contractors may achieve small business participation goals through their own performance/participation as a prime and also through a joint venture, teaming arrangement, and subcontracting to other small businesses.

(iv) VOLUME IV – Factor 5 - Price Proposal and Administrative

Submissions.

The volume shall be organized into the following sections:

(1) Cover letter containing:

• Solicitation number.

• Name, address, email address and telephone number of the Offeror.

• Names, title, email, and telephone number of persons authorized to sign the proposal/contract, and negotiate on behalf of the company, on company letterhead.

(2) Price Proposal:

• Fully completed Standard Form 1442 (SF 1442).

• Fully Completed Bid Schedule.

• Copies of Joint Venture (JV) Agreements, Subcontract, and/or Teaming

Agreements, if applicable.

• Fully Completed Contractor Representations & Certifications.

• Completed and signed copy of each Amendment issued to the solicitation, if any.

(3) General Instructions. In accordance with FAR 15.402 and 15.403-1, certified cost or pricing data are not required based on the fact that adequate competition is expected for this procurement.

If after receipt of proposals the Contracting Officer determines that it is necessary to enter into discussions with offerors information other than certified cost or pricing data may be requested in contractor format. Information submitted shall be prepared following the instruction in FAR 15.403-5.

If after receipt of proposals the Contracting Officer determines that there is insufficient information available to determine price reasonableness and none of the exceptions at FAR 15.403-1 apply, the Offeror may be required to submit cost or pricing data.

Additionally, in the event that adequate competition is not obtained, the Contracting Officer may incorporate FAR 52.215-20 entitled, “Requirements for Cost or Pricing Data or Information Other Than Cost or Pricing Data,” into the solicitation and request a Certificate of Current Cost or Pricing Data.

There are no page limitations for this volume. Proposal information included in this volume which is not directly related to Price or Cost will be disregarded.

B. BASIS FOR AWARD

The award will be made based on the best overall (i.e., best value) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the (5) evaluation factors:

Factor 1 – Technical - Construction Approach Factor 2 – Technical - Project Management Plan Factor 3 – Past Performance Factor 4 – Small Business Participation Factor 5 – Price

Factor 1, Construction Approach, is more important than Factor 2, Project Management Plan.

Factors 1 and 2 are significantly more important than Factors 3, 4, and 5.

Factor 3, Past Performance, is more important than Factor 4, Small Business Participation, and Factor 5, Price.

Factor 4, Small Business Participation, is more important than Factor 5 Price.

Factor 5, Price is significantly lower in importance than the preceding non-price factors except as identified in section C.

To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the technical factors and the Small Business Participation factor.

Additionally, any other than small business offeror must have an acceptable Small Business Subcontracting Plan to receive an award in accordance with FAR 19.702(a).

Offerors will be cautioned that the award may not necessarily be made to the lowest cost offered. NOTE: ALL NON-PRICED FACTORS COMBINED ARE MORE

IMPORTANT THAN COST/PRICE.

C. FACTORS TO BE EVALUATED

The above evaluation factors will be used to evaluate each proposal: Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors described.

The Government reserves the right to make award based upon the Price factor in the event that the Technical (Factors 1 & 2), Past Performance, and Small Business Participation evaluation results of all the offerors’ proposals are substantially the same.

Factor 1 and Factor 2: Evaluation of the offeror’s proposal shall address each Technical Factor as it applies to the project specifications. A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach”, Paragraph D of this section.

During evaluation of each proposal, the Government will assign each Technical Factor an adjectival rating and write a narrative evaluation reflecting the identified findings.

Factor 3: Past Performance: Each offeror’s past performance will be reviewed to determine recency, relevancy, and a confidence assessment will be made.

Factor 4. Small Business Participation: Each offeror’s level and degree of commitment to utilize small business in execution of the requirement will be evaluated.

Factor 5: Price: The resulting award will be a FFP Type Contract. Price reasonableness will be utilized in the evaluation of the FFP effort.

D. EVALUATION APPROACH

All proposals shall be evaluated by the Source Selection Evaluation Board

(SSEB).

1. The overarching evaluation approach for all factors is as follows:

a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the

RFP.

b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable.

