Performance Work Statement (PWS)
Mobile Bulk Document Destruction Services
1. General Information:
1.1. Description of Services: The Contractor shall provide on-site, mobile destruction services of large volume of documents, papers, and other soft media and off-site destruction of data cartridges and platter hard drives that contain sensitive but unclassified (SBU) information at the Federal Law Enforcement Training Centers (FLETC)-Glynco Training Delivery Point located at 1131 Chapel Crossing Road, Glynco/Brunswick, Georgia 31524, from October 1, 2021 through September 30, 2022 with four (4) one-year option periods.
1.1.1. Requirements of On-Site Destruction: Due to government requirements to protect and safeguard SBU information, the contracted destruction service must be able to provide the following requirements while conducting service to the FLETC:
1.1.1.1. Destruction of materials conducted to specifications are to be fully completed on-site via large truck or other appropriate vehicle/mobile-based platform, without the need for external transportation. The truck/mobile platform must be of sufficient size to adequately store all destroyed FLETC materials from a single schedule operation, but still ensure maneuverability with ease and safety while on Center.
1.1.1.2. Destruction operations will be conducted by at least two contractor employees, to ensure two-person integrity and safety while operating destruction machinery.
1.1.1.3. Weight will be measured on-site via certified scales. The scales shall be integrated as part of the truck/mobile machinery system. The weight of material emptied from each bin will be recorded on a Certificate of Destruction (CoD). CoDs will be separated per contract line items numbers (CLINs). Multiple CoDs may be submitted per CLIN. However, multiple CLINs will not be listed on a single CoD.
1.1.1.4. The total of the weights recorded on the Certificate(s) of Destruction per CLIN will be provided to the Government prior to conclusion of each scheduled service. This total weight will correlate with invoicing.
1.1.1.5. The Government will be able to verify bin contents’ destruction via visual monitoring of the on-site machinery’s destruction methodology.
1.1.1.6. Capability of shredding 3,000 pounds (lbs.) per hour.
1.1.1.7. Integrated video display that allows the FLETC representative to witness real-time document destruction.
1.1.2 Requirements of off-Site Destruction of hard plastic or metal devices.
1.1.2.1 Capability of destroying platter Hard Disk Drives (HDD), Data Cartridges - Digital Data Storage (DDS) and magnetic tapes - Video Home System (VHS) using shredder type device. Destruction devise shall be approved by COR.
1.1.2.2 Destruction may occur at offsite location under direct visual observation of Government employee.
1.1.2.3 Material shall be destroyed within eight hours of leaving FLETC property.
1.1.2.4 Certificate of Destruction shall, at a minimum, contain the following information. Type of media destroyed, quantity of media destroyed, media was safeguard in accordance with DHS standards until destruction, materials were destroyed so the data can never be retrieved or reconstructed.
1.1.2.5 Contactor shall be responsible for transportation of materials to offsite destruction location.
1.1.2.6 Charges for hard plastic destruction services shall be based on the number of materials destroyed, as recorded on the Certificate(s) of Destruction, and invoice per unit destroyed.
1.1.2.7 Until destroyed, material shall be stored in a locked container accessible only by cleared employees.
1.2. Background: The Office of Security and Professional Responsibility’s (OSPR)
Administrative Security Program (ADS) at the FLETC administers and manages the disposal of SBU information in accordance with DHS Directive 11042.1, Safeguarding Sensitive But Unclassified (FOUO) Information, and FLETC Directive 70-08, Administrative Security Program. In order to meet DHS destruction requirements, the OSPR/ADS requires contractor services for the on-site destruction of large volumes of SBU information generated by FLETC personnel and offices.
1.3. Security: Contractor personnel shall be U.S. Citizens; no foreign national contractor employees shall be approved for access to the FLETC for this duty. Contractor personnel will submit to and pass Tier 2 background investigation (BI) requirements and sign Non-Disclosure Agreements (NDAs) prior to performing any on-site work at the FLETC. Due to the inherent access to SBU materials, contractor personnel shall complete the DHS Form 11000-25 Contractor Fitness/Security Screening Request Form and Electronic Questionnaires for Investigations Processing (e-QIP) for Tier 2 requirements. The FLETC will notify the Contractor when access requests are approved. Contractor personnel who do not submit to the Tier 2 process, or for whom a favorable Tier 2 adjudication cannot be completed, shall not be allowed to perform work on this contract. The Contractor shall adhere to all security requirements listed within the contract.
