CONTROLLED UNCLASSIFIED INFORMATION (CUI)
1. DEFINITION. CUI is defined as information that Government creates or possesses, or that an entity creates or possesses for or on behalf of the Government, that a law, regulation, or Government-wide policy requires or permits an agency to handle using safeguarding or dissemination controls. CUI does not include classified information.
2. ORGANIZATIONAL INDEX GROUPINGS (OIG) and CUI CATEGORIES: CUI consists of OIGs and their categories with marking guidance. Categories have definitions and legal authorities to help determine if information meets the criteria to be marked as CUI. A complete list of OIGs and categories are located at the National Archives and Records Administration (NARA) website https://www.archives.gov/cui/registry/category-list.
3. GENERAL GUIDANCE: Security Classification Guides (SCG) and documents marked as Controlled Unclassified Information (CUI), legacy For Official Use Only (FOUO), or Distribution Statements B thru F are not authorized for public release and cannot be placed on a publicly accessible web site or web server.
a. All contractors supporting an NSWCDD DNA contract will comply with the DoD phased CUI implementation as determined by DUSN (I&S). NSWCDD DNA is currently in phase one of CUI implementation. Phase one consists of the following marking requirements:

b. Controlled Technical Information (CTI): Dissemination of CTI will be controlled with Distribution Statement (B-F) in the Distribution/Dissemination Control line with CTI as the CUI Category.
i. All controlled technical data provided to the contractor by the government will be protected from public disclosure in accordance with the markings contained therein.
ii. Follow guidance for marking CTI in accordance with DODI 5230.24, Distribution Statements for Technical Documents.

6. DISCLOSURE POLICY: All other information relating to the items to be delivered or services to be performed under this contract may not be disclosed by any means without prior approval of the authorized representative of the contracting officer. Dissemination or public disclosure includes, but is not limited to, permitting access to such information by foreign nationals or by any other person or entity; publication of technical or scientific papers; advertising; or any other proposed public release. Due to the sensitivity of this program, no classified or CUI material received or generated under this contract will be transferred to any other contractor or agency without the approval of the Contracting Officer or Contracting Officer’s Representative (COR).

GENERAL REQUIREMENTS
SCOPE OF SERVICES
1. Scope of Support Services
1.1. The Contractor shall provide all management, labor, material, equipment, transportation, supervision, IT Infrastructure installation/support, and environmental and quality controls, to accomplish simultaneous maintenance, sustainment, repair, and minor construction projects at NSWCDD Dam Neck Activity (DNA) in Virginia Beach, VA.
1.2. In addition to standard maintenance, sustainment, repair, and minor construction, the following are considered within the scope of this contract:
a) Field surveying of sites to document existing conditions (e.g. utilities, grading, sidewalks, etc.), and mapping of new site conditions required to update GIS (graphic information system).
b) Sampling and testing of potential existing hazardous construction materials (e.g. lead paint, flooring mastic, pipe insulation, asbestos, etc.). Providing test reports to the Government documenting materials sampled.
c) Performing and providing engineering analysis and evaluations to determine the structural, electrical capacity, IT infrastructure and heating/cooling requirements to support mission equipment.
d) Providing energy computations for infrastructure solutions including: energy or thermal performance of wall and roof systems; projecting energy performance of new systems (e.g. new boiler, AHU, hot water heater, etc.)
1.3. Work performed under this contract will be complex in nature and require multiple disciplines working simultaneously to include coordination with Architect-Engineer (A-E) Contractors as necessary.
All such work shall be accomplished in strict accordance with all applicable Navy and local instructions, processes, and procedures and applicable building and life safety code requirements.
2. Hours of Operation Normal working hours are Monday through Friday, 0700 to 1700. Work shall not occur outside those hours unless previously approved by the Contracting Officer, or specified in a Task Order. In the event that Government testing schedules interfere with the Contractor’s planned work schedule, and that interference will cause a delay in schedule or increase in price, notify the Contracting Officer immediately.
