About this file

This federal contract opportunity solicitation seeks proposals for the Lake Worth Inlet North Jetty Rehabilitation project in Palm Beach County, Florida. Work includes repairing the approximately 900-foot long north jetty to restore its original profile and cross-section using new and reworked armor stones ranging up to 14 tons. Proposals are due August 24, 2020.

The scope of work involves pre-construction benthic and coral surveys, stone procurement and placement, and environmental protection measures. Access is limited due to nesting turtles and utilities, requiring water-based equipment. Construction tolerances allow flexibility but cannot expand work areas. The Navy Industrial Fund Code is 237990 and size standard is $39.5 million. This is an unrestricted acquisition where all responsible offerors are encouraged to participate. The solicitation will be issued electronically on beta.Sam.gov and interested vendors must register to receive amendments.

1.2 DEFINITIONS

1.2.1 Adverse Weather

"Adverse weather" occurs when atmospheric conditions at a definite time and place that are unfavorable to construction activities and is based on climatological and meteorological observations and data sources provided in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA.

1.2.2 Unusually Severe Weather

"Unusually severe weather" is weather that is more severe than the adverse weather anticipated by the Contractor for the season or location involved. Adverse weather delays are considered unusually severe weather if adverse weather delay days prevent work for 50 percent or more of the Contractor's scheduled work day.

1.3 WORK COVERED BY CONTRACT DOCUMENTS

1.3.1 Background

Palm Beach Harbor is a federal navigation project located in Palm Beach County Florida and discharges into the Atlantic Ocean. The jetties and revetments at the harbor entrance were constructed between 1935 to 1939.

Hurricane Irma impacted the north jetty by displacing and damaging existing stone. The objective of this project is to rehabilitate the north Jetty as shown on the plans.

1.3.2 Project Description

The project includes the work described below and incidental related work. This effort is to include all associated works required and described within this Contract package.

a. Work consists of repairs to restore the North Jetty of Lake Worth Inlet to its original profile and cross-section. The North Jetty is approximately 900 feet in length with a height of +0.82 feet

NAVD88.

SECTION 01 11 00 Page 2

b. Repairs require substantial moving and manipulation of new and reworking of existing stones to obtain the required interlocking within the tolerances provided. The reworking of stone is for only for the incorporation of new stone. Stones to be manipulated range from up to 14 tons with a specific weight of 165 pounds per cubic foot. Stone of such weight is available from various locations in Georgia and South Carolina. Locations of jetty rehabilitation are shown on the drawings.

c. Prior to work on the jetty, a pre-construction benthic community survey shall be performed on the jetty structure and any adjacent submerged areas that may be impacted by contractor's operations. Any coral relocations required as a result of the benthic survey shall be completed prior to jetty work. See section 01 57 20 ENVIRONMENTAL

PROTECTION.

d. Repairs require the procurement and delivery of stones and placement of stones along the identified repair areas. The distribution of the 6 to 14 ton stones is shown on the drawings.

e. Estimated armor stone quantities were calculated based on 1) the absent volume between the design template neatline and the existing surface generated from the survey, and 2) the expected void space around the placed armor stones. The void space is estimated to be 25% of the absent space. The quantity estimations do not account for the volume between the design template neatline and the upper tolerance neatline. The quantity of material above design surface but below the tolerance shall not be taken into account in the event of a VEQ claim.

f. Allowable construction tolerances shall not be used to expand the footprint of work beyond the limits required to establish the finished grade shown on the drawings. Tolerances will be used as a means to provide minor flexibility with the construction without the need for the Contracting Officer to reject the work at each repair area over the possibility of a few select Armor Stone occasionally projecting above the finished grade noted on the drawings.

g. The Contractor shall be responsible for obtaining information concerning the marine work environment including rain, fog, existing depths, shoaling, scouring, wind, wave, current, and tide conditions that could influence safety and construction operations prior to submitting a proposal or bid.

h. Access and staging areas have been identified on the drawings.

