TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS
ADJECTIVAL
RATING
DESCRIPTION
Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
b. Past Performance Rating. Assess the offeror’s probability of meeting the minimum past performance solicitation requirements. Use the rating descriptions outlined below.
PAST PERFORMANCE EVALUATION RATINGS
RATING DEFINITION
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
C. PROPOSAL EVALUATION PROCEDURES
1. All proposals will be received by the PCO, or designee, electronically via email no later than the time specified in solicitation. The SSEB, in concert with the PCO, will control all copies of the Offerors’ proposals and other associated data. Proposals received after the stated deadline shall be handled in accordance with FAR 15.208(b).
2. Upon receipt of proposals, the Contract Specialist (CS) will verify responsiveness by screening all proposals and ensuring they are properly completed, executed, and submitted in accordance with the solicitation requirements. The CS will notify the PCO of any non-responsive offerors.
3. The CS will then perform a price analysis on all offers received in accordance with 15.404-1(b).
Offers will also be reviewed for unbalanced pricing. Any offer that is found to have unbalanced pricing may be rejected if it is determined that the unbalanced pricing creates an unacceptable risk to the Government.
4. Once the price analysis has been performed, the CS will order the offers that are determined acceptable based on the price analysis, starting with the lowest price and moving to the highest price.
5. The PCO or designee will train the SSEB on the evaluation process. All applicable statutory and regulatory references will be made available to each member required to sign the Certification of Personnel Involved in an Acquisition/Source Selection Concerning Conflicts of Interest, Nondisclosure, and Rules of Conduct.
6. The CS will send the lowest priced offer to the SSEB, and the evaluators will individually review the Offeror’s proposal. Each member’s narrative assessment and go/no-go rating will be recorded on the Technical Evaluation Forms. Evaluation forms will be completed electronically. The assessment must be objective and not transfer ideas and concepts from one proposal to another.
Only the evaluation criteria stated in the solicitation will be used to accomplish the evaluation.
Evaluators may not inject their personal opinions of the Offerors if those opinions are not based on the proposal and the solicitation. The evaluator’s narrative assessment of each proposal is the cornerstone of the evaluation process and will be used for the source selection decision document as well as for debriefing unsuccessful Offerors, if required.
7. If there is a disagreement between the rankings of each firm evaluated, the SSEB Chair will conduct a consensus meeting for the evaluated offeror using the individual comments from the SSEB and will conduct an open forum discussion with the evaluators as a basis to arrive at consensus. The SSA and a representative from the Office of Counsel will attend the consensus meeting. It is important to realize that while individual SSEB members may have more specific expertise in one functional area, each member’s unique experience and understanding often prove valuable in identifying aspects of a proposal from a perspective not seen by other members. All participants should be open to varying ideas and interpretations during the consensus process.
8. If the first offer is determined to be technically acceptable, no further offers will receive a technical evaluation and the evaluations will proceed to paragraph 16 below.
9. Should the offer not be technically acceptable, paragraph 6 and 7 above will be repeated with the next-lowest offer until a technically acceptable offer is received.
10. If the SSA determines discussions should be held because none of the offers are technically acceptable, the SSEB will document weaknesses, deficiencies (and associated risks where applicable), and uncertainties identified for each Offeror on Evaluation Notices (ENs). Solicitation and proposal references must be cited. The ENs must be written to prompt the Offeror(s) to respond to the area in detail, but not lead them in their response. ENs are provided with the consensus forms.
11. If discussions are necessary, a competitive range must be established.
12. The PCO will notify all Offerors excluded from the competitive range and debrief as applicable.
13. Discussions will occur with all Offerors within the competitive range. Oral discussions are encouraged in order to establish a common understanding of the Government’s findings.
14. Close discussions and establish a date/time for receipt of final proposals. (Note that revised proposals, prior to final proposals, are permissible).
15. Once final proposals have been received, the evaluation process will follow the procedures outlined in paragraphs 2 through 9 above until an offer is found to be technically acceptable.
16. Contract award is made. Unsuccessful Offerors are notified and debriefed as applicable.
D. TECHNICAL EVAULATION CRITERIA
1. Factor 1 – Vendor Access Narrative
Factor 1 is a Go/No-Go factor and thus will receive a rating of either Go or No-Go.
The Vendor Access Narrative portion of an offeror’s proposal will be limited to five (5) pages in length. Any pages beyond five (5) will not be evaluated.
There are specific requirements to conduct business in the Eastern Syrian Security Area (ESSA) comprised of the North and East sections of Syria. Offerors must be on the Syrian Monitoring and Evaluation Committee’s approved vendor list in order to perform work within the ESSA.
2. Factor 2 – Technical Approach
The Offeror must clearly articulate a narrative demonstrating the Offeror’s understanding of the construction schedule’s logic and constraints, as well as the Offeror’s understanding of the Contract requirements. A schedule shall be provided with all the major construction phases.
Include at least the major construction activities and milestones identified.
Start no earlier than the Contract Award Date (for this purpose only, assume a contract award date of (30 September 2023).
Identify project duration (shown as Day 1) starting on the day that Notice-to-Proceed (NTP) is issued.
3. Factor 3 – Past Performance
Projects submitted for past performance should be submitted using the Past Performance Assessment Worksheet (Attachment 1). If the project does not have a Contractor’s Performance Assessment Reporting System (CAPRS) rating, the contractor shall submit a Past Performance Questionnaire (PPQ) (Attachment 2). If the Contractor submits a PPQ for a project that already has a CPARS rating, only the CPARS rating will be used. The Government will review all performance evaluation ratings and past performance questionnaires for projects submitted under Factor 3. The Government may contact provided points of contact listed on the Experience Information forms submitted under Factor 3.
A submission containing recent projects that meet at least one of the relevancy criteria will be determined acceptable.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.
E. COMMUNICATIONS AND SECURING SOURCE SELECTION MATERIALS
The PCO and the SSEB Chair will ensure information security including ensuring information integrity, confidentiality, and availability is maintained as described in FAR 2.101. Electronic source selection information shall be housed in an access controlled; password protected site. All source selection materials will be marked in accordance with FAR 2.101 (see definition of source selection information) and 3.104 and secured as prescribed by the PCO and SSEB Chair. Communications (internal and external) procedures and limitations (if any) will be provided by the PCO and SSEB Chair.
F. BEST VALUE DECISION.
The SSA will select the source whose proposal offers the lowest evaluated price and for which all non-price factors are rated as “acceptable” in accordance with the established criteria in the RFP.
G. ANNOUNCEMENT OF SELECTION.
The PCF will make the announcement of the selection of a successful offeror directly or through their designee.
H. DEBRIEFING OF UNSUCCESSFUL OFFERORS.
The PCO will conduct the debriefings in a manner appropriate to the acquisition in accordance with FAR 15.506(b).
