About this file
This document provides instructions to offerors for a solicitation seeking a Broadband Serviceable Location Fabric. The Federal Communications Commission (FCC) requires a dataset of all locations in the United States where fixed broadband internet access service can be installed to support its broadband data collection program under the Broadband DATA Act.
Offerors must submit proposals in five volumes by July 1, 2021: Volume I - Business; Volume II - Technical Approach, limited to 30 pages; Volume III - Data Usage Rights, limited to 5 pages; Volume IV - Past Performance, limited to 10 pages; and Volume V - Price with no page limit. The FCC will award a single contract via a best value tradeoff process to the offeror whose proposal represents the best overall value based on the non-price factors of Technical Approach, Data Usage Rights, and Past Performance being more important than Price. The FCC intends to hold discussions and may award based on initial proposals.

Instructions to Offerors and Evaluation Criteria (Addendum to FAR 52.212-1 and FAR 52.212-2)
Instructions to Offerors
1. GENERAL INSTRUCTIONS TO OFFERORS
1.1. This is a Full and Open Best Value Tradeoff competitive procurement.
This competitive procurement shall result in the award of a firm fixed price /labor hour single award contract. No proposal costs shall be reimbursed. The Government intends to hold discussions but reserves the right to award on initial proposals, without discussion, if considered to be in the best interest of the Government. All offerors should submit their best business, technical approach, data usage rights, past performance, and price proposal(s) in their initial submission. The electronic version of the RFP is the official version for this acquisition. No hard copy or facsimile copies of the Request for Proposal, or amendments, will be provided.
Under a Statement of Objectives (SOO), the Government describes its requirement in terms of desired objectives. Offerors should propose solutions that they believe will best meet or exceed the objectives.
In essence, the Government states the problem it wants solved, and industry has the freedom to propose what they consider the best solution. Under a SOO, the Government is changing the very nature of what it is acquiring from traditional compliance with a Government-developed Statement of Work (SOW) to performance results.
Offerors should propose a Contract Line Item Number (CLIN) structure with their Cost/Price proposal that includes the Support and Special Projects Optional Activity, which will be structured as a labor hour CLIN with a ceiling amount. Offerors should propose a ceiling amount per year, which will be included in the government’s calculation of the Offeror’s total evaluated price to use for the tradeoff. Should the Offeror be willing to provide different Data Usage Rights at different prices, the Offeror may submit up to two (2) alternate Data Usage Rights Proposals and associated alternate Price Proposals. The alternate Volume III – Data Usage Rights and Volume V – Price Proposals must be clearly identified as such, and it must be clear which Volume III – Data Usage Rights proposal is associated with which Volume V – Price proposal. An alternate Volume V – Price proposal may only be submitted if the Offeror submits an associated alternate Volume III – Data Usage Rights proposal (i.e. if an Offeror submits only one (1) Volume III – Data Usage Rights proposal, it may only submit one (1) Volume V– Price proposal). Only one proposal each may be submitted for Volumes I, II and IV.
The Government intends to award a single contract. The period of performance will consist of a base period of one year, followed by four option years. All proposals shall include the Offeror and any subcontractor Name(s), DUNS, CAGE Code, and a brief description of the services to be performed by any subcontractors.

EVALUATION CRITERIA
BASIS FOR AWARD
Award will be made on a best value tradeoff basis. Accordingly, the Government will award the contract to the responsible and technically acceptable Offeror whose proposal, conforming to the solicitation, represents the best value to the Government in accordance with the evaluation factors and subfactors stated in this solicitation. The proposal that offers the best value is the proposal that, in the Government’s estimation, provides the greatest overall benefit to the Government in response to the requirement. In determining which proposal offers the best value, the Government may make tradeoffs between prices and non-price proposal attributes (including past performance).
In conducting any tradeoff to determine which proposal provides the greatest overall benefit to the Government, the Government will consider proposal and Offeror attributes, judging the strengths and weaknesses associated with each proposal under the evaluation factors and subfactors identified in the solicitation. Among other things, these strengths and weaknesses may include: past performance or other attributes of the Offeror’s proposal that makes more or less likely the risk of unsuccessful or inefficient performance of the contract, including increased cost, defective or degraded performance, extended or disrupted schedule, or the risk of required additional Government oversight; and meritorious aspects of the Offeror’s proposal that exceed the requirements or approach the requirements in a way beneficial to the Government.
Best value will be determined by comparing the value of the differences in the proposal(s) and Offerors as judged by the non-price evaluation factors with differences in their price to the Government. In making this determination, the Government is more concerned with obtaining superior past performance and technical/management capabilities than with making a source selection at the lowest price. However, the Government reserves the right to place the order with an Offeror(s) whose proposal does not offer the most superior non-price attributes or whose proposal offers other than the lowest price, where doing so achieves the greatest overall benefit for the Government. As the non-price factors among the proposals near equality, price will become more important to the Government.
To the extent any Offeror(s) submit(s) alternate Data Usage Rights and Price Proposals, the Government will fully evaluate each alternate proposal in accordance with the evaluation criteria below. For the purposes of conducting its tradeoff analysis, the Government will fully consider each of the Offerors’ proposals, including any alternate Data Usage Rights and Price proposals, and conduct a full tradeoff.
Essentially, any Offeror submitting alternate proposals could have up to three (3) total proposals in consideration for the purposes of conducting the tradeoff (of which the Technical Approach and Past Performance portions, and evaluation/ratings thereof, would be the same).