TASK ORDER PROCESS
1. Ordering Procedures
1.1. All subsequent Task Orders under this Multiple Award Construction Contract (MACC) will be awarded as Firm-Fixed-Price (FFP). The Government will utilize either a Best Value Tradeoff or Lowest Price Technically Acceptable (LPTA) process in award decisions as deemed appropriate by the Government for each individual Task Order. The Contracting Officer may decide to award a non-competitive Task Order after consideration of:
1. Contract minimums
2. Urgency of requirement
3. Capacity to perform tasking requirements
1.2. For competitive Task Orders, the Contracting Officer will issue a Task Order Request (TOR) to the MACC once construction projects are identified. The TOR will include all specifications necessary for the Contractor to adequately bid on the work, as well as the disclosure of magnitude as required by FAR
36.204. TORs will be issued in accordance with Simplified Acquisition Procedures to the maximum extent practicable.
1.3. A site visit will be scheduled as necessary to review and clarify the requirements of the TOR, verify existing conditions, and obtain measurements and information necessary to develop a complete and accurate Task Order Proposal (TOP).
1.4. Each Contractor’s ability to meet quality standards and delivery requirements based on their past performance under previous Task Orders will be considered. This past performance will be documented in the Quality Assurance Surveillance Plan (QASP) assessment for each Task Order. Contractors who fail to meet the specification and schedule requirements of individual Task Orders may be suspended or removed from further participation in the MACC IDIQ. A single “Unsatisfactory” rating may not result in disqualification from the MACC, unless the unsatisfactory performance is so egregious that it is in the Government’s best interest, as determined by the Contracting Officer. Two consecutive “Unsatisfactory” performances, or multiple “Unsatisfactory” performances across a single one-year period (365 day period) may result in disqualification from the MACC, if deemed in the Government’s best interest, as determined by the Contracting Officer.
2. Contractor Proposals An acceptable TOP shall consist of the following:
2.1. Cover Sheet: Each TOP cover sheet shall include contract number, project number, project title, contact information for the Contractor, performance period, assumptions, exceptions, and the date to which the proposal will be valid. At a minimum each proposal shall be valid for 270 calendar days unless a longer period is requested in the TOR.
2.2. Price: An electronic copy of the Contractor’s pricing, with sufficient data to substantiate pricing (data other than certified cost or pricing). The Government reserves the right to request additional pricing information after receipt and evaluation of proposals.
2.3. Project Schedule: Each TOP shall include a brief critical path schedule, taking into account the major work elements, mobilization, material delivery times, anticipated weather delays, and final inspection.
The proposed timeline should be of sufficient detail to demonstrate that the Offeror can meet the Governments proposed Period of Performance (PoP).
3. PERIOD OF PERFORMANCE
3.1. If the Government has a maximum PoP it will be stated in the TOR. If not the Contractor can propose a PoP using the brief critical path schedule. The PoP shall start on the TO award date. The calculated PoP is made up of the following:
• Pre-Construction Period: Not more than 30 calendar days. Time allotted to the Contractor to submit insurance and bonding information, submission of preconstruction submittals required by specifications, and onsite mobilization.
• Physical Construction: Varies by TO. Time allotted to the Contractor to complete all construction activities required by the TO.
• Project Closeout: Not more than 30 calendar days. Time allotted to the Contractor to prepare all project close out submittals and submit application for final payment.
4. EVALUATION
The Government will evaluate TOPs based on criteria stated in the TOR.
5. COMMENCEMENT OF WORK
5.1. TOs will be issued by the Contracting Officer using the Department of Defense (DD) Form 1155, Order for Supplies and Services. Each TO will include the following information:
• Date of Task Order;
• Contract Number and Task Order Number;
• Item Number, description, material submittal requirements, quantity and unit prices for items and total;
• Task order price and delivery or performance date;
• Accounting and appropriation data;
• Liquidated damage, if any; and;
• Any statement of work, drawings or other pertinent data.
5.2. The Contracting Officer will issue Notice to Proceed (NTP) after receipt and approval of all required pre-construction submittals. In rare circumstances, on projects deemed emergencies, the Contracting Officer may issue verbal direction prior to the issuance of the written TO. In those circumstances, the NTP shall be the date the Contractor received the verbal NTP from the Contracting Officer with written notification to follow with seventy-two (72) hours.
