About this file

This document is a tax notice issued by the State of South Carolina regarding withholding requirements for nonresident contractors. The notice applies to all governmental entities in South Carolina that execute contracts with nonresidents conducting business or performing services within the state. The primary requirement, governed by Section 12-8-550 of the South Carolina Code of Laws, mandates that contracting entities withhold 2% of each payment made to nonresidents, with specific exemptions available for purchases of tangible personal property without accompanying services, nonresidents not conducting business in South Carolina, contracts valued under $10,000 annually, and nonresidents who register with the South Carolina Department of Revenue or Secretary of State and submit Form I-312 (Nonresident Taxpayer Registration Affidavit - Income Tax Withholding). Once submitted to a Using Entity, the affidavit remains valid for all subsequent contracts between that nonresident and entity unless the Department of Revenue revokes the exemption.

An additional withholding requirement under Section 12-8-540 applies to rental or royalty payments of $1,200 or more annually, requiring entities to withhold 7% for nonresident individuals and 5% for nonresident corporations. Nonresidents should submit a separate copy of Form I-312 to each governmental entity making payments under this solicitation. The South Carolina Department of Revenue administers all tax withholding matters and can be contacted at 1-844-898-8542 or through its website at dor.sc.gov for registration, withholding exemptions, and other applicable exceptions. The agency issuing this notice does not administer tax compliance and directs all related inquiries to the Department of Revenue.
