GENERAL

C-1.0 Introduction: This Performance Work Statement (PWS) describes the requirement for Government-owned Contractor-operated (GOCO) fuel services at Fort Sill, Oklahoma. The Contractor shall operate, maintain, manage and provide fuel services as described below for all fuel facilities, related structures, and property described in this PWS and/or listed in Appendix - G. Refueling operations shall be performed using best commercial practices and guidelines in accordance with (IAW) all applicable Local, State and Federal regulations and Appendix D. The Contractor shall be responsible for, and furnish as required all personnel, equipment, and/or material necessary for providing these services.

C-1.1 Terminal Statement: The Contractor shall be responsible for all GOCO facilities and equipment listed in Appendix G and assumes their operation and organizational maintenance. The Government reserves the right to (1) replace defective and worn-out facilities and equipment and (2) improve and modernize the Government facilities for use by the Contractor in the performance of this contract. The products currently utilized at Fort Sill are F24, GUR and DS2. The distinct facility locations are listed as follows:

C-1.1.1: Fort Sill Retail/Bulk Storage Fuel Facility: The Contractor shall provide operation and organizational maintenance (IAW UFC 3-460-03, Petroleum Fuel Systems Maintenance and DoDM 4140.25, DoD Management of Energy Commodities) at the Army owned bulk / retail point (bldg. #2245).

C-1.2 General Scope of Work: The Contractor shall perform required tasks to include fuel operations, management and administration pertaining to the receipt, storage and handling, and issue of DLA Energy fuel products. In addition, the Contractor shall ensure all personnel are adequately trained to perform job tasks, maintain the security of facilities and computer systems, and comply with Army, DLA Energy, Local, State and Federal Laws and Regulations.

C-1.3 Contract Performance: The Contractor shall monitor performance and ensure contract compliance as prescribed by the Contract Compliance Plan submitted. The Contractor shall perform and achieve performance standards for each task in Appendix - A. The Contractor shall, submit performance based plans to ensure performance standards are met and comply with applicable regulations as described in section 4.0 of this PWS. The Contractor shall be responsible for obtaining copies of and ensure compliance with all applicable Federal, State, and Army, DLA Energy and local laws and regulations, including changes.

C-1.4 Personnel Qualifications: The Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet performance requirements and comply with all applicable laws and regulations. The Contractor shall provide personnel in accordance with Appendix - E. They shall be able to speak, read and understand English to the extent of reading and understanding printed regulations, detailed written orders and operating procedures, training instructions and materials, and shall be able to compose reports that convey complete information.

C-1.5 Suitability Investigations: Contractor personnel shall successfully complete a background investigation which includes, at a minimum, a National Agency Check and Inquiries (NACI), before operating a computer workstation that has access to a government server or when the Contractor employees require unescorted entry to restricted areas. These investigations shall be submitted by the

Army at no additional cost to the Contractor. The Contractor is responsible for submitting documentation to the appropriate government office for applicable employees and shall comply with the DoD 5200.2-R, Personnel Security Program.

C-1.6 Contractor Manpower Reporting: The Contractor shall report all Contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Defense Logistics Agency via a secure data collection site using the following web address:

http://www.ecmra.mil/. The Contractor is required to completely fill in all required data fields.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1st through September 30th. While inputs may be reported any time during the FY, all data shall be reported no later than October 31st of each calendar year. C-1.7 Drug Free Workplace: The Contractor shall establish and maintain a Workplace Drug Testing Program in accordance with the Federal Workplace Drug Testing Programs under authority of Section 503 of Public Law 100-71, 5 United States Code (USC) Section 7301 “Presidential Regulations”, and Executive Order (EO) 12564 “Drug-Free Federal Workplace”.

C-1.8 Applicable Directives: The Contractor shall comply with applicable statutory and regulatory requirements and validated best commercial practices. This requirement applies to all performance criteria and deliverables set forth in this document. Appendix - D provides a list of directives and other guidance that are applicable to the performance of this contract. The list is not all inclusive. In the event of conflicting guidance, the contractor shall contact the Contracting Officer for clarification.

