52.219-4 NOTICE OF PRICE EVALUATION PREFERENCE FOR HUBZONE SMALL BUSINESS

CONCERNS (MAR 2020)

(a) Definition. See 13 CFR 126.103 for the definition of HUBZone.

(b) Evaluation preference.

(1) Offers will be evaluated by adding a factor of 10 percent to the price of all offers, except--

(i) Offers from HUBZone small business concerns that have not waived the evaluation preference; and

(ii) Otherwise successful offers from small business concerns.

(2) The factor of 10 percent shall be applied on a line item basis or to any group of items on which award may be made. Other evaluation factors described in the solicitation shall be applied before application of the factor.

(3) When the two highest rated offerors are a HUBZone small business concern and a large business, and the evaluated offer of the HUBZone small business concern is equal to the evaluated offer of the large business after considering the price evaluation preference, award will be made to the HUBZone small business concern.

(c) Waiver of evaluation preference. A HUBZone small business concern may elect to waive the evaluation preference, in which case the factor will be added to its offer for evaluation purposes. The agreements in paragraphs

(d) and (e) of this clause do not apply if the offeror has waived the evaluation preference.

___ Offeror elects to waive the evaluation preference.

(d) Limitations on subcontracting. The Contractor shall spend--

(1) For services (except construction), at least 50 percent of the cost of personnel for contract performance on its own employees or employees of other HUBZone small business concerns;

(2) For supplies (other than procurement from a nonmanufacturer of such supplies), at least 50 percent of the cost of manufacturing, excluding the cost of materials, on the concern or other HUBZone small business concerns;

(3) For general construction--

(i) At least 15 percent of the cost of contract performance to be incurred for personnel on its own employees;

(ii) At least 50 percent of the cost of the contract performance to be incurred for personnel on its own employees or on a combination of its own employees and employees of HUBZone small business concern subcontractors;

(iii) No more than 50 percent of the cost of contract performance to be incurred for personnel on concerns that are not HUBZone small business concerns; or

(4) For construction by special trade contractors--

(i) At least 25 percent of the cost of contract performance to be incurred on its own employees;

(ii) At least 50 percent of the cost of the contract performance to be incurred for personnel on its own employees or on a combination of its own employees and employees of HUBZone small business concern subcontractors;

(iii) No more than 50 percent of the cost of contract performance to be incurred for personnel on concerns that are not HUBZone small business concerns.

(e) A HUBZone joint venture agrees that the aggregate of the HUBZone small business concerns to the joint venture, not each concern separately, will perform the applicable percentage of work requirements.

(f) Notice. The HUBZone small business offeror acknowledges that a prospective HUBZone awardee must be a HUBZone small business concern at the time of award of this contract. The HUBZone offeror shall provide the Contracting Officer a copy of the notice required by 13 CFR 126.501 if material changes occur before contract award that could affect its HUBZone eligibility. If the apparently successful HUBZone offeror is not a HUBZone small business concern at the time of award of this contract, the Contracting Officer will proceed to award to the next otherwise successful HUBZone small business concern or other offeror.

VOLUME 1 - FACTOR 1: CORPORATE EXPERIENCE

Submission Requirements

The offeror shall submit a project portfolio with a minimum of 3 similar projects and maximum of five (5) similar projects (only 3 is required) that have been completed by the offeror (prime construction contractor) in the last five years or substantially complete (90%) with a construction cost with a minimum $10 million in magnitude. Similar work under this criterion consists of firm fixed-price contracts for similar government or commercial runway repairs involving in-ground DOD fuel pits for large frame aircraft; completed within 5 years.

If the offeror represents the combining of two or more companies, state if this project represents a joint venture effort for the listed parties. If more than five (5) projects are submitted, only the first five (5) projects will be evaluated. Data presented shall be limited to two pages per project described. Use the following format to provide project information:

a. Project Title, Contract Number and Location.

b. Project Contract Type (for example, Indefinite-Delivery, Indefinite-Quantity; Design-Bid-Build, Firm Fixed-Price, Cost Plus; Construction Manager at Risk, etc.)

c. Total Dollar Amount

d. Start and Completion Dates (Month/Year)

e. Role of Firm (address type of work performed, and percentage of work, as applicable) (also include any proposed team members that were directly involved in this project, including work performed, roles and responsibilities)

f. Brief Description of Project (address how this relates to this solicitation) Be sure to include:

i. Significant provisions taken to work in high security restricted areas by Offeror as a prime

Contractor or as a significant subcontractor.

ii. Please list the types of high security access and/or instances where you were permitted to work in high security restricted areas particularly for the Department of Defense.

iii. Examples of delays due to working in a high security area that your firm has experienced, and how you handled those delays effectively to keep the schedule and finish the work within the prescribed period of performance.

g. Customer Point of Contact (name, relationship to project, agency/firm affiliation, city, state, current phone number, and e-mail address)

h. Awards or recognition received, where applicable.

The offeror shall describe any previous teaming experience between current team members, if not described in the project list. The Government will evaluate the extent of recent, related experience of the prime contractor and team members as relevant to their role on this project. If Corporate Experience is provided for the teaming member, instead of the prime construction contractor, a letter of commitment is required for it to be acceptable.