SAFETY, ENVIRONMENTAL AND HAZARDOUS MATERIALS
1. SAFETY AND ON-SITE SAFETY
1.1 The Contractor shall comply with the requirements of NSWCDD, Department of the Navy (DON), and DOD safety policies and practices currently in force and all subsequent revisions. Established policies, directives, and guidance relating to safe operating practices and personnel safety are mandatory and shall be complied with at all times. The Contractor shall monitor and observe all activities and personnel to ensure strict adherence and compliance to applicable standard operating procedures and safety procedures. The Contractor shall observe all applicable technical, safety, and policy requirements as applies to the handling of hazardous materials.
1.2 The Contractor shall address and comply with all applicable workplace and work environment conditions for compliance with the intent and letter of Federal, State, local and DoD Occupational Safety and Health laws and regulations, policies, and practices.
1.3 All operations are subject to DOD/DON/NSWCDD safety inspections. The Contractor shall support NSWCDD annual safety and environmental facility audits and data collection efforts.
1.4 The Contractor shall strictly adhere to Federal Occupational Safety and Health Agency (OSHA) Regulations, Environmental Protection Agency (EPA) Regulations, NSWCDDINST 5100.1 Occupational Safety and Health Instruction (current revision), and all other applicable state and local requirements.
1.5 The Contractor shall ensure that each Contractor employee reads the document entitled, "Occupational Safety and Health (OSH) Policy Statement" within 30 days of commencing performance at NSWCDD. This document is available at: https://flankspeed.sharepoint-mil.us/sites/nswcdd_operations/Infrastructure/SitePages/OSH-Bulletin-Board.aspx.
1.6 The Contractor shall provide each Contractor employee with the training required to do his/her job safely and in compliance with applicable regulations. The Contractor shall document and provide, upon request, qualifications, certifications, and licenses as required. Contractors conducting lead or asbestos abatement activities shall also provide a written abatement plan to the Safety & Environmental Branches for review and approval.
1.7 The Contractor shall provide each Contractor employee with the personal protective equipment required to do their job safely and in compliance with all applicable regulations.
1.8 Contractors shall not procure HAZMAT on behalf of NSWCDD without following the approved HAZMAT procurement process in the Enterprise Resource Planning (ERP) Portal. For emergency HAZMAT purchases only, the Contractor shall alert the Safety & Environmental Branches and request a waiver to procure outside the HAZMAT procurement process. For emergency purchases, the Contractor shall submit an Authorized Use List Addition form and the Safety Data Sheet to the Safety & Environmental Branches for approval. Once the HAZMAT arrives onsite, the Contractor shall alert the Environmental Branch so that it can be barcoded and added to the inventory.
1.9 HAZMAT owned by the Contractor and brought into NSWCDD workspaces for temporary use shall be reviewed and approved by the Safety & Environmental Branches prior to use. The Contractor shall submit the Safety Data Sheet that must be routed through the Government supervisor responsible for the specific work area. This HAZMAT must clearly be marked that it is Contractor owned and shall not be stored in NSWCDD spaces.
1.10 Applicable Contractors shall submit Total Case Incident Rate (TCIR) and Days Away, Restricted and Transfer (DART) rates for the past three years upon request by the Safety Branch. A Contractor meets the definition of applicable if its employees worked 1,000 hours or more in any calendar quarter on site and where oversight is not directly provided in day-to-day activities by the command.
1.11 Contractors working with ionizing radiation (radioactive material or machine sources) must comply with NAVSEA S0420-AA-RAD-010 (latest revision)(provided upon request). Prior to bringing radioactive materials or machine sources on base, the Contractor must notify the Command Radiation Safety Officer in the Safety & Environmental Office.
1.12 The Contractor shall immediately report all work-related injuries/illnesses that occur while working at NSWCDD, or an off-site location (including shipboard), to the Safety Branch, and the COR.
HAZARDOUS MATERIALS (HAZMAT) USED ON GOVERNMENT SITE
2.1 The Contractor, suppliers, and Sub-contractors shall comply with all certification, licensing, and training requirements for all federal, state, and local laws and regulations with respect to the handling and disposal of hazardous materials.
2.2 The Contractor shall create a Hazardous Material Management Plan (HMMP) at locations where the Contractor disposes of hazardous materials such as batteries; fluorescent tubes, caulking tubes, and refrigerant. Contractor shall utilize hazardous materials collection points or Government collection centers for discarded hazardous material.
