About this file
This justification provides rationale for a sole-source contract award for power meters required as part of replacing switchgears at the Booster Fabrication Facility at NASA's Kennedy Space Center in Florida. The contractor will replace three obsolete electrical substations serving various buildings at the facility. Work includes removal of existing equipment containing hazardous materials like asbestos and PCBs, installation of new switchgears, transformers, medium voltage switches and PLC controls. The justification cites 10 U.S.C. 2304(c)(1) as authority for the sole-source award, arguing Schweitzer Engineering Laboratories equipment is required for compatibility with the existing relay management system software and hardware already used extensively across the facility, and that use of other equipment would require costly redesign and redundant systems. The notice will be published on SAM.gov to meet competition requirements, with the justification included in the construction solicitation.

NATIONAL AERONAUTICS AND SPACE ADMINISTRATION
KENNEDY SPACE CENTER, FL
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
(JOFOC)
Solicitation 80KSC021R0028 – Replace Switchgears at the Booster Fabrication Facility (BFF)
1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
This document is a justification for other than full and open competition prepared by National Aeronautics and Space Administration (NASA) Kennedy Space Center (KSC), FL.
The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is OP-CS-A, KSC, FL.
2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:
This justification provides the rationale for contracting by other than full and open competition for the inclusion of a brand name only requirement for one (1) Power Meter (see paragraph 3 below) within the award of a larger construction package that will be competed.
3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the Agency’s needs (including the estimated value):
Schweitzer Engineering Laboratories (SEL) 735 Intermediate Power Quality Meter, (6) power meters each, Estimated Value - $3,500.00, which makes the total cost $21,000.00
4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:
The statutory authority permitting other than full and open competition is 10 U.S.C.
2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The rationale supporting the use of 10 U.S.C. 2304(c)(1) is as described below:
(a) The unique combination of SEL Intelligent Electronic Devices (IEDs) and their associated Communications Processors are the only devices capable of full compatibility with the Relay Management System currently installed at KSC.
Rev.:01/2021
The Relay Management System Software combination is manufactured by SEL and is the engineering software used to perform system protection monitoring, IED configuration, event data collection and ocillographic analysis. This software exists in client/server form and is tailored only for the SEL line of products. To optimize the full capabilities of the SEL system, other manufacturer’s products cannot be used.
b. The SEL software allows KSC personnel to access proprietary device functions such as relay settings, communication configuration, data logging, event waveform capture, ocillographic analysis, and automatic event notification and data collection. No other off-the-shelf software package allows for this level of access. The use of other manufacturer’s products will drive KSC to develop, at substantial cost to the Government, a new server software structure around that manufacturer’s product line, creating unacceptable delays in fulfilling the agency’s requirements.
c. The Government has a significant investment in the existing SEL software and hardware equipment. Currently there are over 200 devices networked together and monitored by KSC’s KCCS monitoring and control system. Devices to be installed on this project are on some of KSC’s most important power circuits that require continuous monitoring. Use of equipment not compatible with SEL would result in significant additional costs to the Government to design, implement, and test a new and redundant protective relay network.
d. Purchase of the SEL items will not require additional Government costs associated with training. The Government has on-site personnel already trained and capable of installing, operating, and maintaining the SEL equipment.
6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
A notice to the Government Point of Entry (GPE) website (Sam.gov) will be published at a time to be determined and will be in accordance with FAR Subpart 5.2. The notice will include this justification as a part of the complete construction solicitation that will be transmitted to SAM.Gov.
7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The brand name only requirement applies to a very small portion of a much larger construction package that will be completed.
8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:
Due to the fact that this is a $21,000.00 requirement, no additional market research was performed for the SEL 735 Intermediate Power Quality Meter.
9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition: NONE
10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:
A notice of NASA’s intent to award this sole-source action will be synopsized on the GPE website (Sam.gov) per FAR Subpart 5.2 (See Section 6 above).
11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
