About this file
This Emergency Purchase Statement documents an emergency procurement executed by the Illinois Department of Corrections, Division of Fiscal Services - Procurement, on September 25, 2026. The State of Illinois is procuring weekly shipments of sliced white bread for distribution to individuals in custody at all IDOC facilities on an emergency basis. The contract was awarded to M.J. Kellner Co., Inc., located in Springfield, Illinois, following the termination of the previous bread contract due to ongoing performance issues with the contracted vendor. The emergency procurement was necessary to prevent disruption of statewide meal services and ensure that individuals in custody receive adequate caloric intake as mandated by IDOC. The emergency contract will remain in effect until a new competitively procured bread contract is established through standard procurement procedures.
The total estimated expenditure for this emergency contract is $854,896.80, funded through State Appropriated Funds. To maximize competition under emergency circumstances, IDOC contacted four vendors that had submitted bids on the most recent Invitation for Bids (26-426DOC-ILRIV-B-49804) and selected M.J. Kellner Co., Inc. based on the lowest price and ability to provide immediate delivery. The selected vendor has agreed to maintain the same 14% Business Enterprise Program (BEP) participation goal established in the previous competitive procurement and as outlined in their previously submitted BEP U-Plan. No active State contract was available to meet the immediate need. An Emergency Final Cost form will be submitted by the State agency and published by the State Purchasing Officer no later than the tenth day of the succeeding month to document actual costs incurred.

Provide a description and reasons for needing this emergency purchase:
IDOC issued a previous solicitation for a Bread Contract under Bid #26-426DOC-ILRIV-B-49804 and a contract issued under Purchase Order 26-426DOC-ILRIV-P-90853. Due to ongoing performance issues with the contracted vendor, the contract has been terminated. Provide the conditions and circumstances that led to the need for this emergency purchase:
IDOC is mandated to provide required specific caloric intake for Individuals in custody of which bread is a key component. Without reliable and consistent weekly deliveries of bread, the dietary needs of the individuals in custody cannot be adequately met. Due to the unreliability of the contracted vendor, a new source for bread shipments is required.
