About this file
This is a subcontracting plan template provided by the Federal Bureau of Prisons for contractors required to submit individual subcontracting plans in accordance with FAR Deviation 19.109. The template is not intended to waive FAR requirements or replace more extensive Corporate/Commercial Plans, and contractors should refer to the FAR and specific solicitations when submitting original forms or adapting this template.
The template establishes Bureau subcontracting goals for small business categories: Small Business (36.36%), Small Disadvantaged Business (5%), Women-Owned Small Business (5%), Service-Disabled Veteran-Owned Small Business (5%), and Historically Underutilized Business Zone (3%), with Veteran-Owned Small Business information required under FAR Clause 52.219-9(d). Contractors must complete highlighted sections including offeror identification information, contract valuation across base and option periods, total planned subcontracting dollars by category, principal supplies and services to be subcontracted, methods used to develop goals, and identification sources for potential subcontractors. The plan requires designation of a Program Administrator responsible for facilitating small business participation through solicitation arrangements, timely consideration in make-or-buy decisions, outreach efforts, and verification of HUBZone certifications. Contractors must provide assurances regarding clause flow-down to subcontractors, periodic reporting through the Subcontracting Plan Reporting System in SAM.GOV, good faith efforts to acquire from identified small businesses, equitable opportunity for competition, record maintenance, and timely payment to subcontractors. The completed plan requires signatures from the contractor, Small Business Representative, Contracting Officer, and SBA Procurement Center Representative.

(If checked, provide an attachment explaining who in the company has this responsibility.
Include their information in the Program Administrator box above).
The Program Administrator does have overall responsibility for the subcontracting plan and perform the following functions:
• Assist SB, VOSB, SDVOSB, HUBZone small business, SDB, and WOSB concerns by arranging solicitations, time for the preparation of bids, quantities, specifications, and delivery schedules so as to facilitate the participation by such concerns. • Provide adequate and timely consideration of the potentialities of SB, VOSB, SDVOSB, HUBZone small business, SDB, and WOSB concerns in all "make-or-buy" decisions.
• Counsel and discuss subcontracting opportunities with representatives of SB, VOSB, SDVOSB, HUBZone small business, SDB and WOSB firms.
• Confirm that a subcontractor representing itself as a HUBZone small business concern is certified by SBA as a HUBZone small business concern by accessing SAM or by accessing the Small Business Search (SBS) at https://search.certifications.sba.gov/
• Provide notice to subcontractors concerning penalties and remedies for misrepresentations of business status as small, VOSB, HUBZone small, SDB, or WOSB for the purpose of obtaining a subcontract that is to be included as part or all of a goal contained in the Contractor’s subcontracting plan.
• For all competitive subcontracts over the simplified acquisition threshold, as defined in FAR 2.101 on the date of subcontract award, in which a SB concern received a SB preference, upon determination of the successful subcontract offeror, prior to award of the subcontract the Contractor must inform each unsuccessful SB subcontract offeror in writing of the name and location of the apparent successful offeror and if the successful subcontract offeror is a SB, VOSB, SDVOSB, HUBZone small business, SDB, or WOSB concern.
• Assign each subcontract the NAICS code and corresponding size standard that best describes the principal purpose of the subcontract.
• Attach additional pages to describe additional subcontracting duties performed but not shown or included here.

• Submit the Individual Subcontract Report (ISR) and/or the Summary Subcontract Report (SSR), in accordance with this clause using the Subcontracting Plan Reporting (SPR) System in SAM.GOV. The reports shall provide information on subcontract awards to SB concerns (including ANCs and Indian tribes that are not SBs), VOSBs, SDVOSBs, HUBZone SB concerns, SDB concerns (including ANCs and Indian tribes that have not been certified by SBA as SDBs), and WOSB concerns;

SPR;
• Provide its prime contract number, its unique entity identifier, and the e-mail address of the Offeror’s official responsible for acknowledging receipt of or rejecting the ISRs, to all first-tier subcontractors with subcontracting plans so they can enter this information into the SPR when submitting their ISRs; and

• Records on each subcontract solicitation resulting in an award of more than that simplified acquisition threshold, as defined in FAR 2.101 on the date of the subcontract, indicating whether SB, VOSB, SDVOSB, HUBZone, SDB, and WOSB were solicited, and, if not, why not; and, if applicable, the reason award was not to a SB concern.
• Records of any outreach efforts to contact trade associations; business development organizations;
conferences and trade fairs; and veterans service organizations.
• Records of internal guidance and encourage provided to buyers through workshops, seminars, training, etc; and monitoring performance to evaluate compliance with the program’s requirements.

GOOD FAITH EFFORT
FAR Clause 52.219-9(d)(12)