C-1.9 Quality Monitoring and Evaluation: DLA Energy shall utilize a Quality Assurance Surveillance Plan (QASP) to monitor and evaluate the Contractor’s performance throughout the contract performance period. DLA Energy may also perform customer satisfaction surveys, which may be used as part of the assessment of Contractor’s performance. The Contracting Officer has the option to increase the frequency of surveys to address contract compliance issues as needed.

PERFORMANCE REQUIREMENTS

C-2.0 Introduction: The performance requirements are organized into an Appendix and described in Appendix –A. The Contractor shall provide Personnel Staffing, Fuel Operations, Support Operations, and Management and Administration as follows:

C-2.1. Personnel Staffing Objective: The Contractor shall provide sufficient personnel staffing to accomplish all petroleum receipt, storage, issue, facility maintenance, operations and other tasks as identified in this PWS. The Contractor’s personnel staffing objectives shall be flexible and capable of meeting all fuel related requirements.

C-2.2 Fuels Operations: The Contractor shall safely receive, store and handle, and issue fuel. Fuel Operations shall be specific for the base and shall include federal, state, Army and local requirements as applicable. During operations, fuel quality shall be maintained at all times. The fuel shall be accounted for by quantity received, stored, and issued according to DoDM 4140.25 and DLA Energy Policy and acceptable tolerance levels. The Contractor shall immediately notify the Contract Officer Representative (COR) and Contracting Officer of any issues that impact the quality, quantity, or availability of fuel in storage. See Appendix - A for normal hours of operations.

C-2.2.1 Ground Fuel Operations: The Contractor will perform all fuel operations, inventory management, quality surveillance, maintenance, training, safety and environmental protection functions at the ground fuel service stations listed in Appendix - A. The service stations will provide fuel support to authorized reimbursable Defense Wide Working Capital Fund (DWCF) customers that have approved DLA –Energy purchase devices or have an assigned Department of Defense Activity Address Code (DODAAC), Federal Activity Address Code (FEDAAC) or "2A" DODAAC.

C-2.2.2 Bulk Fuel Operations: The Contractor shall perform all fuel operations, inventory management, quality surveillance, maintenance, training, safety, and environmental protection functions at the bulk storage site as listed in Appendix - A. The Contractor shall post a list of contact numbers for emergencies and after hour's bulk refuels.

C-2.2.3 Ground Fuel Deliveries: The Contractor shall provide fuel support (JAA/DS2/GUR) to outlying organizations located throughout the installation that are not covered under the current DLA Direct Delivery contract during normal duty hours as specified in Appendix – A. Delivery routes are restricted to improved/paved roads only.

C-2.3 Hours of Operations: The hours of operation for each specific petroleum function for which the Contractor shall be responsible are detailed in Appendix - A. Tasks associated with a given function, tank truck receipts at storage for example, will normally be accomplished within the hours specified.

C-2.3.1 After Hour Response: The Contractor shall establish an after-hours notification mechanism: a means of being contacted in the event emergency services or workforce augmentation is required without prior coordination/notification. All services required outside of the normal hours of operation without prior coordination/notification shall be met within two (2) hours as measured from the time the Contractor is notified until the operator is in position to perform the service required. All after hours support shall be the Contractor’s responsibility under their fixed monthly price.

C-2.4 Receive Fuel: The Contractor shall at all times safely receive product without causing delays, interruption, or demurrage. This applies to response times for duty hours, non-duty hours, and extended surge operations at the specified refueling sites. During commercial tank truck receipts, the Contractor will escort fuel delivery trucks from and to the facility gate for all sites. The contractor may be required to escort fuel delivery trucks from the entrance to the installation during increased Force Protection Conditions (FPCON) measures (real or exercise).

• The Contractor shall order fuel and schedule inbound fuel shipments, receipts utilizing appropriate DLA Energy systems i.e. (IRAPT/WAWF, EBS, etc.) Receipt notification shall include the quantity received, mode of delivery, delivery date, shipment source, grade or type of product, and any special instructions. The Contractor shall immediately notify the Contracting Officer’s Representative (COR) and DLA Energy Region office of any inventory/quantity discrepancies or the DLA Energy Quality Assurance Representative (QAR) and Army Petroleum Center (APC) of any quality discrepancies. The Contractor shall not offload off-specification fuel unless a waiver has been granted by DLA Energy-Q (Quality Tech Support Office. The Contractor shall prepare all documents required for product receipt).

