SENDING IN THE PROPOSAL

Proposals shall be submitted electronically to temekka.s.ellis@usace.army.mil, travis.j.specht@usace.army.mil, and michael.w.hughes@usace.army.mil.

If proposals exceed 40MB in size, offerors shall utilize the DoD SAFE application, https://safe.apps.mil/ to submit their proposals.

The DoD SAFE Application is used to send large files to individuals that would normally be too large to send via email. There are no user accounts for SAFE. Authentication is handled via email. Anyone has access to SAFE, and the application is available for use by anyone. The DoD SAFE application can be accessed via https://safe.apps.mil/.

https://www.fiscal.treasury.gov/fsreports/ref/suretyBnd/c570_a-z.htm https://www.fiscal.treasury.gov/fsreports/ref/suretyBnd/c570_a-z.htm mailto:temekka.s.ellis@usace.army.mil mailto:travis.j.specht@usace.army.mil mailto:michael.w.hughes@usace.army.mil https://safe.apps.mil/ https://safe.apps.mil/

a. Creating a Drop-off: In order for offerors to submit their proposal, they must first notify temekka.s.ellis@usace.army.mil and travis.j.specht@usace.army.mil and michael.w.hughes@usace.army.mil. A Request Drop-off will be created. As a result, offerors will receive an email with a link to submit their proposals. Offerors shall notify the individuals identified above if they did not receive the link. Please note a drop-off request is valid only for 14 days.

It is the offeror’s responsibility to ensure their proposal is submitted timely.

b. Size Limitations on Uploads: Being able to upload files larger than 2 GB depends on the browser being used. If at all possible, use a modern 64-bit browser on a 64-bit operating system. If you only have a 32-bit system (the most common cause is Windows 7), then use a modern version of Google Chrome or Firefox. Older versions of Microsoft Internet Explorer are particularly bad at this. If updating your browser is not an option and the combined size of all files being uploaded exceeds 2 GB, split the files into multiple drop-offs. If a single file exceeds 2 GB, split the file into smaller pieces (e.g. using the Split option in WinZip or "Split to volumes" option in 7-Zip) and upload them in separate drop-offs. The DoD SAFE software itself has configurable limits on the amount of data that can be uploaded in a single drop-off. Even for browsers that support uploads larger than 2 GB, drop-off may not exceed 8.0 GB per file, or 8.0 GB total for the entire drop-off.

c. If you are having the following issues when dropping off or picking up a large file: Your browser reports a bad or broken connection after downloading a significant portion of the file •An error page is displayed that indicates you dropped off no files then you are most likely connected to the Internet via a connection too slow to move the amount of data in a timely fashion. Your computer normally has at most 2 hours to fully send or receive a drop-off.

Problems accessing the site: Problems accessing the DoD SAFE site by external (non-CAC) users are typically due to SSL and/or client certificate issues. If the user receives a warning about a problem with the website's security certificate, this is because their browser is not configured to trust the DoD certificate authorities. The user can either import the DoD certificate authorities by following the instructions found here or they can accept the risk and click on the option to continue to the website. Also on non-CAC system - if the browser pops up a window prompting for a certificate to use for authentication, clicking on Cancel should allow unauthenticated access to the site.

d. File names shall be titled:

i. Phase I, Volume 1: W5J9JE-20-R-0004 Vol1 Past Performance-Company Name

ii. Phase I, Volume 2: W5J9JE-20-R-0004.Vol2 Management Approach, Water Supply

Narrative, and Contractor Supplied Batch Plant-Company Name

Proposal submission shall be submitted via DoD SAFE by the date and time indicated on the SF 1442, or as amended. No facsimiles or regular e-mail submissions of proposals, are permitted:

Late Proposals: Any proposal, modification, or revision received by the Government after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the contracting officer determines that accepting the late offer would not unduly delay the acquisition, and (1) if it was transmitted through an electronic commerce method authorized by the solicitation, and it was received at the initial point of entry to the Government infrastructure not later than 4:00 p.m. one working day prior to the date specified for receipt of proposals; or (2) there is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or (3) it is the only proposal received. However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

ADDITIONAL INFORMATION

The Offeror shall not modify the terms and conditions of the solicitation, nor add conditions or qualifications to his proposal based on an assumption or based on his own modification of the terms and/or conditions of the solicitation. Should the Offeror include terms and conditions that conflict with the terms and conditions of the solicitation, the Offeror’s proposal may be determined to be ineligible for further evaluation or for award. Any questions related to specific terms and conditions contained within the solicitation should be resolved with the Contracting Officer prior to proposal submission.