2.3 Asbestos and lead-based paint assessments may be required on this contract to determine the presence of hazardous material during demolition or at utility points of connections. Work on and around waterfront structures, including under deck and underwater, and work in confined spaces may be required on this contract. The Contractor shall be able to accept work that involves asbestos, lead paint, Poly-Chlorinated Biphenyls (PCB) s, and other hazardous materials, work on and under waterfront structures, and in confined spaces.
2.4 Hazardous materials maybe utilized at any time during the performance of work on a Government site as required and specified in the TOP and subsequent TO. Compliance with applicable Government regulations is required.
2.5 Hazardous materials are defined in FED-STD-313F and include items such as chemicals, paint, thinners, cleaning fluids, alcohol, epoxy, flammable solvents, or asbestos.
2.6 The Contractor shall have an active Hazard Communication Program in place for all Contractor employees per 29 C.F.R. 1910.1200. Before delivery of any hazardous materials onto Government property, the Contractor shall provide the COR with an inventory and Safety Data Sheet (SDS) for these materials.
2.7 HAZMAT must be used safely according to local standard operating procedures (SOPs).
ENVIRONMENTAL AND HAZARDOUS MATERIALS HANDLING
3.1 The Contractor, suppliers, and Sub-contractors shall comply with all certification, licensing, and training requirements for all federal, state, and local laws and regulations with respect to the handling and disposal of hazardous materials.

3.4 The Contractor shall perform work under this contract consistent with the relevant policy and objectives identified in the NSWCDD environmental management system (EMS). The Contractor shall perform work in a manner that conforms to all appropriate EMS Plans of Actions and Milestones identified by the NSWCDD EMS Plan. In the event an environmental nonconformance or noncompliance associated with the contracted services is identified, the Contractor shall respond and take immediate corrective and/or preventative actions to ensure the actions do not continue. In addition, the Contractor shall ensure that their employees are aware of their roles and responsibilities identified by the NSWCDD EMS and how these requirements affect their work performed under this contract.
SECURITY
1. PORTABLE ELECTRONIC DEVICES
Non-government and/or personally owned portable electronic devices (PEDs) are prohibited in all NSWCDD buildings with the exception of personally owned cell phones, which are authorized for use in General Office Spaces (GOS). All personnel need to be aware of PED’s policy and being permitted in a building by asking authorized personnel or reviewing the entrance area signs and instructions. The Contractor/personnel visiting shall ensure the onsite personnel remain compliant with this PED policy.
NSWCDD instruction defines PEDs as the following: any electronic device designed to be easily transported, with the capability to store, record, receive or transmit text, images, video, or audio data in any format via any transmission medium. PED’s include, but are not limited to, pagers, laptops, radios, compact discs and cassette players/recorders. In addition, this includes removable storage media such as flash memory, memory sticks, multimedia cards and secure digital cards, micro-drive modules, ZIP drives, ZIP disks, CD-RWs, DVD-RWs, MP3 players, iPADs, digital picture frames, electronic book readers, kindle, nook, cameras, external hard dish drives, and floppy diskettes.
Personal Wearable Fitness Devices (PWFDs) marketed primarily as fitness or sleep devices are allowed in all Navy spaces, if they are compliant with NAVADMIN 216/15, where collateral non-Sensitive Compartmented Information (SCI), classified information is processed, stored, or discussed up to and including secret. The User must ensure the PWFD is compliant with all requirements in NAVADMIN 216/15, Cyber Hygiene Authorization to use Personal Wearable Fitness Devices (e.g., FitBit, Jawbone UP, etc.) in Navy Spaces, dated 14 September 2015 and register PWFD in the NSWCDD Fitness Device Tracker.
Personnel requiring the use of Medical Portable Electronic Devices (MPEDs) must submit Form NSWCDD 5239/4 for SCIF authorization to the Special Security Officer (SSO). For Special Access Program Facility (SAPF) authorizations, follow the guidance provided by the Government Special Access Program Security Officer (GSSO). Authorizations for use in SAPFs that are co-utilized within NSWCDD SCIFs require coordination between both the GSSO and SSO. For authorizations to use MPED in Collateral Classified spaces, submit form to the Special Programs Branch, Code 1053.
PED’s belonging to an external organization shall not be connected to NSWCDD networks or infrastructure without prior approval from the NSWCDD Information Assurance and Compliance Branch.
This approval will be granted using the TARIS form and action tracker process.
