CODE OF CONDUCT
CHARTER VESSEL SAFETY
The owner/operator of a vessel under NOAA charter is responsible to crew and maintain the vessel to include all safety gear and equipment in accordance with all applicable federal, state and local laws.
Fishing Vessel charter to conduct NMFS fisheries research: Shall adhere to the safety regulations as set forth in Coast Guard rules effective on September 15, 1991, and as provided for by the Commercial Fishing Industry Vessel Safety Act of 1988 (specifically, 46 CFR Part 28) or subsequent additions or revisions. These regulations require that specified vessels be equipped with a variety of safety features and equipment.
A Coast Guard inspection of the vessel based on an interagency agreement between National Marine Fisheries Service (NMFS) and the Coast Guard or 46 CFR Part 28 will be required prior to performance. In addition to the requirements of 46 CFR Part 28, the Coast Guard inspection will require conformance with standards for lifesaving and firefighting equipment in the Rules for Small Passenger Vessels, which exceed the requirements of 46 CFR Part 28. Issuance of the notice to proceed by the Government is conditioned upon the successful completion of the mandatory Coast Guard inspection contained in this contract. Failure of the Contractor to successfully complete the inspection requirements shall be grounds for termination of this contract. Conformance with present regulations for commercial fishing vessels requires that the master or an individual in charge of the vessel ensures that safety drills and instruction are conducted at least once a month (46 CFR 28.270). Following personnel changes, safety orientations must be given to each individual on board that has not received the instruction or has not participated in the drills, prior to continuation of vessel operations. The contractor shall conduct such safety orientations prior to sailing on each cruise leg. Due to the frequent wholesale exchange of scientific personnel at cruise breaks, it is recommended that a full drill be completed early in each cruise leg even if less than a month has elapsed since the last drill. Each vessel must also have all required emergency instructions posted (46 CFR 28.265).
Passengers are not permitted to be transported aboard NOAA chartered vessels for any reason without review and approval from the Contracting Officer in consultation with the chief scientist. No individuals shall be aboard the vessel without NOAA’s authorization. Exceptions to this requirement are permitted for the purposes of rescuing and saving life at sea.
POSSESSION OF LIQUOR/ILLEGAL DRUGS
During the charter period, the possession or use of intoxicating liquor and/or illegal drugs by any person is not permitted and may be grounds for termination of this contract by the Government.
CONTROL OF PLASTIC DISCHARGES
Contractor shall comply with the Marine Plastic Pollution Research and Control Act of 1987, which establishes Federal requirements for controlling plastic discharges from ships.
CHARTER ALTERATIONS
The Government may increase or decrease the number of contract award days and/or conduct one or more additional surveys outside of the proposed charter dates, at the daily rates in the Price Schedule, if the Contractor agrees to the change. The addition of charter days in accord with this clause shall be accomplished through the execution of bi-lateral modification by the parties.
LIVING AND WORKING CONDITIONS FOR GOVERNMENT PERSONNEL
The contractor shall provide safe, efficient working conditions and accommodations to the Government personnel working on board free from violence, threats of violence, harassment (including sexual harassment), intimidation, and other disruptive behavior. While conducting research, researchers will spend a considerable amount of time in the wheelhouse. The contractor, its agents, subcontractors, and employees, including the Captain and crew of the vessel shall not harass, assault, oppose, impede, intimidate, threaten, interfere with or make unwelcome advances toward any member of the Government field party. At no time during the vessel charter period which includes staging and destaging in-port times, shall any member of the scientific party or crew be subjected to or take part in, any acts of discrimination based on sex, disability, race, color, ethnic nationality or gender identification. This includes discriminatory comments, jokes, propaganda, harassment or biasness, whether directly or indirectly involving a member of the scientific party or crew member. No pornographic material, such as magazines, movies, calendars, etc. shall be present in any public/common areas on board the vessel during the duration of the vessel charter period. Violation under this clause may result in termination of the contract, at the discretion of the Government under the “Termination for Cause'' paragraph of FAR 52.212-4, and in consequent liability of the contractor to the Government for any costs incurred, as well as debarment, suspension or similar action from future participation in government contracts.
Berthing spaces shall be adequately ventilated and free from tobacco smoke, excessive engine noise and fumes.
During the cruise period, all firearms, should any be onboard, shall be kept under lock and key by the contract vessel Master.
Water intended for personal use and consumption that is taken, produced, or stored aboard the vessel shall be handled in accordance with applicable regulations. Evidence of bacteriological and chemical testing of shipboard potable water taken from the vessel’s storage tanks via the vessel’s distribution system by a certified laboratory within three months of the charter period shall be provided. Potable water shall be tested and treated to maintain a pH of 6.8 to 7.8 and a residual halogen content of 0.2 ppm to 2.0 ppm free available chlorine (or equivalent) weekly. Water should be free of tastes, odors, and turbidity that would be objectionable to the majority of those on board.