The access and staging areas shown on the drawings are for access to the site and staging of materials, but not access to the individual work areas.

i. Access to the individual jetty work areas via land is limited due to sea turtle nesting restrictions (See SECTION 01 57 20 ENVIRONMENTAL PROTECTION) and buried existing utilities. Work areas must be closed to the public during construction.

j. Water based equipment is required for this work at Areas A and B and shall be US coast Guard certified vessel for marine construction.

Work shall be conducted during daylight hours.

k. The survey shown on the drawings and provided in the contract depicts the conditions at the time of survey collection. It is

SECTION 01 11 00 Page 3 possible conditions have changed at the time of construction.

1.3.3 Location

The project is located at the north side of Lake Worth Inlet in Palm Beach County. Lake Worth Inlet is approximately 71 miles north of Miami Harbor and 53 miles south of Fort Pierce Harbor.

1.3.4 Safety Requirements

See Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS and EM 385-1-1 .

1.3.5 Work Performed by Others

The Government will not undertake to keep the channel free from vessels or other obstructions, except to the extent of such regulations, if any, as may be prescribed by the Secretary of the Army, in accordance with the provisions of Section 7 of the River and Harbor Act approved 8 August 1917. The Contractor will be required to conduct the work in such manner as to obstruct navigation as little as possible, and in case the Contractor's plant so obstructs the channel as to make difficult or endanger the passage of any vessels, said plant shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage. Upon completion of the work the Contractor shall promptly remove his plant, including ranges, buoys, piles, and other marks placed by him under the contract in navigable waters or on shore.

1.8 PRE-CONSTRUCTION PHOTOGRAPHIC SURVEY

Prior to commencement of construction, the Contractor shall perform a pre-construction photographic survey at the project site to document the pre-construction condition of the North Jetty. The survey shall document the entire jetty, but special attention shall be focused on the condition of existing armor stones, especially armor stones in areas which are not to be rebuilt as part of this contract, or which may be subject to damages from other activities. This pre-construction photographic survey shall include still photographs and/or videos in sufficient quantity to fully document the existing conditions which may be impacted by construction activities. A written narrative shall be prepared by the Contractor which organizes and summarizes the findings of the pre-construction photographic survey photographs and/or videos. The written narrative, together with the photographs and/or videos, shall constitute a Pre-construction Photographic Survey Report , which shall be submitted to the Contracting Officer for approval. No on-site work shall be performed until this "Pre-construction Survey Report" has been approved.

1.9 PRE-CONSTRUCTION CROSS-SECTIONS

a. Prior to the commencement of construction, the Contractor shall

SECTION 01 11 00 Page 5 perform a pre-construction survey of the jetty submitting cross-sections at 10-foot intervals along the established control line.

b. The survey data collected for the cross-sections shall meet the requirements of subparagraph "As-Built Cross-Sections" under Section

01 71 23 FIELD SURVEYING AND ENGINEERING.

The Contractor shall also submit all raw survey data, metadata and survey reports.

d. After the Contracting Officer has received and reviewed the submittal of the cross-section drawings and data, the Contractor and the Administrative Contracting Officer (ACO) will compare the pre-construction cross-sections with the extent of the repair work as shown on the construction drawings. The Contractor and the ACO shall also visually inspect the jetty, to the extent practicable, to determine if existing stone are less than the specified gradation for each area or have cracks and other flaws which may contribute to spalling or breakdown from handling and placing, such that they need to be removed and replaced with new armor stone. If it is found that areas of the jetty have deteriorated beyond the extents of the repair work, or less deterioration has occurred than originally estimated, new repair work extents shall be submitted and approved by the Contracting Officer. If it is agreed upon by the Contractor and the Contracting Officer that the repair work for any Work Area requires an increase or decrease of tonnage, then a revised tonnage shall be submitted by the Contractor for approval by the Contracting Officer.

If it is agreed upon by the Contractor and the ACO that the repair work for any Work Area requires an increase or decrease of tonnage, then a revised tonnage shall be submitted by the Contractor for approval by the Contracting Officer .If necessary, the work will be done at an equitable adjustment to the contract price in accordance with the Clause 52.243-4 CHANGES of Section 00700 CONTRACT CLAUSES.