Personally owned hardware or software shall not be connected or introduced to any NSWCDD hardware, network or information system infrastructure.”
Navy-issued peripheral:
Government procured headsets with or without microphones must be wired, use either a 3.5 millimeter
(mm) audio jack or universal serial bus (USB) port, cannot contain active-noise cancelling functionality and may be used on systems and may be used on systems of classification up to and including collateral Top Secret. The headsets are considered unclassified when unplugged, and must be unplugged when not in use within classified spaces or when classified discussions are taking place in unclassified spaces.
Government procured Bluetooth earbuds and headsets that do not require a USB dongle or any other physical connection to enable wireless connectivity are allowed for use on government issued tablets, phones, and personal devices in telework environments or unclassified general office space where no classified discussion are occurring.
Web cameras may only be used on systems at the classification level of the space. For example, in a collateral SECRET open storage area an external web camera may be connected to the SECRET workstation only. No camera pass is required for these devices.
Government provided printers and/or scanners are authorized in a telework environment. Users must ensure that any paper or media containing controlled unclassified information (CUI) or unclassified information not authorized for public release is safeguarded by locking in a drawer, cabinet or room.
CUI and unclassified information not approved for public release must be returned to the worksite for destruction.
Government issued peripherals may be used on personal devices.
While connected to any Navy network, whether on site or while in a telework environment, the use of headsets with microphones and web cameras are restricted to official government duties.
2. OPERATIONS SECURITY (OPSEC)
2.1 Contractor personnel shall follow OPSEC concepts and principles in the conduct of this requirement to protect critical information, personnel, facilities, equipment, and operations from compromise. All Contractors (including Subcontractors) shall supplement their current security practices by requiring any personnel involved in executing this Task Order to complete Government-sponsored and administered Operations Security (OPSEC) training. In addition, all Contractors should be aware of the Critical Information and Indicators List (CIIL) for the organization they are supporting as well as the OPSEC plan for NSWCDD DNA.
2.2 These OPSEC requirements will be in effect throughout the life of the procurement from award through the conclusion of services at the end of the period of performance (PoP) or other procurement termination. The Contractor must immediately notify the Government upon the discovery of any nonconformance with the OPSEC Plan.
3. IDENTIFICATION BADGES
3.1 The Contractor shall be required to obtain identification badges from the Government for all Contractor personnel to be located on Government property. The identification badge shall always be visible while employees are on Government property.
3.2 The Contractor shall furnish all requested information required to facilitate issuance of identification badges and shall conform to applicable regulations (DoDM 1000.13) concerning the use and possession of the badges.
3.3 The Contractor shall be responsible for ensuring that all identification badges issued to Contractor employees are returned to the appropriate Security Office within forty-eight (48) hours following completion of the Task Order, relocation, reassignment, or termination of an employee, and upon request by the Contracting Officer.
4. SECURITY CLEARANCES
4.1 The Department of Defense Contract Security Classification Specification (DD254) provides the security classification requirements for this effort. All personnel performing under this order shall possess, at minimum, a DoD Industrial Security Clearance of at least SECRET. Interim clearances are acceptable at time of award so long as a current clearance, respectively, is obtained within 180 calendar days subsequent to award unless further extended by prior written authorization by the Contracting Officer.
For Controlled Unclassified Information (CUI) and Personally Identifiable Information (PII) generated and/or provided under this Task Order shall be safeguarded and marked as specified in DoD Instruction 5400.48.
Contractor employees that require a SECRET clearance as part of their job duties, with or without IT Level-I designation, will be initiated by the Contractor, and will be at the Contractor's expense.
Contractor employees that require a SECRET security clearance as part of their job duties, with IT Level-I designation, shall be initiated by the Contracting Company.
Citizenship Requirements: Only U.S. citizens may perform under this contract unless waived.
Physical Security: No storage of classified material is required at the Contractor’s facility. All data generated under this contract shall be classified in accordance with the guidance in the 32 CFR Part 117 and the NSWCDD Command Security Manual.
Prior to starting work on tasks requiring clearances, Contractor personnel shall possess the required current clearance based on a National Agency Check. Contractors must comply with guidelines specified on the DD254. An interim SECRET (S) clearance is acceptable at time of award so long as a current clearance, respectively, is obtained within 180 calendar days subsequent to award unless further extended by prior written authorization by the Contracting Officer. The Contractor shall submit completed clearance packages within ten (10) calendar days or identification of any increased security requirements.