References in the Offeror’s proposal to, and examples of “classified” projects or contracts, should not be included in the Offeror’s proposal unless the information is authorized to be viewed or utilized by the Government for review and evaluation. Offerors who include information in their proposals that they do not want disclosed to the public or to anyone without a need-to-know, must clearly mark their proposals in accordance with the instructions at FAR 52.215-1, paragraph (e), Restriction on Disclosure and Use of Data.

Electronic proposals submitted via email and DOD SAFE are the required methods of proposal transmission and will be the only forms of submission accepted. It is the Offeror’s responsibility to ensure its proposal is received by the Government by the date and time of the proposal deadline. Undeliverable emails due to an Offeror’s proposal size is not the responsibility of the Government.

Proposal Expenses and Pre-Contract Costs: The request for proposal (RFP) solicitation does not commit the Government to pay any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any firm submitting a proposal in response to this solicitation.

JOINT VENTURE PROPOSAL

If submitting a proposal as a Joint Venture, the experience and past performance of each of the Joint Venture Partners can be submitted for the Joint Venture Entity. The experience for each Joint Venture Partner should be clearly described.

The proposal may receive a higher rating if the proposal contains evidence of the Joint Venture Entity working successfully together previously on relevant projects.

An Offeror that is part of a Joint Venture must submit a legally binding Joint Venture Agreement. The Government will not evaluate the capability of any Offerors that are not included in the Joint Venture agreement. Joint Ventures must include a copy of the legal joint venture agreement signed by an authorized officer from each of the firms comprising the Joint Venture with the chief executive of each entity identified and must be translated into English, if the original agreement is in a language other than English.

If submitting a proposal as a joint venture, the experience and past performance of each of the joint venture partners can be submitted for the joint venture entity. The experience for each joint venture partner will be considered the experience of the joint venture entity. Joint ventures shall submit the following additional documentation regarding their business entities:

a. A copy of their joint venture agreement in English.

b. A detailed statement outlining the following in terms of percentages, where appropriate.

c. The relationship of the joint venture parties in terms of business ownership, capital contribution, and profit distribution or loss sharing. The joint venture agreement must show that joint venture members are jointly and severally liable for any obligations under the contract.

d. The management approach of the joint venture in terms of who will conduct, direct, supervise and control the project and have custody and control of the assets of the joint venture and perform the duties necessary to complete the work.

e. The structure of the joint venture and decision-ranking responsibilities of the joint venture parties in terms of who will control the manner and method of performance of the work.

f. The bonding responsibilities of the joint venture parties. Bonding capability shall at a minimum meet the bonding requirements as defined above in paragraph m. Failure to provide evidence of sufficient bonding capability as defined above, will result in rejection of the offer without further evaluation.

g. Identification of the key personnel having authority to legally bind the joint venture to subcontracts and state who will provide or contract for the labor and materials for the joint venture.

h. Identification of party maintaining the joint venture bank accounts for the payment of all expenses and the deposits of all receipts, keep the books and records, and pay applicable taxes for the joint venture.

i. Identification of party furnishing the facilities, such as office supplies and telephone service.

j. Identification of party having overall control of the joint venture. Other sections of the proposal shall identify, where appropriate, whether key personnel are employees of the individual joint venture parties and identify the party, or hired as employees of the joint venture. Include this information as a part of Phase I.

k. A complete and legally binding document with all the information required under this section titled “Joint Ventures” shall be included. The JV agreement submitted to the Government shall be the only valid JV agreement for purposes of performance under this contract or any responsibilities of the JV under the contract. Factor 2 – Management Approach is approximately equal to Factor’s 3 and 4 combined. Factor’s 3 – Water Supply Narrative and Factor 4 – Contractor Supplied Equipment are approximately equal.

The Government will select up to five (5) acceptable offerors based on the ratings received on the factors in Phase I to move to Phase II. Only the selected firms will submit proposals for phase 2. Firms will be notified of their status after Phase I evaluations. Do not submit a Phase II proposal until directed by the contracting officer.

Phase II:

Factor 5: Project Design and Construction Approach: Each Offeror’s design and construction narrative will be reviewed to determine a clear understanding of the work and an ability to coordinate resources to ensure successful pursuit of the work.

Factor 7: Price: The resulting award will be a standalone “C” type contract. Cost Analysis will be performed in accordance with 15.404-1. The cost on the project and other price related attachments, which will be utilized in determining which Offeror provided the best value to the Government.

NOTE: All non-price factors (including final Phase I evaluations), when combined, are approximately equal to Factor 6 – Price.

To be considered for award, a rating of at least “Acceptable” must be achieved on all non-price factors, with the exception of past performance, which must be, at a minimum, somewhat relevant with no less than a neutral confidence rating.

