2.10 Munitions and Explosives of Concern (MEC)
The contractor shall provide all personnel, MEC detection specialized equipment, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform MEC
PM and MEC QA services as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
2.10.1 Background
DoD Directive 6055.09E (2016) defines “Explosives Safety Management,” and requires DoD
Components to implement and maintain an effective explosives safety management program. The
DoD protects people and property from the effects of military munitions (including MEC), to execute the mission safely and effectively by exposing the minimum number of people required.
Furthermore, the Directive provides explosives safety management principles and requirements that provide for immediate protection of people and property while ensuring that DoD Components are complying with applicable environmental regulations. (Later replaced in 2019 by DESR 6055.09 and later adapted for AF use through AFMAN 91-201 in 2021).
2.10.2 Objectives
The contractor will provide individuals to perform independently of direct Government supervision support services to satisfy the overall operational objectives of the 36th Civil Engineer Squadron
(CES) and the subordinate Engineering Flight Chief (CEN/CC). The primary objective is to provide contractor services and deliverables through the performance of Munitions and Explosives of
Concern (MEC) Quality Assurance (QA) Services.
The individuals shall provide all labor, material, and equipment necessary to complete the work described in the paragraphs below. Specifically, the MEC QA Services individuals shall be available full time unless revised via task order and shall perform tasks as defined generally below and as particularly set out in this Performance Work Statement (PWS). The contracted individuals will each serve as the technical advisors and SMEs to the 36th CES/CEN and other teams of
Andersen AFB, in all aspects of UXO related operations to include (but not be limited to) MEC clearance operations in support of or in addition to the government MEC QA Specialist.
Responsibilities will include the execution of the Quality Assurance Program for unexploded ordnance (UXO) related operations in support of Andersen AFB, Guam properties. Specific individuals will focus on Project Management (PM) during the planning phase of a project, e.g.
creating MEC annexes. Other individuals will focus on Quality Assurance (QA) during the execution of a project, e.g. inspecting during a project’s MEC work plan.
The MEC personnel have no authority to direct the construction contractor(s) in any way regarding methods and/or procedures and shall not interfere with methods of performance unless life and/or property are endangered. The 36th CES/CEN Flight Chief or its designated Government representative shall be responsible for, and will sign, all correspondence and specific directives to contractors.
SECTION III
3.0 CONTRACTOR PERFORMANCE
3.1 Contractor’s Quality Control Program
The contractor shall establish, implement, and maintain a quality control program that is proactive and responsive to the Government’s needs that ensures compliance with all requirements IAW FAR part 46, Quality Assurance. The contractor shall submit a Quality
Control Plan (QCP) that contains, as a minimum, the items listed below and is updated with each task order that is awarded. The QCP shall be submitted to the COR no later than fourteen
(14) calendar days after contract / task order award. The Government will notify the contractor of acceptance or required modifications to the plan. The QCP shall include the following minimum requirements:
(a) A description of the inspection system to cover all major services and deliverables. The description shall include specifics as to the areas to be inspected on both a scheduled and unscheduled basis, frequency of inspections, and the job title of the inspectors. Contractor inspectors must be cleared at the appropriate classification level.
(b) A description of the methods to be used for identifying and preventing defects in the products delivered and the quality of service performed.
(c) A description of the records to be kept to document inspections and corrective or preventative actions taken. All records of inspections performed shall be retained and made available to the
Government upon request throughout the contract performance period, and for the period after contract completion, until final settlement of any claims under this contract. (CDRL A001)
3.2 Quality Assurance
The Government will evaluate the contractor’s performance of this contract using the contractor’s approved QCP, the Government’s Quality Assurance Surveillance Plan (QASP), and the PWS requirements of this contract. The Government reserves the right to inspect any service or deliverable in accordance with the inspection clauses applicable in this contract.
Government surveillance of tasks not listed in the Services Summary (SS) or by methods other than those listed in the SS (such as provided in the inspection clauses) may occur during the performance period of this contract. For those tasks listed in the SS, the COR or other designated evaluator will follow the method of surveillance specified in this contract (e.g., periodic surveillance, 100% inspection). Government personnel will record all surveillance observations.
When an observation indicates defective performance, the COR or other designated evaluator will require the contractor manager or representative at the site to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation. It acknowledges that the contractor has been made aware of the non-compliance. Any action taken by the Contracting Officer (CO) as a result of surveillance will be according to the terms of the contract.
3.3 Government Inspection
Contractor performance is subject to surveillance by the COR to ensure compliance with the task order to include all elements of the Service Summary.
The task order identifies two types of non-conformances: minor and major. All records of non-conformance and corrective actions will be documented in Corrective Action Reports (CAR), Quarterly Surveillance Reports and Contract Performance Assessment Report (CPAR).
3.3.1 Non-Conformances
The Contractor shall identify and control non-conformances through root cause analysis, corrective actions, and preventive actions. The Contractor shall focus on proactive identification and transparency of issues, and on eliminating the cause to prevent recurrences. The Contractor shall maintain records of non-conformities and actions taken. The Contractor shall correct and provide response to all Government-identified non- conformances IAW timeframes specified by the CO.
3.3.2 Minor Non-Conformance
A minor non-conformance is a non-conformance, which by itself does not adversely impact the overall Directorate mission, safety of personnel and/or equipment, performance (quality), schedule (delivery), or cost. Minor non-conformances are typically low risk and may be communicated through a CAR form with the minor box checked.
Minor CARs are normally issued for any identified non-conformances. Second notice minor
CARs are normally issued for repeat non-conformances or failing to correct issues within a reasonable amount of time or non-conformances that increase risk to one specific technical element or program. Upon receipt of a minor CAR addressing minor non-conformance, the
Contractor shall complete applicable sections and return it to the CO within the time specified in the notice. A formal corrective action plan is not required for minor CARs. Minor non-conformances shall be documented in order to be used in support of a Quarterly Surveillance
Report or CPAR rating.
3.3.3 Major Non-Conformance
A major non-conformance is a non-conformance that adversely impacts (or has the potential to impact) mission, safety of personnel and/or equipment, performance (quality), schedule
(delivery), or cost. This type of non-conformance increases risk to the Government and therefore has a risk assessment rating of moderate or high. For example, a CO may find that a situation of increasing risk exists where there are a significant number of recurring minor non-conformances creating an indication of inadequate preventive measures/actions which lowers the Government’s confidence that the Contractor can provide quality services on time and within cost.
The CO will communicate major non-conformances…