The Government intends to hold discussions with Offerors as needed, but reserves the right to award on initial proposals, without discussion, if considered to be in the best interest of the Government.
SOURCE SELECTION FACTORS
The evaluation factors for this award are as follows:
Evaluation Factors Order of Importance
Factor 1 Technical Approach Factor 1 is slightly more important than Factor 2.
Factor 2 Data Usage Rights Factor 2 is slightly more important than Factor 3.
Factor 3 Past Performance
Factor 3 is slightly less important than Factor 2.
Factor 4 Price Factors 1-3, when combined, are significantly more important than price.
Adjectival Ratings
Proposals will be rated for Factor 1: Technical Approach; Factor 2: Data Usage Rights, and Factor 3: Past Performance under an adjectival rating scheme. The Government will not “roll up” factor adjectival ratings into an overall non-price proposal adjectival rating. To the extent an Offeror submits an Alternate Data Usage Rights proposal, that alternate proposal shall be fully and separately evaluated in accordance with the Factor 2 evaluation criteria described below, and the alternate Data Usage Rights proposal will be assigned a separate adjectival rating in accordance with the adjectival rating scheme.
Evaluation Factors:
(1) Technical Approach
(a) The FCC will consider the extent to which the Offeror’s technical approach will achieve the Broadband Location Serviceable Fabric objectives. The evaluation will assess the extent to which the solution provides an in-depth understanding of and adheres to the project’s objectives. Evidence of a high-quality technical solution includes:
1. A comprehensive performance work statement that identifies the services to be delivered to meet the requirements set forth in the Statement of Objectives.
2. A Quality Control/Quality Assurance Plan that provides a thorough overview of responsibility and plans/actions to provide quality control/quality assurance throughout the contract lifecycle.
3. A sound technical proposal that clearly demonstrates how implementation of the proposed solutions will deliver timely, standard, stable, reliable, secure, flexible, responsive, compliant, and cost-effective services to meet the needs of FCC and its stakeholders.
4. The FCC will evaluate each Offeror’s description of the approach it will use, or has used, in creating a dataset of all structures in the U.S. and of Broadband Serviceable Locations (BSLs).
The description will be evaluated based on the thoroughness and feasibility of the offer’s approach, including:
• Underlying and/or primary sources of data, including how often the underlying sources are updated or refreshed
• How data will be, or have been, analyzed or derived from the underlying data sources to determine the following:
The location of structures Whether structures are BSLs Additional required data (location counts, address(es), residential/business classification) The extent to which, and process by which, FCC staff can influence or update the
Offeror’s approach to determining the location of structures, designation of BSLs, or additional data to meet the FCC’s particular needs
• Information about the timeframe for refreshing data, including the shortest time period to refresh the data, and the ability to create monthly, quarterly, or bi-annual datasets
• How the Offeror will validate and incorporate feedback on the accuracy of the datasets, including challenge data submitted via the FCC
• The extent to which the Offeror demonstrates relevant expertise in working with GIS datasets as required by the Broadband DATA Act, including any prior work creating or maintaining a nationwide location dataset.
• The Offeror’s process to evaluate and correct errors in the dataset over time
• Proposed timeframe for delivering the initial databases to the Government, including an estimate for the number of total structures, number of BSLs, and number of addresses in the initial delivery of databases.
(2) Data Usage Rights
The FCC will evaluate the extent to which the Offeror’s proposed data usage rights meet or exceed the Government’s requirements, with preference given to data rights more closely aligned to the most-preferred rights described in the SOO.
(3) Past Performance
The past performance assessment will assess the Government’s confidence in the Offeror’s ability to successfully accomplish the requirement based on the Offeror’s demonstrated work record on recent and relevant efforts in terms of size, scope, and complexity in comparison to the requirements in the SOO, and how well the Offeror performed those relevant efforts. The recency and relevancy of the information, the source of the information, the context of the data, and general trends in the Contractor’s performance will be considered. More recent and more relevant performance usually has a greater impact in the confidence assessment than less recent and less relevant performance. The Government will perform an independent determination of relevancy of the data provided or obtained. A relevancy determination will be made for each of the three (3) contracts submitted by the Offeror. For the Offeror, information on no more than three (3) contracts should be submitted for consideration; information on additional contract will not be evaluated. If additional contracts are submitted, they will be evaluated in order of receipt of the Past Performance Questionnaires up to the required number. An Offeror without a record of relevant past performance or for whom any or recent information on past performance is not available will not be evaluated favorably or unfavorably on past performance. In conducting the past performance evaluation, the FCC may use information obtained from sources other than the Offeror’s references and information contained in their proposals, including, among other sources, current information from Government-wide past performance databases and industry reporting sources. The FCC may also consider past performance information regarding predecessor companies, key personnel, or other corporate entities or subcontractors where such information is relevant to this acquisition, whether or not contained in the Offeror’s proposal.
The FCC is not required to interview points of contact identified by Offerors.
(4) Price Analysis
The Government will evaluate the information submitted in each Offeror’s price proposal in accordance with FAR 15.404-1(b). The Government will review price proposals for completeness and arithmetic accuracy. Price will be evaluated but not rated. The Government will determine whether the total evaluated price is fair and reasonable. In reaching such a determination, the Government may evaluate the reasonableness of proposed labor rates and unit prices to be paid by the Government over the course of the contract.
Options. The Government will evaluate offers for award purposes by adding the total price for the base period and all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