1.10 LAYOUT OF WORK

Read this paragraph in conjunction with the Clause LAYOUT OF WORK (FAR 52.236-17) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.10.1 Established Project Control

The Government has established monuments along the work site(s). Each monument is represented in the contract drawings by a Designation and in most cases, an alphanumeric Permanent Identifier (PID). Information concerning the location and elevations can be found within the Survey Notes on the plan sheets. The Survey Notes for each included field survey will cite a particular survey number, and specify the control used to conduct that survey. Additional information is included in the Survey Notes that must be duplicated if an attempt to recreate the subject survey is desired.

See Section 00 31 21 CONTROL MONUMENT DESCRIPTIONS.

SECTION 01 11 00 Page 6

1.10.2 Layout

From the monuments, control data and elevations established by the Government, the Contractor shall complete the layout of the work and shall be responsible for all measurements that may be required for the execution of the work to the location and limit marks prescribed in the specifications or on the contract drawings, subject to such modifications as the Contracting Officer may require to meet changed conditions or as a result of necessary modifications to the contract work.

1.10.3 Survey

The Contractor shall furnish, at his own expense, such stakes, templates, platforms, equipment, tools and material, and all labor as may be required in laying out any part of the work from the monuments, control data and elevations established by the Government. It shall be the responsibility of the Contractor to maintain and preserve all stakes and other marks established by the Contracting Officer until authorized to remove them, and if such marks are destroyed by the Contractor or through his negligence, prior to their authorized removal, they may be replaced by the Contracting Officer, at their discretion, and the expense of replacement will be deducted from any amounts due or to become due the Contractor.

The Contracting Officer may require that work be suspended at any time when location and limit marks established by the Contractor are not reasonably adequate to permit checking of the work. Such suspension will be withdrawn upon proper replacement of the construction control markers.

1.11 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work shall be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.

1.12 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (31 OCT 1989)

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Clause DEFAULT (FIXED-PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract

SECTION 01 11 00 Page 7 period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.12.1 Contractor Responsibility

The project area may be affected by stormy, windy and/or rainy weather, including thunderstorms, during any time of the year. The Contractor shall be responsible for obtaining information concerning rain, wind, waves, currents, and tides that could influence safety and construction operations prior to submitting a proposal or bid.

a. Contractor shall research the project site conditions and incorporate potential adverse weather delays into their schedule prior to submitting a proposal or bid. The Contractor shall develop a schedule of monthly anticipated adverse weather based on the equipment to be used to complete the project and determine the conditions that would cause them to cease operations using the sources provided in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

b. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report the occurrence of adverse weather and unusually severe weather with the purpose to note impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's schedule to be considered "unusually severe weather".

c. The number of actual adverse weather delay days shall include days impacted by actual adverse weather, be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated for adverse weather by the Contractor, the Contracting Officer may convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days that should have been anticipated for the conditions at the project location.

MEASUREMENT AND PAYMENT

PART 1 GENERAL

1.1 SUMMARY

This section describes how Line Items will be measured and paid for when making progress payments. Work to be measured is described in specification sections listed for each Line Item. Measurement procedures for payment, required quantity survey or procurement documentation and payment restrictions are described in applicable specification sections.

Allocate costs for work not specifically mentioned to the Line Item most closely associated with work involved. Unless there is a specific Line Item for administrative costs, such as Quality Control and Safety, allocate such costs proportionally across all Line Items.

1.2 RESIDENT MANAGEMENT SYSTEM (RMS)

1.2.1 Definition

The terms "Contract Line Item Number (CLIN)" and "Line Item" are interchangeable herein (e.g.: CLIN 0001 is Line Item 0001). The term "CLIN" is a contracting term used in the Resident Management System (RMS) payment data base.

