About this file
This document is a Questions and Answers (Q&A) file issued by the Illinois Department of Central Management Services (CMS) for the JPMC Collection Cups Random Drug Testing solicitation (Bid Number 25-416CMS-BOSS4-B-47180). The document provides detailed responses to 18 vendor questions regarding a joint purchase master contract for drug testing collection cups, covering technical specifications, testing requirements, delivery terms, and bidding instructions. Key clarifications include maintaining 18-month shelf life, requiring 510(k) FDA clearance, mandating specific drug panel configurations, and confirming that the current contract expires on 12/25/25.
The Q&A document reveals important procurement details, such as the contract being available to all governmental units and qualified not-for-profit agencies in Illinois, with no guaranteed order quantities. Vendors are advised that line-item quantities in BidBuy are for evaluation purposes only, and pricing must include all costs with F.O.B. destination shipping. The state will not consider alternative specifications for drug testing cup requirements, including cutoff levels, Sustiva studies, and shelf-life duration. Notably, the CLIA-waived labeling requirement has been removed in an updated version of the vendor instructions, simplifying the compliance process for potential bidders.

Questions and Answers #1
Date: 06/13/2025
Q1 I am considering putting in a bid for the above solicitation, and I want to verify if an 18-panel would be okay, so long as it has all the requested drugs.
A1 BidBuy line-item descriptions indicate a minimum panel for each of the collection cups. Your product should meet at least these minimum requirements. Per Section B.2.4 of the Vendor Instructions and Requirements, the State will determine whether the Bid meets the stated requirements.
Q2 In Vendor Instruction B.2.11, Vendor should submit that there is no interference of the urine by reagent system. Could you elaborate on that?
A2 The Bidder must provide test results indicating that the urine collection system
(chemicals/reagents, etc.) do not interfere with GC-MS testing. Essentially, we must have documentation that the product bid is compatible with GC-MS testing.
Q3 Who is the incumbent vendor?

Q6 What is the estimated annual volume per agency/location? Or historical order volume by location?
A6 Since the resulting contract may be utilized by all governmental units and qualified not-for-profit agencies in the State of Illinois, we are unable to provide any estimated volumes or a potential list of locations., Per Section 1.5.5 of the Contract, there is no guarantee of quantities for actual orders or usage.
Q7 Contract document, Scope of Work, Supplies and/or Services Required, Section 1.2.6, would CMS consider alternate cutoff levels?
A7 No, drug testing cups must meet all initial test cut-off levels as indicated in Section 1.2.6 of the
Contract.

Q8 Contract document, Scope of Work, Transportation and Delivery, Section 1.5.1, can CMS confirm if this means that minimum orders of $250 should have freight are included in the device price?
And less than $250 must have freight itemized.
A8 Per Section B.3.2 of the Vendor Instructions and Requirements and Section 2.2.1 of the
Contract, pricing must include all costs shipped F.O.B. destination and may not include any additional costs due to taxes (federal or otherwise) unless accompanied by proof the State is subject to the tax. Per Section 1.5.1 of the Contract, the minimum order is $250 for F.O.B.
Destination. For any order less than the minimum of $250, the Vendor may charge additional delivery fees, but the additional charge must be added to the invoice as a separate line item and a copy of the freight bill will be submitted with the invoice for payment.
Q9 We noticed the last award had a last possible expiration of 2030, is there a reason the State is going out to bid early?
A9 The expiration date of the current contract is 12/25/25.
Q10 Are the line-item quantities in BidBuy reflective of historical purchasing information about the volume of drug testing cups? Are these indicatives of anticipated annual volumes or multiple year/full contract volumes?
A10 Per Section B.3.1 of the Vendor Instructions and Requirements, the quantities indicated under the Items Tab in BidBuy are for evaluation purposes only and are no guarantee of actual usage or future orders.
Q11 Please verify that a Utilization Plan is not required for this IFB.
A11 Bidders are not required to submit a Utilization Plan for this solicitation.
Q12 When vendors submit a copy of the "Contract" document, do they need to have page 19 signed, or is this to be signed by the vendor only after award and contract negotiation?
A12 Bidders should submit, along with other required documents, a signed and dated copy of the contract in BidBuy prior to the bid opening date.
Q13 In the "Offer to the State" we see the ability to make redlines to the Standard Terms & Conditions. May vendors also request redlines to the Contract document in the same fashion?
A13 A bidder may submit a redline version of the contract for items outside of specification requirements. See Section C.10 of the IFB Vendor Instructions for any protest to specifications.
Q14 Can the state verify that all purchases would be billed to the Bureau of Strategic Sourcing address showing on the BidBuy page as indicated in section C.9 of the Instructions, but shipped to individual state agencies? Or would bill-to addresses also vary depending on the agency ordering devices?
A14 This joint purchase master contract may be utilized by all governmental units and qualified not-for-profit agencies. All deliveries and invoicing will be direct to the governmental unit or qualified no-for-profit agency that places the order. No delivery or invoicing will be to the Bureau of Strategic Sourcing.
Q15 We provide drug testing cup devices to state agencies across the country and have not seen a requirement for Sustiva studies--which we understand is typically related to the potential cross reaction of HIV medications with the THC test strip--on any other bids other than from the State of Illinois. Is this possibly an outdated specification? Would the State consider cups that do not have these studies, and instead use other methods to determine possible cross-reaction, such as a THC laboratory confirmation test if cross-reaction is suspected?
If not, would you consider providing vendors with more time to provide this type of study, as it seems unlikely vendors will have these studies from within the past 6 months?
A15 The State will not consider cups that do not have this type of study conducted as it is a requirement of this solicitation.
Q16 The required cup configurations contain drug tests that, to our knowledge, are not currently available in an FDA 510k cleared test device. Are these intended for a forensic setting, such as compliance monitoring at a department of corrections facility? If so, would the State allow for devices labeled as "forensic use only" for these line items instead of 510k cleared devices?
A16 The State requires that the collection cup have 510k clearance. However, if you believe that the required cup configures are not currently available in a FDA 510k clearance, please provide documentation substantiating that claim. Pursuant to B.2.4 of the Vendor Instructions, The State will determine whether the Bid meets the stated requirements.
Q17 Most standard guaranteed shelf-life specifications are for 12 months. Would the State allow for this one-year shelf life instead of 18-months?
A17 Per Section 1.2.10 of the contract, the “test shall have a minimum 18-month shelf life from date of delivery to the ordering entity when stored at the following temperature range: 38°- 85°F/2°-30°C. If an 18-month shelf life is unavailable, then the vendor must contact the ordering entity for approval of available option before delivery”.
Q18 Can the State please explain why CLIA-waived labeling is required on these devices? Will they be used in clinics/facilities with laboratories that have active CLIA-waived licenses?
A18 B.2.10 of the Vendor Instructions will be changed to remove the CLIA waiver requirement. See
Updated Vendor Instructions dated June 13, 2025.
B.2.10 Currently Reads:
B.2.10 Device must have 510 (k) clearance and per Clinical Laboratory Improvement Amendments (CLIA) regulations be CLIA - waived.