The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

2. Technical – Factor 1 and Factor 2:

Factor 1: This factor evaluates the offeror’s proposed Construction Approach for the basic contract period. Marginal levels of the overall approach to construction of the project could indicate a lack of understanding concerning mission requirements and may result in the entire proposal receiving an unfavorable rating and/or being eliminated from the competitive range. The evaluation will focus on the offerors’:

• Continuous supply of stone to meet the placement rates stated in the solicitation including identifying the proposed stone source, and the ability to sustain stone delivery to the worksite in conformance with the daily production rate, including the Offeror’s statement of commitment from the stone supplier(s) proposed to use to complete this project.

• Equipment including barges, work plants, excavators, support vessels, etc. needed to meet the stone placement accuracy and rates stated in the solicitation, including the Offeror stating what equipment is owned or anticipated to be leased for

• Validation of construction approach including how the proposed approach has been successfully used on recent projects of similar scope, complexity, magnitude, and schedule.

• Coordination of navigation traffic during construction including allowing the navigation queue to clear during the nighttime hours and potential standby during daytime hours to clear the navigation queue as required in the solicitation during the seasonal harvest period of September to November.

Factor 2: This factor evaluates the offeror’s Project Management Plan. Major emphasis will be placed on the following:

The Offeror’s project management philosophy and their organization’s approach to project management.

• Details demonstrating construction and quality management plan for potentially concurrent weir placement operations.

• Surveyor and contact pilot licenses meeting the solicitation requirements.

• Organizational chart showing lines of authority needed to manage this project.

• Anticipated subcontracted work activities and what work will be self-performed.

• Details of their corporate safety philosophy and what tools they will use to ensure no lost time accidents will occur including OSHA safety forms.

• Their use of the U.S. Army Corps of Engineers Resident Management System (RMS) – Contractor Mode or similar contract administration and quality control systems.

In accordance with the Department of Defense Source Selection Procedures, the methodology for evaluating Technical Approach and Related Risk is the Separate Technical/Risk Rating, (see Table 1a below).

Technical Rating. The offeror’s technical solution will be rated separately from the risk associated with its technical approach. The technical rating evaluates the quality of the offeror’s technical solution for meeting the Government’s requirement and includes consideration of the significant strengths, uncertainties, and deficiencies found in the proposal. The risk rating considers the risk associated with the technical approach to meeting the requirement. (See Table 1b below).

Table 1a Technical Ratings

Adjectival Rating Definition

Outstanding Proposal demonstrates an exceptional approach and understanding of the requirements, contains multiple strengths and/or at least one significant strength.

Good Proposal demonstrates a thorough approach and understanding of the requirements and contains at least one strength or significant strength.

Acceptable Proposal demonstrates an adequate approach and understanding of the requirements.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements.

Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is un-awardable.

Table 1b

Technical Risk Ratings Adjectival Rating Description

Low Proposal may contain weakness/weaknesses which have low potential to cause disruption of schedule, increased cost, or degradation of performance.

Normal contractor emphasis and normal Government monitoring will likely be able to overcome any difficulties.

Moderate

Proposal contains a significant weakness or combination of weaknesses which may have a moderate potential to cause disruption of schedule, increased cost, or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome any difficulties.

High

Proposal contains a significant weakness or combination of weaknesses which is likely to have high potential to cause significant disruption of schedule, increased cost, or degradation of performance. Special contractor emphasis and close Government monitoring will unlikely be able to overcome any difficulties.

Unacceptable Proposal contains a deficiency or a combination of significant weaknesses that causes an unacceptable level of risk of unsuccessful performance.

3. Past Performance - Factor 3 the Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the contract specifications.

a. Evaluation of past performance shall be in accordance with this plan, utilizing the forms and questionnaires set forth Appendix D - ENCL 1.

b. The Government will focus its inquiries on the offeror’s (and major subcontractor’s) record of performance as it relates to all solicitation requirements, including cost, schedule, performance, and management of subcontractors.

For the purposes of this requirement, major subcontractors are defined as members of an offeror’s overall team who are expected to perform 10 percent or more of the proposed effort. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process.