1.2.2 Instructions

See Section 01 45 00 RESIDENT MANAGEMENT SYSTEM CONTRACTOR MODE (RMS CM) for more information on CLINs, schedule of values of pay activities and construction schedule, and payment procedures. The Contractor mode user manual with in-depth instructions can be downloaded from the RMS web site indicated in Section 01 45 00 RESIDENT MANAGEMENT SYSTEM CONTRACTOR MODE

(RMS CM).

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Transmit submittal items in accordance with Section 01 33 00 SUBMITTAL PROCEDURES. Submit the following preconstruction submittal items no later than 30 calendar days after Notice to Proceed:

SD-01 Preconstruction Submittals

Schedule of Values ; G, RO

SECTION 01 22 00 Page 2

SD-07 Certificates

Request for Progress Payment ; G, RO

Submit monthly in accordance with subparagraph "Requesting Progress Payment" below.

Weight Scales ; G, RO

For all weight scales used to weigh materials brought to the site for incorporation in this project, Certificates of Calibration testing shall be provided by the Contractor.

Weight Slips ; G, RO

The Contractor shall submit the original weight slips signed by the stone supplier's representative for each load of stone brought to the site for use on the project. The weight slips shall clearly show the weight of each individual stone, with Unique Identifiers corresponding to the Identifiers marked on the stones. The weight slips will not be for single truckload weights.

1.4 JOB PAYMENT ITEMS

Payment items for the work of this contract for which contract lump sum payments will be made are listed in the LINE ITEMS AND PRICING SCHEDULE with the unit "JOB" and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, shall be included in the listed job item most closely associated with the work involved. The job price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.

Progress payments for job CLINs will be made in accordance with the Payments Under Fixed-Price Construction Contracts clause of Section 00700 CONTRACT CLAUSES in Volume 1. Submit a list of pay activities, (Schedule of Values) to breakdown bid for each job CLIN. The Schedule of Values shall be submitted for Government approval with the baseline schedule submittal (see Section 01 32 01 PROJECT SCHEDULE). An unbalanced Schedule of Values and Pay Activity Schedule will be returned for revision. If this contract contains either the Continuing Contracts clause or the Continuing Contracts (Alternate) clause, the Contractor should take into account the amount reserved for contract payments when preparing the construction schedule.

1.4.1 Mobilization and Demobilization (Line Item 0001)

Payment will only be made for costs associated with or incidental to mobilization upon commencement of work and demobilization after completion of work, including installation and removal of temporary aids to navigation, and establishment of initial project management and coordination. No accommodation or payment will be made based on the Contractor's sole decision to demobilize and remobilize prior to completion of work. See Clause PAYMENT FOR MOBILIZATION AND DEMOBILIZATION of Section 00700 CONTRACT CLAUSES in Volume 1.

SECTION 01 22 00 Page 3

1.4.2 Environmental Monitoring, Benthic Survey and Sea Turtle Nest Relocation (Line Item 0007)

Payment will be made for costs associated with or incidental to all environmental monitoring, benthic survey and sea turtle nest relocation activities indicated in Section 01 57 20 ENVIRONMENTAL PROTECTION.

1.4.3 Permitting Associated with Coral Relocation (Line Item 0008)

Payment will be made for cost assiciated with or incidental to obtaining all relevant permits associated with coral or octocoral relocation as indicated in Section 01 57 20 ENVIRONMENTAL PROTECTION. The Contractor will only be paid if the Contractor is required to obtain any permits associated with coral or octocoral relocation.

1.5 UNIT PRICE PAYMENT ITEMS

Payment items for the work of this contract on which the contract unit price payments will be made are listed in the LINE ITEMS AND PRICING SCHEDULE and described below. The unit price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for each of the unit price items.

Each Unit Price CLIN may be a single pay activity item or may be broken down into pay activities with smaller quantities equal to CLIN total.

Contract unit price multiplied by agreed quantity is full compensation.