• All incoming product shall be sampled in accordance with the most current version of MIL-STD- 3004-1 and Quantity determination shall be performed as outlined in DoDM 4140.25, DLA Energy Interim Policy P-2 and API Manual of Petroleum Measurement Standards (MPMS). The Contractor shall accomplish and submit all appropriate documentation to the DLA Energy Regional Office.

• During transport truck receipts, the custody and risk of loss shall pass from the carrier to the

Contractor when the product passes from the end of the truck discharge hoses into the Contractor’s receiving facility (GOCO).

• The Contractor shall not receive and dispense fuel from the same tank simultaneously.

C-2.5 Issue Fuel: All bulk issues and receipts shall be under the Contractor’s supervision and control to prevent spills and ensure safety. The Contractor shall at all times safely issue fuel without causing delay, interruption or demurrage. This applies to response times for duty hours, non-duty hours and extended surge operations at the specified fuel site. The Contractor shall immediately notify the COR and DLA Energy Region office of any discrepancy or issue that may result in the inability to issue product.

• Except for scheduled maintenance, and other occurrences of which DLA Energy has been notified, the Contractor shall maintain a tank in ready-to-issue mode for bulk and retail dispensing at all times of the day, every day.

• The Contractor shall coordinate bulk issues directly with receiving customers within duty hours outlined in the PWS. Site-specific response times and duty hours are in Appendix A. The Contractor shall respond to after hour request IAW C-2.3 Hours of Operations. All after-hours support will be the Contractor’s responsibility, and shall include the price under the fixed monthly price.

C-2.6 Storage of Fuel: The Contractor shall at all times safely maintain product quantity, quality, and availability to meet its intended use as specified in Quality Assurance Surveillance Plan (QASP) and contract provision I-119.04 (Inventory Control Records and Systems of Record). The Contractor shall maintain the product storage facilities, as well as maintain product stock levels required to support the mission and planning requirements, within allowable limits. Product will be maintained to preclude degradation, contamination, commingling, or other occurrences which render the product unsuitable for its intended use. The Contractor shall immediately notify the COR and DLA Energy Region office of any issues which impact the integrity, quantity, or availability of fuel in storage.

C-2.7 Transfer of Fuel: When directed by DLA Energy or as required for normal operations, the Contractor shall transfer product between tanks to consolidate types or grades. The responsibility for preventing commingling or contamination rests solely with the Contractor.

C-2.8 Automated Dispensing System Key Management and Release: The base shall provide the Contractor with a data file containing the fuel DLA Purchase Source Media Device currently in service that the Contractor will upload into the automated fuel dispensing system for the GOCO facilities. The Contractor shall be responsible for issuing and revoking keys as requested in writing from the customer units through the COR. The COR shall provide the Contractor with fuel key data file requests as changes occur to issued fuel keys.

• Contractor shall maintain databases as necessary to provide all required reports required by the contract, including but not limited to, customer account numbers, responsible office for key/card holders, key/card serial numbers, and other key/card information. The Contractor shall provide required reports in accordance with DLA Energy Interim Policy P-5, Vehicle Identification Link (VIL) Key Encoding, Accountability and Control.

• The Contractor shall be responsible for receiving, maintaining, issuing, reprogramming and revoking DLA Purchase Source Media Device (formerly Vehicle Identification Link (VIL) as requested in writing from the COR and in accordance with DLA Energy P-5. The Contractor shall issue replacement keys within two working days after receiving the written request from the COR, and the same day for emergencies as directed by the COR.

• To procure additional DLA Purchase Source Media keys, the Contractor shall order keys

IAW the guidelines outlined in DLA Energy P-5.

C-2.9 Account for Fuel/Inventory Management: The Contractor shall account for fuel according to I-119.04, Inventory Control Records and Systems of Record and DoDM 4140.25 and other applicable DLA Energy policies and procedures. Physical inventory management shall include:

• Documenting each order, receipt, transfer, sale, loss, credit, gain, and adjustment.

• Maintaining auditable product document control files.

• Using inventory measurement practices that support product accountability and auditability.

• Use of Accountable Property System of Record (APSR) hardware and software, documenting each sale, credit, receipt, shipment, adjustment, and physical inventory transaction.

• Ensure that adequate stocks are on-hand to fully support mission requirements at all facilities and maintain the required inventory levels.

