ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATIONOF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable No information or did not apply to your contract
Rating will be neither positive or negative.

PERFORMANCE WORK STATEMENT (PWS)
For
PARK and PROJECT AREA MOWING
SERVICES
At
Town Bluff Project
1. GENERAL: This is a non-personal services contract to provide Park and Project Area Mowing services. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1. Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, transportation, materials, supervision, and non-personal services necessary to perform Park and Project Area Mowing services as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property and services. The Contractor shall perform to the standards in this contract.
2. Scope: The Contractor shall provide all contract labor, equipment, vehicles, fuel, materials, supplies, supervision, quality control and non-personal services required to perform specified Park and Project Mowing services at Town Bluff Project (see Section 1.4). Contractor's work and responsibility shall include, but not be limited to, all job planning, programming, scheduling, administration, inspection, and management necessary to accomplish the required specified services. Contractor shall assure that all work is accomplished in accordance with the contract, all applicable laws, municipal codes, regulations and/or written directives issued by the Contracting Officer (KO).
3. Park and Project Area Mowing - The type of services to be performed include mowing and trimming grass, weeds, and tree/brush sprouts in parks, public and restricted use areas, and along access roads at the locations and as indicated by appropriate limits on the attached park maps. In developed recreation areas, unless indicated otherwise on the attached park maps, the mowing area will extend on both sides of the road to either the native tree line or to the water’s edge. Unless indicated otherwise on the attached park maps, mowing along access roads shall be performed over a distance of fifty (50) feet on each side of centerline; fifty (50) feet beyond limits of parking areas; fifty (50) feet beyond paved edge of boat ramps and boat ramp turnarounds, or to the tree line if it falls within the required fifty (50) foot distance. The required fifty (50) foot distance includes ditches, back slopes, riprap, and bluff areas, which shall be cut with power or hand tools. Unless otherwise indicated on the attached area maps, mowing and trimming will be performed to the water's edge.
1.3.1 Mowing and Trimming Requirements: Cut, trim, and mow grass to a height of not more than three (3) inches or less than one and one half (1 1/2) inches in Park and Project mowing areas. All mowing and trimming activities should result in a uniform cut, with smooth transitions between different mowing equipment areas.
Grass shall be mowed evenly throughout the mowing areas, maintaining the required height. All rocks, branches, grass, dirt, or other debris resulting from mowing or trimming operations must be removed from all developed surfaces, including but not limited to roads, sidewalks, impacts sites, picnic pads, etc. The Contractor will be required to trim around guard rails, traffic counters, trees, shrubs, culverts, all signs, guard posts, posts and cable, boat ramps, parking lots, curb stops, rip-rap, fences, and any other natural or manmade objects that protrude above the ground line to such a height as to prevent passage of the larger mowing equipment over them without damage to the equipment or the object. The Government reserves the right at any time to plant additional trees and/or shrubs in any park or area which will require trimming as described above at no additional cost to the Government. Trimming will be accomplished each time mowing is performed. The Government is not responsible for the condition of the mowing area (grass height, rocks, etc.) at the time the contract or task order becomes effective.
1.3.2 Mowing and Trimming Exclusion: The area immediately adjacent to the following park facilities (at Magnolia Ridge and Sandy Creek Parks only) is not included in this contract. Detail mowing and trimming is not required within fifteen (15) feet of bathroom and shower facilities, group picnic shelter slabs, trash containers, water supply buildings, picnic table slabs, fire rings, utility tables, drinking fountains, vehicle pullouts, RV pads, and water and electrical hookups located at each campsite. This fifteen (15) foot mowing and trimming exclusion applies only to Magnolia Ridge Park and Sandy Creek Park. It does not apply to the Bluff View Park, Campers Cove Park, East End Park, Headquarters, Structure Slope, or Spillway mowing areas.
