Performance Work Statement Lagoon Pumping
PERFORMANCE WORK STATEMENT (PWS)
FOR
SEWAGE LAGOON PUMPING SERVICES AT MISSILE ALERT
FACILITIES
23 February 2024
341st Civil Engineering Squadron (341 CES)
Malmstrom AFB, MT
1. DESCRIPTION OF SERVICES
The Contractor shall provide all equipment, tools, materials, transportation, personnel, labor, supervision, and management necessary to perform Sewage Lagoon Pumping services at the 15 Missile Alert Facilities (MAF) assigned to Malmstrom Air Force Base (MAFB), MT. Any reference to MAFB in this document includes the 15 MAFs assigned to MAFB, which are dispersed throughout central Montana (see Appendix 2, MAF Lagoons Location Map).
1.1 UTILITIES
1.1.1. All reasonable quantities of utilities will be made available from existing utilities to the Contractor without charge. Any temporary connection or lines that may be required will be installed, maintained, and removed by the Contractor at his own expense and in such a manner satisfactory to the Contracting Officer.
Removal of such connections or lines will be accomplished prior to final acceptance of the construction.
The Contractor shall provide any necessary portable power.
1.1.2. No restroom facilities will be available for Contractor use at the missile sites. It is the responsibility of the Contractor to provide a portable latrine (Porta-Potty) at each work location for the duration of work if restroom facilities are needed.
1.2 SAFETY
1.2.1. The Contractor shall comply with all existing standards by the Occupational Safety and Health Act (OSHA), Malmstrom AFB Fire Protection Program, Air Force Occupational Safety, and the Fire Prevention and Health Program, at all times in the performance of this contract.
1.2.2. Compliance with OSHA and other applicable laws and regulations for the protection of Contractor employees is exclusively the obligation of the Contractor, and the Government will assume no liability or responsibility for the Contractor’s compliance or non-compliance with such responsibilities.
1.2.3. Hazards to the safe use of the premises due to the Contractor’s work and/or equipment shall be suitably marked at all times.
1.2.4. Contractor is responsible for all related Personal Protection Equipment (PPE).
1.2.5. Pedestrian and vehicle traffic ways shall be kept clear and unobstructed.
2. BASIC SERVICES
2.1. Waste Water.
2.1.1. The Contractor shall provide all equipment, labor, supervision, vehicles, and tools required to pump liquid from Missile Alert Facility (MAF) sewage lagoons and properly dispose of liquid per Montana State and federal regulations. NOTE: The City of Great Falls will not allow disposal of this waste water at their treatment plant.
2.1.2. Contractor must provide copy of current Montana septic pumping license prior to start of work.
2.1.3. Minimum pumping should be expected around 100,000 gallons per call.
2.1.4. Upon notice to commence work, the Contractor will have a period of performance of 30 days to complete requirement.
2.1.5. Pumping activities must not block vehicle access to the MAF.
2.1.6. Intake and lagoon level must be inspected by 341 CES prior to the start of work. No payment will be made for work performed prior to 341 CES inspection. If the adjacent ground is too soft to get close access to a lagoon, the Contractor shall provide a device to start a siphon and hose to where the truck or tank trailer will be parked.
2.1.6. The intake must be floating and the liquid drawn from the top foot of the lagoon.
3. GOVERNMENT FURNISHED PROPERTY AND SERVICES
3.1. Emergency Services. There are no emergency medical services available on MAFB. Therefore, the Contractor shall call 911 in case of medical emergencies.
4. GENERAL INFORMATION
4.1. Superintendent. Upon award, the Contractor shall designate a primary, and at least one alternate Superintendent, who will be responsible for performance of services. The Contractor shall submit the names and telephone numbers of the primary and alternate(s), in writing, to the CO. The Superintendent or alternate(s) shall have full authority to act for the Contractor on all matters relating to daily operation of this contract. The Superintendent or alternate(s) shall be available within 60 minutes, either in person or by telephone, during normal duty hours to discuss performance issues or problems with Government personnel. The Superintendent may be a Contractor employee providing services in accordance with this SOW. The Superintendent or alternate(s) must have experience performing the services described in this
SOW.
4.2. Contractor Employee Restrictions. The Contractor shall not employ persons for work on this contract if such employee is identified to the Contractor by the CO as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population.
4.2.1. Conflict of Interest. The Contractor shall not employ any individual who is an employee of the United States Government if the employment of that individual would create a conflict of interest, nor shall the Contractor employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval of the employment in accordance with Department of Defense Directive (DoDD) 5500.07-R, Standards of Conduct. In addition, the Contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies contained in AFI 64-106, Air Force Industrial Labor Relations Activities.
4.2.2. Military Personnel. The Contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station (PCS), change in duty hours, or deployment.
Military reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the Contractor’s ability to perform. Their absence at any time shall not constitute an excuse for non-performance under this contract.
4.2.3. Undocumented Immigrants. Undocumented immigrants without a valid work permit are unauthorized on MAFB. The Contractor shall not hire undocumented immigrants to perform contract services on MAFB or in the missile field, nor attempt to bring undocumented worker on the installation.