• Maintain control over the physical environment to ensure proper product storage can take place with minimal losses.

• Ensure inventory variations are within allowable limits. Document, investigate, report, and take corrective action if necessary on excessive variations in compliance with DLA Energy Policies.

• Unless otherwise directed, the Contractor shall process all transactions IAW DoDM

4140.25 and other applicable guidance into the Fuels Management Defense System or other approved DLA Energy system on a daily basis as outlined in the hours of operation set forth in Appendix A.

• Ensure that all tanks authorized to store Defense Working Capital Fuel products are manually gauged in accordance with DLA Energy Policy 7 (Accountability and Custodial Responsibilities For Defense Working Capital Funds (DWCF) Inventory and Government Property) and the results are provided on a DLA Form 2026 upon request.

C-2.10 EBS/APSR Computer Software and Hardware: DLA Energy shall provide the appropriate hardware and software for all facilities to be utilized for Enterprise Business System /Accountable Property System of Record (EBS/APSR) actions. The contractor shall utilize this hardware for Government related business only. The Contractor shall provide separate hardware and internet to conduct contractor related business not related to the requirements of this PWS.

C-2.11 Ensure Fuel Quality: The Contractor shall at all times ensure product quality according to applicable product specifications, the latest version of Military Standard 3004-1 (MIL-STD-3004-1) and the Product Quality Control Plan (PQCP) IAW Quality Assurance Surveillance Plan (QASP). The Contractor will perform additional tests listed in Table – 1. No petroleum product shall be received or issued until product quality determinations have confirmed conformance with specifications. The Contractor shall ship samples of the product requiring analysis to the Army fuels laboratory in New Cumberland, PA. Samples shall be shipped within 72 hours of being drawn. Shipping costs shall be the Contractors responsibility and be included in the fixed monthly price.

• Inspection Responsibility: The PQCP will describe how the Contractor shall designate personnel, facilities, and equipment on-site to accomplish routine tests and procedures. These resources may be provided by the Contractor by commercial sources acting on behalf of the Contractor. The Government/DLA Energy will not be responsible for performing any of these services.

• Additional Samples: The Contractor shall provide to a certified lab, the following representative samples of any product being stored, shipped, or received under the contract, at the request of, and in the manner designated by the QAR or COR. These samples shall be provided in addition to samples required elsewhere in the contract and referenced in the PQCP. The packing, marking, shipping, and the associated costs, shall be the responsibility of the Contractor and shall be included in the fixed monthly price.

C-2.12 Ensure Safety: The Contractor shall ensure safety in all operations according to the its Safety Plan submitted in response to this request for proposals. The safety of the workforce, facilities, equipment, and practices shall be preserved while supporting the customer mission requirements.

C-2.13 Ensure Security: The Contractor shall provide access control for US Government property (fuel products, facilities, equipment, and information systems) according to the Security Plan.

C-2.14 Ensure Environmental Compliance: The Contractor shall be responsible for compliance with all Federal, state, local, DoD, Service, and installation environmental codes, regulations, and laws as well as installation-specific permits, licenses, and plans in effect at the time of the start of the contract period and shall comply with all additions, changes, and revisions that become effective during the contract period. The Contractor shall be responsible for maintaining documentation required by the fuel facility permits, licenses, and by regulation. The Contractor shall provide requested environmental compliance documentation upon request by appropriate personnel or agencies. The Contractor shall document the environmental requirements in their Environmental Protection Plan as required at C- 4.5.

C-2.14.1 Assignments:

GOCO Operations:

Permit and License Compliance: Environmental compliance of the fuel facility is the responsibility of the Contractor. In coordination with the appropriate installation organization, ensure the environmental permits and licenses required to operate the fuel facilities are obtained and maintained. The original copy shall be kept on file by the appropriate installation organization except where the original is required to be displayed at the facility. The Contractor shall be responsible for operating the fuel facility in accordance with these permits and licenses.

The Contractor shall maintain onsite an electronic copy and a hard copy of each of the permits and licenses that are applicable to the fuel facility operations. Permits and licenses should be properly posted in accordance with permit/license details. Permits and licenses may include, but are not limited to: air permits, storage tank operating permits; storm-water permits; hazardous waste permits, or operator licenses. Compliance requirements as negotiated by the Government may change during the contract period and the Contractor shall modify standard operating procedures and work practices to ensure compliance with any new or revised permits, licenses, laws or regulations.

