PERFORMANCE WORK STATEMENT

Joint Base McGuire-Dix-Lakehurst Open House WARBIRD – B-29 Superfortress 17-18 May 2025

1. DESCRIPTION OF SERVICE: GENERAL REQUIREMENTS

1.1. Scope of Work. The Contractor shall provide all personnel, equipment, tools, materials, supervision and other items and service to provide a demonstration aircraft. The Contractor shall perform to the standards in this Performance Work Statement (PWS).

1.2. Contractor. The Contractor shall provide a B-29 Superfortress as a static display at Joint Base McGuire-Dix-Lakehurst Open House 2025, hereafter referred to as JB MDL Open House 2025, within the limitations prescribed by Federal Aviation Regulation Waiver (FAA Form 7711-1), on 16-18 May 2025 (3 total performances, 1 per day) provided weather, mechanical and site condition permit. Please reference Attachment 6 of AFI 10-1004 for list of Approved Warbird Status Aircraft.

1.3. Performance. The Contractor shall display the aircraft each day of 16-18 May 2025.

1.4. Static Display Requirements. The Contractor shall make their aircraft available for static display for the duration of that day’s open house. If requested the Aircraft will be protected behind a crowd control barrier, provided by JB MDL, at all times for safety purposes. 1.5. Compensation. The Government hereby agrees to compensate the Contractor at the rate specified. This agreement is in full force rain or shine. If the Contractor is physically unable to display the aircraft, has an equipment failure, or cannot display the aircraft for any reason, other than stated above, the Contractor will be paid on a graduated rate, up to full payment, for services actually rendered as reasonably determined by the Contracting Officer.

1.5.1. Deposits. Advance payment is not authorized, nor will the Government pay a deposit under this contract. Payment shall be made in one lump sum within 30 days of receipt of invoice and material inspection and receiving report.

1.5.2. Donation. Based on Air Force Policy, the Contractor shall not solicit donations as additional compensation from the public on an Air force Installation unless the contractor is a legitimate “Warbird” 501c3 Organization. Air Force shows are free to the public and charge no admission. The Contractor may not display, or present signage or person charge for an admission fee in any way, shape, or form to tour an aircraft or display. However unsolicited donations are permissible as long as no signage or person block or interfere entry by the public and, displayed as “donation” with no set fee or cost. See AFMAN 10-1004 for further guidance.

1.5.3. Merchandise Sale Requirements. The Contractor may sell items in conjunction with their static display provided items for sale are specifically related to the aircraft at JB MDL Open House 2025. No item for sale may imply DoD or Military Branch endorsement. The Contractor is required to obtain written approval from the Master Concessionaire Contractor prior to selling any merchandise.

1.6. Air Show. The JB MDL Open House 2025 is a two-day event and shall start on 17 May 2025 and continue through 18 May 2025. Services are required for rehearsals/Family Day on 16 May 2025, and a full set of airshow routines on 16-18 May 2025. Operating Hours are at the discretion of the JB MDL Open House 2025 Director. The Contractor should arrive no earlier than 1200 EDT 14 May and no later than 1600 EDT 15 May and may depart any time after the event ends at 1700L EDT 18 May but no later than 1000L EDT 19 May. Should the contractor have issues and unable to arrive within the allotted window the contractor should contact the JB MDL Power in the Pines Air Operations Officer to see if a late arrival is available. In the event a late arrival is approved the Contractor will be paid on a graduated rate, up to full payment, for services actually rendered as reasonably determined by the Contracting Officer. As it stands now it’s a larger aircraft so we would prefer they arrive earlier than later so smaller aircraft can move around them and not vice versa. I’ve changed the timeframes to be more specific. 1.7. Contractors Liability Insurance. The Contractor declares that they will maintain personal liability insurance limits of one million dollars ($1,000,000.00) per aircraft/occurrence for bodily injury or property damage. Civil Aircraft Certificate of Insurance (DD Form 2400) to provide evidence of the above coverage will be provided upon request and before filing FAA waivers prior to commencement of performance under this agreement. Civil Landing Permit (DD Form 2401) and Civil Aircraft hold Harmless Agreement (DD Form 2402) will also be required at that time. Period of performance will be 16-18 May 2025.