Therefore, offerors will be reminded to include the most recent and relevant efforts in their proposal. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned a “neutral confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the NAICS 237990 – Other Heavy and Civil Engineering Construction.

c. Offerors shall submit Government and/or commercial contracts for the prime offeror and each major subcontractor in performance or awarded during the past number of years previously indicated, from the issue date of this RFP, which are relevant to the efforts required by this RFP. The Government may consider a wide array of information from a variety of sources but is not compelled to rely on all the information available.

d. The past performance factor considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract requirements. There are three aspects to the past performance evaluation:

recency, relevancy, and confidence.

(i) RECENCY: The first aspect is to evaluate the recency of the offeror’s past performance. Recency is generally expressed as a time-period during which past performance references are considered relevant and is critical to establishing the relevancy of past performance information. Recency is defined above in the Proposal Submission Requirements.

(ii) RELEVANCY: The second aspect is to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. The following criteria (see Table 2) will be used to establish what is relevant which shall include similarity in scope, complexity, magnitude, and schedule to the solicitation requirements.

Table 2 - Past Performance Relevancy Ratings Rating Definition Very Relevant Present/past performance effort involved essentially the same scope, complexity and magnitude and schedule of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope, complexity and magnitude and schedule of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope, complexity and magnitude and schedule of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope, complexity and magnitude and schedule of effort and complexities this solicitation requires.

(ii) CONFIDENCE ASSESSMENT: The third aspect assesses the overall quality of the offeror’s past performance. Documented results from Past Performance Questionnaires, interviews, CPARS, and/or other sources form the support and basis for this assessment.

e. Performance Confidence Assessment will utilize the Performance Confidence Assessment (see Table 3 below) to select the most appropriate confidence level for each Offeror.

TABLE 3 - Performance Confidence Assessments

Rating Definition Substantial Confidence Based on the offeror’s recent/relevant performance record, the

Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The Offeror may not be evaluated favorably or unfavorably on the facto of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

4. Small Business Participation – Factor 4. IAW Defense FAR Supplement (DFARS) 215.304(c)(i), the extent to which offeror’s identify and commit to small business performance of the contract shall be evaluated. Offerors (both large and small busiess) shall submit a Small Business Participation Proposal which specifies the offeror’s level and degree of commitment to small business utilization/participation in performance of this requirement. A Small Business Participation Proposal is required from all offerors. The Government will evaluate the following:

a) The extent to which such firms are specifically identified in proposals.

b) The percentage of participation of such firms in terms of the value of the total acquisition.

c) The statement of commitment to small business.

d) The realism of the proposal.

TABLE 4 – Small Business Ratings Rating Description

Acceptable Proposal indicates an adequate approach and understanding of small business objectives.

Unacceptable Proposal does not meet small business objectives.

Small business contractors may achieve small business participation goals through their own performance/participation as a prime and also through a joint venture, teaming arrangement, and subcontracting to other small businesses.

Large business contractors may achieve the small business participation goals through subcontracting to small businesses.

Other than Small Businesses must also submit a Subcontracting Plan meeting the requirements of FAR 52.219-9 and DFARS 252.219-4003 (or DFARS 252.219-7004 if the offeror has a comprehensive subcontracting plan). Reference Appendix E - ENCL 3 DOD Checklist for Reviewing Subcontracting Plans. Subcontracting Plans shall reflect and be consistent with the commitments offered in the Small Business Participation Commitment Document. The Subcontracting Plan will not be evaluated as part of the source selection evaluation but will be subject to approval by the Contracting Officer prior to a contract award.

5. Price – Factor . Adjectival ratings shall not be used for offeror’s Price proposals. The Government will fully evaluate all priced Contract Line Items for award purposes, the total proposed price for all CLINs will be added together into a total sum.

The Offeror’s Price proposal will be evaluated as follows.

a. Firm Fixed-Price Evaluation. For a price to be fair and reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. The Offeror’s proposed fixed-price CLINs may be evaluated, using one or more of the techniques described in FAR 15.404-1 to determine if they are fair and reasonable. A comparative analysis will be made between the Offeror’s price and the Independent Government Estimate (IGE). Per UAI 5136.205-100 Statutory Cost Limitations-Civil Works Contracts – IAW 33 U.S.C, 624, no Civil Works construction shall be done by private contract if the contract price exceeds the Government Estimate by more than 25%.

b. Overall Price Proposal Evaluation: The overall Price proposal will evaluated for the following:

1) Compliance: The Price proposal submitted by the Offeror will be evaluated for compliance based upon the submission requirements contained in the proposal submission instructions.