Trade-off Analysis: After evaluations of all Phase II proposals are completed, the SSA will consider all factors to determine which Offeror submitted the proposal that represents the “best value” to the Government for this project. The Government reserves the right to award the resulting contract to other than the lowest proposed price. The greater the equality of the offerors’ ratings of their non-priced factors, the more important price shall become in selecting the Best Value to the Government. Unreasonably high and unreasonably low proposed prices shall be grounds for eliminating a proposal from the competitive range. The awarded contract will incorporate the successful offerors proposal to the extent it offers betterments and does not conflict with the solicitation requirements.

Evaluation of each Offeror’s proposal shall address each factor as it applies to the plans and specifications. A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach”, Paragraph C of this section. During evaluations of each proposal, the Government will assign each sub-factor an adjectival rating and write a narrative evaluation reflecting the identified findings.

Findings Definitions:

1. Findings Definitions:

a. Deficiency: A material failure of a proposal to meet a Government requirement or a combination of weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.

b. Strength: An aspect of an Offeror’s proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

c. Significant Strength: An aspect of the Offeror’s proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

d. Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.

e. Significant Weakness: A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.

f. Uncertainty: Any aspect of a non-cost/price factor proposal for which the intent of the offeror is unclear (e.g., more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission or mistake).

g. Adverse Past Performance: Past performance information that supports a less than satisfactory rating from sources where the information is from other than formal rating systems such as “PPIRS” or “FAPPIS.”

h. Clarification: Limited exchanges between the Government and the Offerors that may occur when award without discussions is contemplated. No proposal revisions are allowed.

i. Discussions: Exchanges between the Government and the Offerors that are undertaken with the intent of allowing the offeror to revise its proposal.

C. EVALUATION APPROACH

PHASE I

All proposals will be evaluated by the Source Selection Evaluation Board (SSEB). The overarching evaluation approach for Phase I is as follows:

a. Adequacy of Response. Each proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the solicitation.

The submission for this subfactor shall not exceed twenty-five (25) single spaced typed pages (A4 or letter size). Provide descriptions of at least (3) projects but no more than five (5) projects that have been constructed (i.e., construction is substantially complete, which is defined as being at least 75% complete) within the last five (5) years (from the solicitation issue date) which are similar in size and scope as defined in Subfactor A. In order to be considered similar, the proposed A/E firm must have been the designer of record (“DOR”) on the submitted project. The first design firm submitted will be the only DOR be evaluated under Subfactor B. Any additional design firms submitted will not be evaluated. Indicate any previous working relationship with the prime contractor.

NOTE: For purposes of evaluating Past Performance, the Prime Contractor is defined as the contractor identified in Block 14 of the Standard Form 1442. If more than one contractor is listed in Block 14, then a signed joint venture agreement must be submitted with the proposal and the joint venture shall be registered as such in the System for Award Management (SAM). However, each party of the Joint Venture must submit their own DUNS number with the JV proposal. Projects performed by other contractors than the offeror, such as teaming partners or subcontractors, will not be evaluated for past performance, unless those other contractors are part of a joint venture offeror as demonstrated by a signed joint venture agreement. If the offeror represents the combining of two or more companies as a joint venture for the purpose of this RFP, each company in the joint venture may submit project examples, but the total submitted by the joint venture will not exceed five (5).

Past Performance Questionnaire

The Past Performance Questionnaire (PPQ), enclosed, included in the solicitation is provided for the Offeror or its team members to submit to the client for each project the Offeror includes in its proposal for Factor 1, Past Performance. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed PPQs should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before the proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ (attached), which will provide contract and client information for the respective project(s). The Government reserves the right to contact each client regarding the uncompleted portion of any PPQs. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Mr. Michael Hughes via email at michael.w.hughes@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Offerors may provide a completed Department of Defense, DD2626 form or a Contractor Performance Assessment Report (CPAR), in lieu of Attachment 3. CPARS evaluations and DD2626s shall be signed by all designated authorities for consideration of evaluation.

These documents will not count against the page limitation for Factor 1.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, JV, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror's proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System mailto:michael.w.hughes@usace.army.mil

(FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror and the government is under no obligation to check other sources.

EVALUATION CRITERIA:

For both the Prime and the DOR, the SSEB will first evaluate the relevancy of recent past performance identified in the proposal in response to the submission requirements described above. By using the criteria identified above, the SSEB will determine how relevant a past project is when compared to the scope and magnitude of effort, and complexities of the contract scope of work. Projects that are more similar to the work expected to be performed on the contract as described in the contract scope of work, may be considered to be more relevant. A relevancy rating will be assigned to each submitted project using the Past Performance Relevancy Ratings in Table

1.1 below.

For both the Prime and the DOR, the SSEB will next review how well the offeror performed on those projects. The Government reserves the right to check cited references to verify supplied information and to assess owner satisfaction. In addition to the information submitted by the offeror, the Government may review any other sources of relevant information for evaluating past performance, including similar projects other than those submitted by the offeror.