2. GOVERNMENT FURNISHED PROPERTY/SERVICES

2.1. Lodging. The Contractor shall not include a fee for lodging. The Government will provide single-occupancy, non-smoking rooms for Contractor personnel from 15 May to 19 May 2025. The Contractor will submit the number of rooms required in their official quote. Contractor, and all individuals/Sub-Contractors assisting the Contractor in the execution of this PWS and/or accompanying the Contractor under the terms of this PWS, will be responsible for paying all sundry items consumed. A credit card for each room provided will be required upon check-in to cover any sundry items.

2.2. Food/Refreshments. Per AFMAN 10-1004, lunch and refreshments will be provided by the Government on 17-18 May 2025, during Operating Hours, to allow warbird operators to remain at their displays.

2.3. Transportation. The Contractor will not include a fee for ground transportation. If required, JB MDL will provide a reasonable number of vehicles, fully insured during the hours of the JB MDL Open House 2025. Contractor shall include vehicle request (quantity and type) within their quote.

2.4. Fuel/Oil. The Contractor will not include a fee for fuel or engine oil. At the time of proposal, the Contractor will provide an accurate estimate of fuel, engine oil, and smoke oil (if required). Type and quantity (in gallons or quarts) of engine oil shall be noted in the quotation. The Government will provide aviation fuel and oil for the Contractor’s aircraft during the course of the JB MDL Open House 2025. The Contractor may be required to make an enroute stop, daily stop, and departure stop to receive the aviation fuel and engine oil at a local source contracted by the Government. Any effort by the Contractor to obtain fuel and oil from any other source than contracted by the Government will be at the Contractor’s own expense. The Contractor will submit the maximum amount of fuel/oil required at JB MDL to fulfill this PWS in their quote.

2.5. Aircraft Support Equipment. The Contractor will provide all wheel chocks, tie downs, grounding cables and specialized tow bars required for operations and servicing, except those previously coordinated, for the duration of the Open House.

2.6. Hanger Space. The Government will provide hanger space, as required, on a non-interference basis, free of charge. Space is limited. Contractor aircraft needing hanger space for parking will coordinate with the Government for hanger space. Aerial performers have priority over static displays for hanger space. Every effort will be made to house the Contractor aircraft in a fully enclosed and secure hanger after air show hours if the contractor so desires. Aircraft security on the parking ramp will be provided during all hour’s day and night for the duration of the event. Crowd control will be provided by the government such that the show aircraft is protected from spectators at all times while at the show site.

3. ADDITIONAL INFORMATION

3.1. Mileage. Mileage will be included in the contract price.

3.2. Government Contractor. The Contractor and his/her employees will perform services under this contract in accordance with the terms and conditions of this contract including the PWS as a contractor and not as a government agent or employee or joint venture. The contractor and employees are employed to render professional aviation service only, and any payment made by the Government, are compensation solely for such services rendered.

3.3. Security Requirements. All Contractor Personnel employed by the Contractor in performance of this contract, or any representative of the Contractor entering the Government installation, shall abide by all security regulations of the installation. The Contractor shall sign an agreement stipulating the security requirements of this contract.

3.3.1. Base Access. The Contractor shall obtain personal identification passes for all Contractor Personnel and vehicle passes for all Contractor Personnel’s personal vehicles, to include prospective Contractor Personnel, requiring entry onto JB MDL. Additionally, the Contractor shall keep current, for Government inspection, a list of the names of Contractor Personnel employed on this contract. Vehicle registration, proof of insurance, and a valid driver’s license must be presented for all vehicles to be registered.