Contractor requests for visit authorizations shall be submitted in accordance with National Industrial Security Program Operating Manual (NISPOM), 32 CFR Part 117, as early as practicable and not later than three (3) working days prior to visit (except in cases of urgency). When a contractual relationship exists, original requests shall be delivered to the Security Officer of the activity being visited. When a contractual relationship does not exist, original requests shall be delivered to the Security Officer of the activity being visited via the COR for endorsement of need-to-know. Visit requests for Sub-contractors shall be submitted to the appropriate contractor FSO for certification on need-to-know, when applicable.
4.2 Security Classification Specification
Classified Military Information (CMI). This is information that is originated by or for the DOD, or a Military Department, or an entity under its jurisdiction and control, and that requires protection in the interest of national security. Such information is designated as TOP SECRET, SECRET, or CONFIDENTIAL.
Controlled Unclassified Information (CUI). This is information that although unclassified, is subject to access or distribution limitations in accordance with statute or regulation. Included is information exempt from mandatory release to the public under the Freedom of Information Act, or information that is subject to export control.
5. ELECTRONIC SPILLAGES
5.1. Electronic spillages (ES) are unacceptable and pose a risk to national security. An electronic spillage is defined as classified data placed on an information system (IS), media or hardcopy document possessing insufficient security controls to protect the data at the required classification level, thus posing a risk to national security (e.g. sensitive compartmented information (SCI) onto collateral, Secret onto Unclassified, etc.). The Contractor's performance as it relates to ES will be evaluated by the Government. ES reflects on the overall security posture of the Government and a lack of attention to detail with regard to the handling of classified information of IS security discipline and will be reflected in the Contractor's performance rating. In the event that a Contractor is determined to be responsible for an ES, all direct and indirect costs incurred by the Government for ES remediation will be charged to the Contractor.
5.2 NSWCDD Command Security will continue to be responsible for the corrective action plan in accordance with the security guidance reflected on the Department of Defense (DOD) Contract Security Classification Specification - DD254. Command Security will identify the Contractor facility and contract number associated with all electronics pillages during the investigation that involve Contractor support.
Command Security will notify the Contracts Division with the Contractor facility name and contract number, incident specifics and associated costs for cleanup.
5.3 The Contracting Officer will be responsible to work with the Contractor Facility to capture the costs incurred during the spillage clean up. The Contractor is also responsible for taking Information Security Awareness training annually, via their Facility Security Officer (FSO), as part of the mandatory training requirements.
GENERAL REQUIREMENTS
1. PROJECT REQUIREMENTS
1.1. Each Task Order (TO) will specify the project requirements. The following are required in all TOs:
a) Procuring all construction equipment, materials, and documentation necessary for timely completion of projects. The Contractor shall maintain all certification and re-certification equipment paperwork;
inspection records (QA/QC form filled out by Government TPOC); and permits and licenses for heavy equipment operation.
b) Providing a project schedule at the beginning of each Task Order. A Government approved scheduled is required prior to commencing work on any project. The Contractor shall be required to maintain the construction schedule throughout the duration of the project and adjust the schedule accordingly based on any project delays or efficiencies incurred throughout the course of the project.
c) Conducting a site visit prior to commencing work in order to verify existing conditions; coordinating with NSWCDD/NAVFAC to confirm location and type of existing utilities at buildings or sites that may be impacted by construction work.
d) Regularly inspecting all work to ensure it is in accordance with all project requirements, design documents, and safety requirements.
e) Obtaining all permits and regulatory approvals required to perform work (ex: Virginia Department of Environmental Quality, VDEQ).
f) Operation and Maintenance Support Information (OMSI): Providing training to the Government on operating and maintaining all critical systems. The Contractor shall submit to the Government all O&M manuals at the conclusion of each Task Order.
2. REGULATIONS
2.1 All work performed under this contract shall be performed following applicable Government plans, standards, policies, and processes. The Contractor’s activities shall conform to the systems test and operations environment and standards including all updates, improvements, and additions to these process documents made over the life of the contract. The Contractor shall use the Department of Defense (DoD) Unified Facilities Criteria (UFC) for facilities and infrastructure construction and modification.