Installation-Specific Plan Compliance: Pertinent environmental plans shall be provided by U.S.

Army Garrison Fort Sill. The Contractor shall be responsible for operating the fuel facility in accordance with these plans. The contractor shall maintain an electronic copy and a hard copy of each of the applicable plans on-site. This may include, but is not limited to: Integrated Natural Resources Management Plan (INRMP), Integrated Cultural Resources Management Plan (ICRMP), and spill prevention and/or response plans as required by 40 CFR 112.

Environmental Compliance Inspections: The contractor shall be responsible for conducting periodic inspections of the fuel facility to ensure the facility is operating in accordance with environmental laws, regulations, permits, licenses, and plans. Inspection reports shall be maintained electronically and in hard copy. Inspection reports shall be made readily accessible during compliance assessments, audits and regulatory inspections. DLA and the installation reserve the right to conduct audits and/or inspections of the facility. Regulatory agencies shall also be allowed access to the facility to conduct inspections and/or audits.

C-2.15 Spills: The Contractor shall be responsible for spill response and restoration activities as outlined below.

C-2.15.1 Spill Response:

GOCO Operations: In the event of a spill, the Contractor shall follow the Installation spill response plan(s).

C-2.15.2 Spill Reporting: In the event of a reportable spill, as defined in DLA Energy Policy P- 40, the Contractor shall report to the Contracting Officer, DLA Energy Operations Center, DLA Energy Region, and the COR, in accordance with the requirements in DLA Energy Policy P-40.

Any volume of fuel spilled or released must be processed in APSR as a loss (due to spill) when not recovered and returned on specification to inventory. The Contractor shall also report the spill in accordance with the applicable installation spill plans.

C-2.15.3 Spill Site Assessment and Restoration: The Contractor shall coordinate site assessment and restoration activities with the Installation Environmental Chief and DLA Energy.

The Contractor shall be required to reimburse Fort Sill and/or DLA Energy for associated costs incurred by the government in response to spills caused by contractor personnel.

C-2.15.4 Spill Response Supplies: The Contractor shall be responsible for the care, restocking, and upkeep of all spill containment and clean up kits; supplies, and equipment under the fixed monthly price, which are required in accordance with the spill response plans.

C-2.16 Ensure Data Management Related to Quality of Service: Unless exempted by law, the Contractor, when requested by DLA Energy, shall promptly provide all records (electronic and otherwise) related to operations and staffing, contract quality assurance, fuel quality control, safety, security, environmental compliance and spill control, maintenance, training, and property management.

C-2.17 Training Requirements: The Contractor shall ensure that each employee in the fuel operations workforce successfully completes job specific and mandatory training required by DoD, DLA, Federal, State, Army and Local statutory and regulatory requirements. The Contractor is responsible for maintaining each employee’s requisite certifications or licenses on file.

• The Contractor shall establish and maintain a training program to ensure that applicable personnel receive training in the areas defined below and in accordance with all federal, state, and local laws and regulations. Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet minimum performance requirements and comply with all applicable laws and regulations. The Contractor shall maintain documentation of training records which will include, but not limited to employees’ name, date of training, course information (synopsis), and test results, if applicable.

C-2.17.1 DLA Energy provided training: The Contractor shall ensure employees are fully qualified at the performance start date of the contract. DLA Energy will provide the following classroom instructions; Fuels Terminal Manager/Property Administrator /Responsible Officer course, (5 days), and the Accountable Property System of Record (APSR) course, (15 days). This training will be funded by DLA Energy. This includes training, transportation and lodging. DLA Energy will only fund the cost of training for the initial two (2) individuals hired into required positions. Any additional employees requiring training will be funded by the Contractor. The Contractor will submit requests for classroom slots to the COR who will approve or disapprove requests based on contract requirements.

Once approved, the Contractor will make a written request accompanied by an indemnification statement to the Contracting Officer for scheduling. When required, the Contractor shall ensure that all employees attend and participate in the Annual Spill Response Training.