EMERGENCY MEDICAL CARE, SAFETY AND HEALTH
a. Medical Services. The Contractor shall provide a qualified Emergency Medical Technician (EMT) holding current National certification (preferred) or at least one crew member trained in advanced first aid, CPR and automated external defibrillator (AED) use while underway for the duration of the contract. The medical person in charge is responsible to the Master for the health of crew members and Scientific Field Party personnel including emergency and routine care, preventative medicine and medical administration. The medical person in charge shall assist the Master in developing plans and procedures for dealing with medical emergencies, including obtaining shore side medical advice/assistance and designating and training other shipboard personnel to aid in emergencies.
b. Medical Provisions. The Contracted vessel shall be outfitted with a current first aid manual, complete first aid kit and automated external defibrillator (AED). The Contractor shall provide a designated area to accommodate first aid treatment, medical equipment and other medical provisions. The Contractor shall establish adequate and reasonable controls and procedures for the custody and safekeeping of all medical supplies, equipment and controlled medical substances.
c. Medical Records. The Contractor shall maintain medical records aboard the vessel for Scientific Field Party personnel containing a minimum medical history and on-board treatment records. The confidentiality of these records shall be protected in accordance with the Privacy Act at 5 USC 552a.
d. Hazardous Materials. The contractor shall follow all applicable regulations and standards pertaining to the Pipeline and Hazardous Materials Safety Administration, Department of Transportation contained in 49 CFR.B.1.
The Contractor shall maintain a current library of Material Safety Data Sheets (MSDS) for all hazardous materials aboard the vessels and shall make them readily available to all personnel on board. The Chief Scientist will provide the contractor with a current copy of an MSDS for any/all hazardous materials brought onboard the vessel by the Scientific Field Party. The Chief Scientist will be responsible for the removal of all hazardous materials not consumed during scientific operations and for the removal of all hazardous materials, if any, generated by the Scientific Field Party. The Government will provide the personal protective equipment required for the safe handling of those hazardous materials brought onboard by the Scientific Field Party. The contractor is responsible for the compliance with all applicable environmental, health and safety laws and regulations pertaining to shipboard operations, including the use of hazardous materials, and the treatment, storage and disposal of hazardous materials (if any) generated by the vessel. It is anticipated at this time that at least one hazardous material (denatured alcohol) will be brought on board. Arrangements will be made with the Master to accommodate the above requirements. Additional safety requirements such as an emergency eye wash station will also need to be arranged. These arrangements will be made in cooperation with the Master.
SECURITY
The vessel shall provide a security watch while in port to ensure that unauthorized personnel are not permitted to board the vessels from shore or via the harbor. Emergency phone numbers for local port officials and law enforcement shall be available to the person on watch. Best marine practices shall be in place while underway to ensure that unauthorized personnel or craft are not permitted to approach the vessel. The Master of the vessel shall take all additional customary and reasonable precautions to ensure that no harm befalls the vessel while in port and at sea
RECREATIONAL FISHING
Scientists and vessel’s crew members may engage in recreational fishing upon obtaining permission from the vessel’s Captain and chief Scientist (to ensure that fishing will not affect scientific operations). Recreational fishing must be done in full compliance with the recreational fishing laws and regulations in effect at the fishing locality.
Fish and shellfish caught recreationally may be consumed aboard the vessel or, with permission of the captain, be retained for consumption after the completion of the charter. Recreationally caught fish which are retained should be clearly marked as such, including the license holder’s name. It is the responsibility of each recreational fisherman to meet all legal and license requirements relative to the capture, landing, and possession of recreationally caught fish.
LIAISON AND COORDINATION
The Contractor shall coordinate efforts with the Contracting Officer or a designated representative. Any request or recommendation for a change shall be made in writing to the Contracting Officer for necessary implementation, if applicable.
HARMLESS FROM LIABILITY
The contractor shall hold and save the Government, its officers, agents, and employees harmless from liability of any nature or kind, including costs and expenses to which they may be subject or on account of any or all suits or damages of any character whatsoever resulting from injuries or damages sustained by any person or persons or property by virtue of performance of this contract, arising or resulting in whole or in part from the fault, negligence, wrongful act or wrongful omission of the contractor, or any subcontractor, their employees, and agents.
SMOKING POLICY
Smoking shall be prohibited in all interior spaces occupied or utilized by the Scientific Field Party. The Scientific Field Party shall be protected from the effects of secondary tobacco smoke at all times.
