About this file

This is an Emergency Purchase Statement from the State of Illinois, Chief Procurement Office for General Services, involving the Department of Innovation and Technology (DoIT) and the vendor DataBank Holdings LTD. The emergency procurement (BidBuy Reference #B-54506) concerns the leasing of additional data center space and associated services to support the State's Alternate Data Center (ADC) operations. The ADC has reached maximum capacity and requires expansion to maintain disaster recovery capabilities and system failover functionality for critical applications across multiple state agencies, including the Department of Human Affairs (HDA) and the State Employees' Retirement System (SERS). The contract was awarded on the earliest date when the State agency communicated to the vendor to start work, as indicated by the vendor communication being selected as the award date trigger. No specific response deadline, site visit, or bidder's conference information is provided in the document.

The estimated expenditure for this emergency purchase is $2,876,280 in State Appropriated Funds, classified as an estimated amount subject to final cost reporting within ten days of the succeeding month. The emergency was justified under the "quick purchase" provision of Section 20-30(d) of the Illinois Procurement Code, citing both discounted pricing availability for a limited time and the competitive market conditions for data center space. DataBank Holdings was selected as the sole vendor because the State's existing data center is currently located at the company's facility and cannot be split or relocated without substantial cost ($8.2 million estimated) and 2-3 years of planning. An existing contract with DataBank Holdings (formerly zColo) was in place; however, expanding capacity through a formal sole source change order would require a minimum of three weeks, during which the available space would likely be leased by commercial competitors. The agency determined that no portion of this emergency purchase could be subcontracted to Business Enterprise Program (BEP)-certified vendors due to the proprietary nature of the data center infrastructure and security restrictions.

Emergency Purchase Details BidBuy Reference #: B- 54506

Emergency Condition (select the appropriate option from the drop-down menu below):

Quick purchase as provided by Section 20-30(d) of the Illinois Procurement Code

Protecting the health and safety of any person

Items are available on the spot market or at a discounted price for a limited time so that good business judgment mandates a "quick purchase" immediately to take advantage of the availability and price

Rare items, such as items of historical value or art collections, are available for a limited time

The opportunity to obtain entertainment, speakers and athletic and other events or performances (not exempt under Section 1-13 of the Code) is available for a limited time.

Immediate action is necessary to avoid lapsing or loss of federal or donated funds

Provide a description and reasons for needing this emergency purchase:

The Alternate Data Center (ADC) has reached its maximum capacity and no longer has adequate space to support required disaster‑recovery operations. DoIT must maintain a fully functional ADC to ensure continuity of services in the event of a system failure, major outage, or catastrophic geographical incident. If the primary data center becomes unavailable, the ADC provides the necessary failover capability to prevent data loss and minimize downtime. Because the existing ADC cannot be shut down without jeopardizing critical systems, relocating it would require extensive planning, significant expense, and simultaneous operation of the current site during the transition. As a result, the only feasible and immediate option is to lease additional capacity at the turnkey data center. This emergency purchase is therefore necessary to maintain operational resilience and ensure uninterrupted disaster‑recovery readiness.

Provide the conditions and circumstances that led to the need for this emergency purchase:

Space and capacity at the State’s current data center are extremely limited and highly competitive. DoIT has repeatedly missed opportunities to secure the additional capacity required because available space is often acquired quickly by commercial entities before the State can complete the standard procurement process. The Alternate Data Center (ADC) is now at a critical capacity level, and a suitable additional space has become available. However, due to market competition, the State must act immediately to secure this space before it is leased by a commercial entity. This urgency creates the need for an emergency quick purchase.

Reason for selection of this particular vendor:

The State's current data center is at this location. The Data Center can not be split so this is the only viable vendor.

Description of supplies or services to be provided:

The contract will be with DataBank Holdings (formerly zColo) for leased data‑center space and associated services that support the State’s Alternate Data Center (ADC). This leased space is essential for maintaining system failover capabilities in the event of a major outage. DoIT must maintain a fully functional ADC to provide redundancy for critical applications across multiple agencies. DoIT, as well as other agencies such as HDA and SERS, currently house their ADC environments under an existing contract with zColo (now DataBank Holdings). It is standard disaster‑recovery practice to air‑gap and duplicate critical systems to ensure continuity of operations if one or more systems fail. In the event of a system failure, the ADC functions as the backup environment containing duplicate operational systems and data, preventing data loss and minimizing downtime. Failover

Division: Data Center OperatonsAgency: Department of Innovation and Technology capability ensures little to no server interruption during emergencies and protects against major outages or data loss. This redundancy is essential for maintaining continuous State operations and safeguarding critical information. At this time, DoIT does not have sufficient capacity to fail over all critical applications. The additional leased space and capacity at DataBank is required to meet these operational and disaster‑recovery needs.

Emergency procurements shall be made with as much competition as is practicable under the circumstances, and agencies shall utilize best efforts to include contractors certified under the Business Enterprise Program in its emergency procurement process. 30 ILCS 500/20-30(a).

Describe the actions taken by the agency to make the emergency purchase with as much competition as is practicable under the circumstances:

The data center cannot be moved without considerable time and costs. Its estimated it would take 2 -3 years to secure a solution and conduct a move at a cost of $8.2M or more in sunken cost in addition to the on-going operating cost which is anticipated to be higher than housing the ADC at a co-location site like Databank.

The estimated move cost to a new leased space is $8.2M which includes:

$3.5M to stand up the network infrastructure in the new ADC $3M to extend fiber to the new location $1M to hire vendors to move and re-certify the equipment at new location $750K contingency

List the actions taken by the agency that constitute its best efforts to include contractors certified under the Business Enterprise Program in this emergency purchase:

The agency evaluated whether any portion of this emergency purchase could be subcontracted to a vendor certified under the State of Illinois Business Enterprise Program (BEP). However, the data‑center space and associated power infrastructure are proprietary to the selected vendor, and the required capacity is available only through this specific facility. Because this purchase involves leasing physical space, power, and environmental controls at a single provider‑owned location, no part of the scope can be reasonably separated or subcontracted to a BEP‑certified firm. Despite these constraints, the agency reviewed the nature of the services to determine whether any ancillary work, such as installation, support, or maintenance—could be directed to BEP vendors. These activities are also controlled exclusively by the data‑center operator due to security, compliance, and facility‑access restrictions. As a result, there are no viable opportunities for BEP subcontracting within this emergency procurement. The agency remains committed to BEP participation and will continue to seek opportunities for BEP‑certified businesses in future procurements where subcontracting or competitive sourcing is feasible.

Is there an active State contract available for the required supplies or services? Yes No

If Yes is checked above, explain why the existing contract does not meet the need:

This addition would require a formal sole source change order to he current contract which would take at the minimum 3 weeks. The space would be taken by a commercial vendor before this could be completed.

This emergency contract was awarded on the earliest of these dates: (choose one) the State agency communicated to the vendor to start work