2. Government Responsibilities: Government will provide adequate information on the
FLETC locations of the SBU/FOUO information to be destroyed, as well as clear access to these locations for the Contractor's mobile shredding vehicle(s).
3. Contractor Responsibilities:
3.1. All drivers, mobile shred operators, and on-site assistants to be provided by the
Contractor shall comply with Tier 2 and security requirements, including the completion of the DHS Form 11000-25. All such Access Request forms shall be submitted to the FLETC Contracting Officer (CO) within two business days of award of this purchase order.
3.2. The Contractor will conduct all shredding operations while on-site at FLETC by means of a mobile shred truck. The Contractor's mobile shred truck will have a minimum capacity of 15,000 pounds, and able to shred one full 95-gallon shred container in less than 5-minutes. The Contractor's mobile shred truck must have a minimum capability of shredding 3,000 pounds of material per hour. The Contractor's mobile shred truck must be equipped with an integrated video display that allows the FLETC Representative to witness real-time document destruction.
3.3. The FLETC Contracting Officer (CO) or Contracting Officer’s Representative (COR) shall observe destruction operations at any time in order to perform quality control of contracted services.
3.4. The Contractor's bid shall be in price per pound for on-site destruction of soft material and per unit price for destruction of hard plastics and hard drives. Invoices for services shall be based on the weight, in pounds, of soft materials destroyed and quantity of hard plastics and hard drives destroyed, as recorded on the Certificate(s) of Destruction.
3.5. At OSPR’s discretion, the Government reserves the right to add additional FLETC
Participating Organizations (POs) at any time for the life of the contract. The services will be provided, and the cost rated the same as a scheduled service.
3.6. As required (within 10 days of request), the Contractor shall provide up to 100 new, slotted lid, locking, 64-gal and/or 95-gal document accumulation containers at no additional cost to the Government. The containers will be distributed by the Contractor to various locations designated by the Government throughout the FLETC. The Contractor shall empty bins located only on the first floor of FLETC buildings with the exception of training venues and those buildings with access to an elevator/left.
Destruction of materials in the additional container will be in accordance with the fee structure and pricing set forth in the contract. Additional containers may be requested at any time during the contract period at the discretion of the FLETC Contracting Officer (CO) or Contracting Officer’s Representative (COR). The containers will be provided by the Contractor for the FLETC's use and will be provided at no additional cost to the Government. The Contractor shall replace unserviceable or otherwise unacceptable bins at the request of the Government. Should the Contractor find an unserviceable container, the FLETC Contracting Officer (CO) or Contracting Officer’s Representative (COR) shall be notified and a determination as to the cause of the problem will be made. In either case, the Contractor and Government shall together determine the cause of the problem. Any defective or unserviceable bins found to not be in that condition through no cause of the Government, shall be replaced at no additional cost to the Government. Defective or unserviceable bins found to be in that condition through actions caused by the Government, shall be replaced at cost not to exceed the wholesale price to purchase a bin of similar dimensions and capacity. All additional work must be coordinated with the COR and approved by the CO in advance. Unauthorized work will not be reimbursed.
3.7. The Contractor shall be responsible to deploy, move, and replace the accumulation containers to locations on the FLETC, as requested by the FLETC CO or their representative, which the Contractor shall be directed to access and conduct document destruction activities. Deployment and relocation of containers to various locations throughout the FLETC will be performed by the Contractor at no additional cost to the Government.
3.8. SCHEDULED SERVICES: The Contractor will provide FLETC with on-site destruction services occurring every Three (3) Weeks. This three-week schedule shall commence beginning with the first time services are provided under this contract. The Contractor will complete destruction service at FLETC in one day if possible. The Contractor shall never take more than 2 days to complete the on-site destruction work.