1.5.1 Armor Stone Placement

1.5.1.1 Line Items

Armor Stone Placement Area A (Line Item 0002) Armor Stone Placement Area B (Line Item 0003) Armor Stone Placement Area C (Line Item 0004) Armor Stone Placement Area D (Line Item 0005)

1.5.1.2 Payment

Payment will be made for costs associated with or incidental to reworking of existing stone, and furnishing, delivering and installing new armor stone materials required for repairing the jetty as shown on the drawings, and as specified in Section 35 31 19 ARMOR STONE FOR JETTY REHABILITATION. Included in the unit cost is sampling and evaluation test section work (field quality control), providing and maintaining access to the work site(s), and noise control, barricades and signs, debris removal, obstruction of channel avoidance, dive reports, and surveys.

The Government will pay the contractor progress payments for that tonnage of stone delivered to the storage/staging area at 50 percent of the CLIN unit-price. The remaining 50 percent payment will be made upon final in-place acceptance by the Contracting Officer as verified by Government survey (see next subparagraph "Measurement" below). Payment will not be made for excess stone, unsuitable stone, or materials placed beyond the boundary of the rehabilitation areas shown on the drawings. If the initial 50 percent payment was already made for excess stone, unsuitable

SECTION 01 22 00 Page 4 material, or misplaced stone, this payment amount will be deducted from future progress payments or final payment by utilizing the Contractor's New Stone Placement Log and weight slips signed by the armor stone supplier's representative. New stone placed completely above or partially above the tolerance limits indicated in the drawings will be evaluated and determined by the Contracting Officer to either be reworked to be below the tolerance limits at no additional cost to the Government or deducted from payment.

Deduction of payment will only be for entire stones, and not for portions of stones that are above the tolerance limit. If there is excess stone for a Work Area that is unable to fit within the tolerance, and the Contractor has not yet qualified for all of the estimated tonnage agreed upon following the pre-construction survey (as described in Section 01 11 00 SUMMARY OF WORK, paragraph PRE-CONSTRUCTION CROSS SECTIONS), then the Contractor shall receive payment for the excess stone (up to the agreed amount). The Contractor will place the excess stone along the jetty at a location directed by the Contracting Officer.

1.5.1.3 Measurement

The total amount of material to be paid for under this item shall be measured by the ton with certified calibrated weight scales. Certificates of calibration for weight scales shall be provided by the Contractor. The Contractor shall weigh each stone brought to the site, using certified weight scales, and shall provide to the Contracting Officer the original weight slips signed by the stone supplier's representative for each load.

These signed weight slips shall be used as a basis of payment for this item. The information from these weight slips shall be incorporated into the Contractor's New Stone Placement Log.

For stones placed above or partially above the tolerance limit, please see previous subparagraph "Payment" above for direction.

If the new stone is unable to be identified, the weight of the stone will be determined by field inspection measurements by the Contracting Officer. The volume of the stone will be determined by multiplying the stone's measured volume by the density of the stone (165 lb/cf), and then divided by 2,000 lb/ton to calculate tonnage. The volume will be calculated by measuring at least three representative sides of the stone to determine the stone's nominal diameter. The volume is calculated using the nominal diameter as input into the general equation for a sphere.

In place acceptance shall be determined by Government survey of no more than three (3) separate surveys of acceptance sections during the performance period. The limits of these acceptance sections shall be determined by the Contractor prior to the commencement of construction.

When the area is found to be in a satisfactory condition, it will be accepted. Should more than three (3) Government surveys be required, the cost of each additional survey will be charged against the Contractor at the rate of $20,000 per survey. The Contractor shall give seven (7) calendar days advance notice, in writing, to the Contracting Officer's Representative of the need to perform the final acceptance surveys.

Standby time will be utilized only due to the presence of endangered species in the immediate area of operations, differing site conditions, security operations or other conditions as determined by the Contracting Officer. Standby time is not afforded for delays caused by adverse weather conditions. Payment will only be made for actual standby time required by the Contracting Officer. If performance of this line item is not required or implemented per the NOTES in Section 00010A LINE ITEMS AND PRICING SCHEDULE, no payment will be made to the Contractor for this line item. See Section 01 57 20 ENVIRONMENTAL PROTECTION.

1.5.2.2 Measurement