2) Unbalanced Pricing: The Offeror’s overall Price proposal will be evaluated for unbalanced pricing as defined in FAR 15.404-1(g). An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government (see FAR 15.404-1(g)(1) through FAR 15.404-1(g)(3)).

3) Errors: The Offeror’s Cost/Price proposal will be reviewed for errors. The Offeror may be given an opportunity to clarify certain aspects of their proposal at the sole discretion of the Contracting Officer.

E. DISCUSSIONS

1. GENERAL INFORMATION. It is the Government’s intent to award a contract without discussions. Discussions may be held if determined to be in the best interest of the Government. In accordance with FAR 15.306(d), discussion sessions with each offeror may be held. Should discussions take place, all offerors in the competitive range will be allowed a minimum of (2) calendar days to submit Final Proposal Revisions.

2. DISCUSSION SCHEDULING. If discussions are conducted, the Contracting Officer will schedule the discussion sessions, and each offeror will be notified of the time and place at least (1) business days prior to their discussion session. The Contracting Officer will provide additional instructions with the notification. The discussion sessions will take place telephonically, or by any other medium of the Contracting Officer’s choosing.

NOTES:

(A) THIS PROCUREMENT IS UNRESTRICTED UNDER NAICS CODE 237990 WITH A SMALL BUSINESS SIZE STANDARD OF $45,000,000.00. Reference Limitations on Subcontracting FAR 52.219-14. This procurement is Unrestricted under NACIS Code 237990. The awardee of this contract shall comply with all requirements up to and including the following:

Services (except construction): Contractor will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.

Supplies (other than procurement from a nonmanufacturer of such supplies): Contractor will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract.

General construction: Contractor will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 85 percent subcontract amount that cannot be exceeded.

Construction by special trade contractors: Contractor will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 75 percent subcontract amount that cannot be exceeded.

Upon the Contracting Officer’s request, the Contractor shall submit a report to the Contracting Officer documenting compliance with FAR 52.2l9-l4. If the Contractor is using Similarly Situated Entities, it must be clearly identifiable in the submitted reports. If the required percentage is not being met the Contractor shall also include, with the semiannual report, a plan to meet the required percentage before the contract end date.

The below calculation for FAR 52.219-14 is for example only and not representative of this solicitation or any contract that may be awarded as a result of this solicitation.

1. Total value of contract award = $5,000,000.00

2. Cost of materials = $3,000,000.00

3. Adjusted amount (contract award value less cost of materials): $2,000,000.00 ($5,000,000.00 - $3,000,000.00)

4. 85% of $2,000,000.00 may be paid to non-similarly situated entities ($1,700,000.00)

5. 15% of $2,000,000.00 must be paid to a similarity situated entity ($300,000.00)

What is similarly situated and what does it mean for the prime?

i. 1st tier subcontractor that has the same small business program status of the qualified prime contractor (i.e. HUBZone prime contractor, any HUBZone subcontractor is similarly situated).

ii. Any 1st tier subcontracts to similarly situated entities can count towards the prime contractor’s self-performance requirements.

iii. Example: HUBZone Set-Aside Contract, 1st Tier is a HUBZone Small Business subcontractor. This meets the similarly situated requirement and the work performed by the HUBZone subcontractor will count towards the HUBZone prime contractor’s self-performance requirement.

iv. Example: SDVOSB Set Aside Contract, 1st Tier is a WOSB subcontractor only, this does not meet the “similarly situated” requirement and the WOSB subcontractor performance does not count towards the SDVOSB prime contractor’s self-performance requirement.

IF APPLICABLE, IN ACCORDANCE WITH FAR 52.219-9, A SMALL BUSINESS SUBCONTRACTING

PLAN SHALL BE REQUIRED, and SHALL BE SUBMITTED WITH YOUR PROPOSAL PACKAGE. THE

SMALL BUSINESS SUBCONTRACTING PLAN SHALL BE FORMATTEED IN ACCORDANCE WITH THE