Evaluation Criteria

The Government will evaluate the offeror’s Corporate Experience based on the below evaluation criteria:

To receive an Acceptable rating for this factor the offeror must demonstrate all of the minimum requirements:

1. Minimum of 3 and no more than 5 construction projects (design for construction is not acceptable);

2. Projects must include horizontal construction of airfield pavements;

3. Similar Project Locations – i.e. Military Installation (Base) or Commercial Runway;

4. Projects that demonstrate familiarity with applicable UFC and local conditions;

5. Minimum construction contract cost of $10M.

6. Completed or substantially completed (90%) within the last 5 years. If the project is not complete, offeror must provide a narrative and supporting information that clearly demonstrate at least 90% complete (i.e.

construction schedule, interim CPARS, etc.).

TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS

Rating Definition Acceptable Proposal meets minimum requirements of the solicitation.

Unacceptable Proposal does not meet the minimum requirements of the solicitation.

VOLUME 1 - FACTOR 2: KEY PERSONNEL

Unacceptable Proposal does not meet the minimum key personnel requirements of the solicitation.

VOLUME 1 - FACTOR 3: PAST PERFORMANCE

For each of the Factor 1 Projects, one or more completed Past Performance Questionnaires (PPQ) and/or final Contractor Performance Assessment Reporting System (CPARS), should be submitted with your proposal. Past performance for each Factor 1 project is required to be acceptable. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.

Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before the proposal closing date, the offeror may have the client provide the PPQ. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. At the client requests, questionnaires may be submitted directly to the Government’s point of contact, Joseph Weber at Joseph.Weber.7@us.af.mil. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Past performance information shall be obtained from any other sources available to the Government, to include, but not limited to, the CPARS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency.

To improve accuracy of database searches, the offeror will also provide the CAGE Codes for the prime contractor and all teaming partners, i.e. Joint Venture Partners, whose experience is relevant under Factor 1. The Government may contact and interview points of contact on the Past Performance Questionnaires. The Government reserves the right to interview other individuals acting for the listed references, if the listed reference is not available.

Offerors with no past performance information will not be rated favorably or unfavorably and will receive a neutral rating.

At no time during this process, nor during the debriefing, nor after award, will the names of the individuals providing additional reference information about an offeror’s past performance be revealed to the offerors or to any other party. If discussions are held, offerors may be afforded the opportunity to respond to adverse comments made by references in accordance with guidelines identified in FAR Part 15.3. In this case, comments will be extracted and provided to the offeror. Copies of the questionnaires will not be furnished to the offeror and will remain confidential.

Evaluation Procedures

PERFORMANCE CONFIDENCE ASSESSMENT

The past performance evaluation will result in an assessment of the offeror’s probability of successfully meeting the solicitation requirements. The past performance evaluation considers each offeror's demonstrated recent and relevant record of performance in supplying construction services that meet the contract requirements. One performance confidence assessment rating is assigned for each offeror after evaluating the offeror's recent past performance, focusing on performance that is relevant to the contract requirements. In reviewing each past performance effort by the offeror, the SST will first evaluate the relevancy and recency of the projects.

An offeror’s past performance effort will be considered recent and relevant if it meets the minimum requirements for Technical Factor 1, Corporate Experience. Each past performance effort will be assigned one of the levels of relevancy shown in Table 1:

Table 1: Past Performance Relevancy Ratings

Rating Definition Relevant Past performance effort involved essentially the same scope and magnitude of effort and complexities for the Corporate Experience factor.

Not Relevant Past performance effort involved little or none of the scope and magnitude of effort and complexities for the Corporate Experience factor.

For each past performance effort, the SST will then evaluate how well the contractor performed on the contracts (Quality of Performance). The past performance evaluation will not establish, create, or change the existing record and history of the offeror’s past performance on past contracts. The Overall Rating for the performance record must be above a Marginal Rating to be Acceptable.

In conducting the performance confidence assessment, the offeror shall be assigned one of the ratings in Table 2.

Table 2: Past Performance Evaluation Ratings

Past Performance Evaluation Ratings

Confidence/Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

No Confidence/Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

*Offerors without past performance will receive a rating of Neutral (i.e. Acceptable).

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to your contract

Rating will be neither positive nor negative.

VOLUME 2 - FACTOR 4: PRICE PROPOSAL

Offerors shall submit the Price Proposal consistent with the CLINS included in the solicitation (Price Proposal Schedule). The Price Proposal Schedule consists of the original signed Standard Form 1442 “Solicitation, Offer, and Award”; providing a price for all line items in the corresponding bid schedule; and acknowledgement of all amendments to the solicitation. Proposed prices must be entered for all items of the Price Proposal Schedule.

Evaluation Criteria

The Price Evaluation Team (PET) will perform the price evaluation. Price will not be rated or scored, but will be evaluated for fairness and reasonableness through the use of price analysis. The PET will evaluate the reasonableness of the price proposal using their expert judgment. The PET will also evaluate for unbalanced pricing. In the event, during the course of the analysis, the PET has reason to question the reasonableness of a price proposal, the PET may conduct such additional fair and reasonable analysis as it requires in order to complete a thorough price analysis. Because the evaluation of the price proposal will represent a portion of the total evaluation, it is possible that an offeror might not be selected because of an unreasonable price proposal. The price proposal will also be evaluated for completeness; all price information required by the RFP must be submitted.