4. Special Mowing and Trimming Requirements and Limitations:
1.4.1 Special Mowing and Trimming Requirements: Mowing with farm type tractor-mounted mowers will not be permitted within fifty (50) feet of any people, building, picnic/camping unit, camper hook-up, or under trees with low hanging limbs. Small riding mowers will be allowed to mow as close as necessary to all obstructions, provided said mowing does not cause any damage to public, private or Government property. If a camping/picnic unit is occupied by the public at the time of the scheduled mowing and trimming, the Contractor will inform the occupants of safety measures which need to be followed by the occupants to prevent any personal injury or damage to personal property. Any special equipment must be approved in writing by the Government Quality Assurance Representative (GQAR) prior to use and shall be used in accordance with manufacturers recommendations at all times.
1.4.2 Bulkhead Areas: No farm type tractors will be permitted within ten (10) feet of the shoreline bulkheads in Sandy Creek Park. Mowing and trimming within ten
(10) feet of bulkheads will be accomplished by small riding or push lawnmowers, or trimmers.
5. Task Orders: Mowings will be accomplished when directed in writing by the Contracting
Officer. This directive will be in the form of a task order authorizing the Contractor to mow any one or more of the designated areas. The task order shall also state the number and sequence in which the parks or areas are to be mowed and the time limitation allowed.
6. Mowing Frequency: The number and frequency of mowings required for each area will vary, due to environmental conditions and Project needs. No adjustment of the unit price will be made based on the number of actual mowings ordered. The Government is not responsible for the condition of the mowing area (grass height, etc.) at the time the contract or task order becomes effective. The government reserves the right to request mowings in selected areas if the growth of vegetation warrants. The estimated number of mowings for Park and Project areas is as shown on the bid sheets.
7. Mowing Sequence: The Government Quality Assurance Representative (GQAR) will furnish the Contractor a list showing the sequence in which each area is to be mowed. Completion of work and the government’s quality assurance inspection schedule will adhere to this sequence. Unless otherwise approved by the GQAR all mowing and trimming required in an area identified on the bid schedule, once started shall be completed before starting mowing in another area. In all cases the Contractor shall provide sufficient personnel and equipment to complete the work within the required time limitation.
8. Period of Performance: Period of performance will be determined as each task order is issued under this contract.
1.8.1 A complete mowing would include all items listed on the bid schedule. The time limitation for a complete mowing is twelve (12) days. Task orders containing one or more bid items, but less than a complete mowing will have a time limitation of from two (2) to twelve (12) days, as determined by the GQAR and specified in the task order.
1.8.2 All work will be started on the date specified in the task order. The starting and completion dates are critical in the performance of this contract. If work cannot be commenced on the starting date, the Contractor shall provide written notification to the GQAR and submit a revised schedule for GQAR approval.
Delays in service requiring an extension to the completion date due to inclement weather or conditions beyond the Contractor's control may only be allowed with the approval of the Contracting Officer Representative (COR). If the Contractor does not complete the required mowing within the time specified on the task order, without prior approval, deductions may occur and/or the contract may be terminated.
1.8.3 The services provided under this contract shall be independent of all services provided under other contracts at this project or any other project, at which the Contractor may receive award.
9. Damage Responsibility: The Contractor shall be responsible for restoring any Government facilities or structures damaged as a result of performance. The Contractor shall survey the park or area and submit a report of all damage or vandalism to the Government Quality Assurance Representative (GQAR) prior to commencement of mowing or cleaning in each area. Any damage found thereafter by the Government's inspector that has not been previously reported by the Contractor shall be assumed to be damage caused by the Contractor's operation, and shall be repaired, replaced, or deducted from the invoice, as determined by the GQAR at no cost to the government. The Contractor shall also be responsible for any damage to private property and injury to any person as a result of performance. The Contractor will notify the Contracting Officer (KO) immediately of damage to Government and private property and injury to any person resulting from performance of work. Mowers must have slides or wheels, which will prevent tearing or plowing into the turf.
Mowing with farm-type tractors will not be permitted when the ground is so wet or boggy that the mowing operations will cause wheel rutting.