The FLETC Contracting Officer (CO) or Contracting Officer’s Representative (COR) may modify the regularly scheduled on-site destruction dates due to operational needs of the FLETC (holidays, special events, government operations, etc.). The Government shall not be penalized for modification of service dates, so long as reasonable notice was given to the Contractor. The Contractor shall provide at least three business-days’ notice of any necessary deviation from regularly scheduled service.
3.9. UNSCHEDULED SERVICES: Upon notification for an unscheduled service, the
Contractor will provide (within 48 hours of notification) the FLETC Contracting Officer (CO) or Contracting Officer’s Representative (COR) with a scheduled date and time of arrival to the FLETC for services to be performed. The services will be provided, and the cost rated the same as a scheduled service based on the documented number of pounds destroyed and the price per pound.
3.10. The Contractor shall provide an overall service ticket with a total weight for the entire service of soft materials and quantity of hard materials listed per contract line item number (CLIN). It shall be submitted in conjunction with the Certificate(s) of Destruction. The Contractor will provide these and other supporting documents (such as internal route maps, bin locations, etc.) and service tickets at no additional cost to the Government.
3.11. The Contractor shall be responsible to fully destroy all documents, papers, disk and tape media, and materials provided by the FLETC for destruction. Destruction shall be sufficient to render the original document or material incapable of use for identification of personal information or sensitive information, which it may have contained while still on-site. If the Contractor fails to fully destroy the documents, papers, and materials at first effort, the Contractor shall continue efforts to destroy the documents, papers, and materials until such is completed, and at no additional cost to the Government. All documents, papers, and materials shall be destroyed prior to their removal from the FLETC. If undestroyed documents, papers or materials must be removed from the mobile shredding vehicle prior to the vehicle leaving the FLETC in order to meet this requirement, the Contractor shall complete this work without assistance from the Government and at no additional cost to the Government.
3.12. The Contractor shall be able to provide on-site destruction services for SBU information including paper, optical media disks (CD, DVD, Blu-Ray). The Contractor must be able to destroy these materials simultaneously with paper materials during the same service/operation, by utilizing the same destruction equipment truck(s).
3.13. The Contractor shall be able to provide destruction services for SBU information platter style hard drives (HDD) and data cartridges (DDS). The Contractor must be able to destroy these materials at a rate no longer than 30 seconds per unit. The destruction may occur off-site, however, material must remain in direct observation of government employee until destroyed. Contractor is responsible for disposal of residue and waste produced.
3.14. HDD and DDS shall be invoice per unit.
3.15. All destroyed soft material shall be recycled by being transported to a U.S.
consuming mill or recycling facility that conducts its recycling of such wastes on site. Non-recycled FLETC document wastes are not to be sold or transferred to another recycler, facility, company, or baling facility but must instead be disposed of (through the recycling process) on-site at that destination facility. The Contractor shall provide the name, address and phone number of the recycling or mill facility it will use as evidence of compliance with this requirement. The Contractor shall also obtain a statement from the recycling or mill facility that non-recycled FLETC wastes will not be sold or transferred to another party, but will instead be considered destroyed through the recycling process, on site within 30 days of delivery. Such documents shall be provided in advance of the wastes being transported from the FLETC to the recycler. The Contractor will provide these documents and service at no additional cost to the Government.
3.16. Period of Performance
Base Period 10/01/2021 - 09/30/2022 Option Period 1 10/01/2022 - 09/30/2023 Option Period 2 10/01/2023 - 09/30/2024 Option Period 3 10/01/2024 - 09/30/2025 Option Period 4 10/01/2025 - 09/30/2026
3.17. The Contractor shall ensure registration verification of System of Award
Management (SAM) and Data Universal Numbering System (DUNS).
3.18. Invoice Submission: Invoices and copy Certificate of Destruction for each individual truckload of material destroyed shall be submitted to the FLETC Contracting Officer (CO) via email.
Invoice shall contain the following information:
• Business Name and Address
• Invoice Date
• Invoice Number
• Contract Number
• Description: Date of Service, Each Contract Line Item Number (CLIN) FLETC and Name of Participating Organizations (POs), Total Pounds Destroyed (soft material), Price per Pound, Total Quantity Destroyed (hard materials), Price per unit, and Total Line Amounts.
