CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The contract shall be awarded on a best value basis using a tradeoff process. Evaluation factors are listed below:

1. Licensing: In order to be considered, the contractor shall be licensed by the Arkansas Elevator Safety Board, Arkansas Department of Labor, and shall provide documentation of this license. Any bid package that does not include proof of licensure will be considered a defective bid package and will not be considered.

2. Maintenance Control Program: As a part of the bid package, the contractor shall submit their proposed maintenance plan, including their proposed Maintenance Control Program (MCP), a schedule of routine maintenance, and the number of hours per month that they will be performing maintenance, excluding travel time. Upon award, the successful bidder’s maintenance proposal, including their MCP, shall become a part of the contract, and any proposed changes to the plan will require negotiation and issuance of a contract modification prior to implementation of the proposed change. The Maintenance Control Program (MCP) shall comply with all requirements of ASME A17.1 and ASME A17.3. The MCP shall specify examinations, tests, cleaning, lubrication, and adjustments to applicable components at regular intervals, and any other details specific to the proposed maintenance schedule. The MCP shall only include maintenance and inspection procedures applicable to the electric traction elevator located at Montgomery Point Lock and Dam. As part of the maintenance proposal, the contractor shall also submit the names and qualifications of proposed maintenance and repair personnel, including any resumes, certifications, licenses, etc. required to document qualifications. The successful bidder’s MCP shall become the property of the Government after the MCP is approved and implemented.

3. Special Certifications Qualifications of Personnel: In addition to, or incorporated into, the Maintenance Control Program, the contractor shall also submit the names and qualifications of proposed maintenance and repair personnel, including any resumes, certifications, licenses, etc. required to document qualifications. At a minimum, the contractor shall submit licenses and proof of qualifications for all specialized personnel that will be performing work on this contract as listed in paragraphs C.1.6.2.1.1 (Elevator Equipment Mechanic), C.1.6.2.1.2 (Elevator Equipment Mechanic Apprentice) and, C.1.6.2.1.3 (Elevator Controls Technician).

4. Price. The Government will perform a price analysis after completion of technical evaluation in accordance with FAR 13.106-2(b)(3) to determine which response represents the “best” as a whole. Comparative evaluation is the act of comparing two or more offers or proposal in response to the RFP. Proposals are evaluated by performing a direct comparison of each offer to one another in a uniform manner to determine which offer provides the best benefit to the government. The government has the discretion to accept other than the lowest priced offeror that provides additional benefit and/or lower performance risk. The combination of all technical (non-price) evaluation factors are approximately equal to price. As technical ratings and relative advantages and disadvantages become less distinct, differences in price between proposals are of increased importance in determining the most advantageous proposal.

Conversely, as differences in price become less distant, differences in rating and relative advantages and disadvantages between proposals are of increased importance to the determination.

Technical and past performance, when combined, are equal.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days (insert the period of time within which the Contracting Officer may exercise the option); provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

(End of clause)

52.252-1 SOLICITATION PROVISIONS INCORPORATED BY REFERENCE (FEB 1998)

Upon request, the Contracting Officer will make their full text available.
