About this file

This document is a Clarification Points file from the Office of the State Architect for the Sterling Correctional Facility Access Controls Electronic Security System Replacement project in Colorado. The document addresses two key clarification points submitted by a potential contractor regarding the project's contract details. The first clarification seeks confirmation on which set of General Conditions apply to the project, with the response definitively stating this will be a Design/Bid/Build contract, and Appendix F has been updated accordingly from page 74 to reflect the Design/Bid/Build Agreement's General Conditions.

The second clarification point pertains to staffing requirements, specifically asking about the on-site presence of a Project Manager and Project Superintendent. The response indicates that while Article 7 mentions both roles, the contractor is required to employ a competent project manager "as applicable" and satisfactory to the Principal Representative. The document emphasizes that these contractual terms are set by the Office of the State Architect and reviewed by the Attorney General, and no modifications to the language can be made.

Clarification Points:

Clarification 1 In review of the provided document title Appendix F – Sample DBB Contractor’s Agmt and Gen Cond..pdf, we see that BOTH Design/Bid/Build AND Design/Build Agreements (see pdf page

74) were provided.

Please advise which set of General Conditions apply to this project.

Response:

This contract will result in a Design/Bid/Build contract. Appendix F has been updated from page 74 on to include the General Conditions of the Contractor’s Design/Bid/Build Agreement.

Clarification 2 In review of the provided DBB Contractor’s Agreement and General Conditions, we note that Article 7 on pdf page 18 states that “The Contractor…shall keep present…” both a Project Manager AND a Project Superintendent on the project. Can we assume that the Project Superintendent is the only person required to be on-site full time, or are both required on-site?

Response:

The Contractor’s Agreement and General Conditions are set forth by the Office of the State Architect and reviewed by the Attorney General. We are unable to change any wording in either of these documents. Article 7 does state, however, that “The Contractor shall employ, and keep present (as applicable) on the Project during its progress, a competent project manager as satisfactory to the Principal Representative.” Hopefully this helps.