Corrective/punitive action will be taken against the Contractor and the undocumented worker if the Contractor hires undocumented immigrants to perform contract services on MAFB or in the missile field.
4.2.4. Contractor Employee Conduct. The Government reserves the right to require removal from the contract any Contractor employee who endangers persons or property, whose actions are inconsistent with professional conduct, whose continued employment is inconsistent with the interest of military security or who is found to be incapacitated or under the influence of alcohol, drugs, or other substances. Removal of employees for any reason does not relieve the Contractor of the requirement to perform services specified herein.
4.4. Federal Holidays. MAFB recognizes the following Federal Holidays. The Contractor is not required to perform services on the following Federal Holidays.

4.5. MAFB Official Hours of Operation. The official hours for MAFB are from 7:00 a.m. to 4:30 p.m., Monday-Friday, excluding federal holidays.
4.5.1. Normal Duty Hours. The normal duty hours for 341 Security Forces Group (341 SFG) are from 7:00 a.m. to 4:30 p.m., Monday-Friday, excluding federal holidays. COR’s are usually available during these times. However, Missile Alert Facilities are manned 24 hours a day, 7 days a week, with no exceptions. When the Contractor’s work schedule conflicts with an Air Force mission requirement, the Contractor is required to advise the Government to reschedule the work to minimize disruption of operation
4.6. Cooperation with Other Contractor Personnel. The Government may award other contracts for additional work. The Contractor shall fully cooperate with other contractors and Government employees and fit its own work to such other work as may be directed by the CO. The Contractor shall not interfere with the performance of work by any other contractor or Government employee.
4.7. Contractor Vehicles. All Contractor vehicles shall be properly registered and meet all local, state, and federal safety and emissions requirements. Vehicles shall be in satisfactory mechanical condition. Any vehicle(s) not so maintained may be ordered removed at the sole discretion of, the CO until satisfactory repairs are made. Vehicle-mounted communication equipment shall conform to all applicable base and federal frequency regulations and avoid conflict with existing frequencies.
4.8. Illegal Substances. Illegal substance possession and/or use will not be tolerated. The Contractor shall ensure that Contractor employees do not possess and/or use illegal substances. All Contractors and subcontractors are required to adhere to all local, state and federal laws concerning possession and/or use of illegal substances. Contractor personnel found to be in possession of illegal substances will be barred from the contract, and subject to arrest and prosecution by local authorities.
4.9. Continuation of Essential DoD Contractor Services During Crisis. This requirement has been determined not to be essential and does not require continued support during a crisis as defined in DoDI 3020.37, E2.1.1 and E2.1.3.
4.10. Security Requirements
4.10.1. Contractor will be required to comply with all security measures (real world or exercise) while working in close proximity to MAFs.
4.10.2. For Official Use Only (FOUO). The Contractor shall comply with DoDD 5400.07, Chapter 4, DoD Freedom of Information Act (FOIA) Program requirements. This regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding FOUO material. FOUO or FOIA material discovered by the Contractor or Contractor employees shall not be retained by the Contractor and surrendered immediately to an appropriate Government authority.
4.10.3. Reporting Requirements. Contractor employees shall immediately report to an appropriate Government authority any information or circumstances of which they are aware that may pose a threat to the security of Department of Defense personnel, Contractor personnel, resources, and classified or unclassified defense information.
4.10.4. Key Control. If the Contractor is issued Government keys, the Contractor shall establish and implement methods of ensuring all keys issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. The Contractor shall not duplicate any keys issued by the Government.
4.10.4.1. The Contractor shall immediately report any occurrences of lost or duplicated keys to the COR and 341 SFG.
4.10.4.2. In the event keys, other than master keys, are lost or duplicated, the Contractor may be required, upon written direction of the CO, to re-key or replace the affected lock or locks without cost to the Government. The Government may, however, at its option, replace the affected lock or perform re-keying and deduct the cost of such from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.
4.10.4.3. The Contractor shall prohibit the use of keys and/or cipher lock combinations, issued by the Government, by any persons other than the Contractor’s employees and the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in performance of contract work requirements in those areas.
4.10.5. Restricted/Controlled Access Areas. Contractor personnel shall avoid restricted and controlled areas unless work is to be accomplished in those locations and the necessary coordination has been made.
Strict security and personnel access control is maintained in these areas. The area within the fenced adjacent to the MAF lagoons are restricted/controlled areas and entry is prohibited and not expected. Contractor must contact the appropriate Security Control Center upon arrival to service MAF lagoons.
5. ENVIRONMENTAL REQUIREMENTS
The Contractor shall be in compliance with all applicable local, County, State, and Federal environmental codes, laws, and regulations.
6. PERMITS, LICENSES AND CERTIFICATIONS
Unless otherwise specified in the contract, obtain necessary permits, licenses, and certifications; give all required notices; and comply with applicable local, County, State, and Federal codes, laws, and regulations in the performance of the requirements of the contract. The Contractor shall maintain records of such requirements and make the documentation available to the Government for review.