GOCO Operations: DLA Energy will provide the following annual on-site instruction for GOCO contractor employees: Underground Storage Tank (UST) Operator training (if applicable), and Spill Prevention and Response exercise training. The Contractor shall ensure that all applicable employees attend and participate in the required training and training documentation is maintained onsite. For any applicable Contractor employees that do not attend the DLA-funded training, the employees shall be trained at the Contractor’s expense.

Documentation confirming this contractor-provided training shall be maintained and provided upon request of the CO, Contract Specialist (CS), COR, installation representative, or appropriate agency.

C-2.17.2 Contractor Provided Training: In accordance with applicable Federal, state, and local laws, rules, and regulations, the Contractor shall ensure all of their employees are properly trained by providing, at a minimum, the following training: OSHA Hazard Communication;

Confined Space training, Hazardous Waste Operations and Emergency Response (HAZWOPER); Occupational Safety and Health Administration (OSHA) Lock-out/Tagout;

Personnel Protective Equipment; EPA Hazardous Waste Handling and Disposal, Hazardous Communication Training; Terminal Safety Training; DoT Safe Transportation of Hazardous Materials; fuel operations; environmental compliance; and DoD Antiterrorism (AT Level I Awareness training) Additional training requirements are as follows:

• The Contractor shall establish a program to provide recurring familiarization training to military personnel on the operation of the bulk-loading racks to ensure safety and proper operation during use and to prevent spills.

• The Contractor shall establish a program to provide training to military personnel on the operation of the aviation refueling systems to ensure safety and proper operation during use and to prevent spills. Oil Handling Personnel (OHP) Training will be provided by the installation (SPCC/Storage Tank Program) in accordance with EPA Title 40, CFR 112- “A Facility Owner/Operator's Guide to Oil Pollution Prevention’.

• The Contractor shall provide familiarization training to the Base’s Fire Department on the facilities and procedures when requested.

• All Training records shall be made available to the COR upon request.

• The contractor shall obtain access to all Government systems and databases required to provide the services and ensure required security clearances are obtained by personnel as needed.

• Prior to the contract start date, the contractor shall ensure Common Access Cards (CAC’s) for individuals that are required to perform Accountable Property System of Record (APSR), DLA Enterprise External Business Portal (EEBP) and/or DLA Enterprise Business System (EBS) actions are obtained. Once obtained, the contractor shall immediately request the required roles in the Account Management Provisioning System (AMPS) to gain required access. These roles shall be obtained prior to the start date of the contract.

C-2.18 Base Equipment/Property: The Contractor shall be afforded access to Army equipment which shall be operated and maintained under this contract. This equipment shall be accounted for in accordance with local Policy and the Contractor’s Property Management Plan. The Contractor shall grant access to base equipment for inspection and accountability as required. See Appendix-G for listing and details.

C-2.18.1 The Government shall provide the following supplies and equipment:

• Fire Suppression Equipment: All fire suppression equipment (i.e., fire extinguishers, portable and installed fire suppression equipment) currently in use at Fort Sill fuel operations will be provided at the contract start date. The quantity and type of fire suppression equipment required at the facilities will be determined by local jurisdiction per NFPA 407.

• Utilities: Electricity, water, sewage, and telephone (on station and FAS line as required.)

• Safety Data Sheets for Government provided products.

• FAS Software and Hardware (including installation, configuration, and training, as required.)

C-2.19 Contractor Equipment (CE)/Items: The Contractor shall provide sufficient and adequate tools, equipment, materials, and vehicles to adequately and safely perform all tasks required by the contract.

The Contractor shall ensure compatibility between Contractor-furnished equipment and base-equipment and facilities.

C-2.19.1 Contractor Vehicles: The Contractor shall provide commercial vehicles and equipment in necessary quantities to meet the ground refueling requirement listed in Appendix – A of the PWS for hours of operation.

• The Contractor shall provide all necessary tools, instruments, devices, parts, required to operate and maintain vehicles and equipment. All vehicles and equipment shall be maintained in a fully serviceable condition by the Contractor and shall be fully capable of safely performing the tasks for which they are designed.

• All refueling vehicles that are taken out of service for maintenance and repair shall be reported to the COR; however, this does not relieve the Contractor of its responsibilities in meeting the fuel servicing requirements within this PWS. The technical proposal shall include contingency plans for major/minor breakdowns or unavailability of Contractor-furnished equipment such as vehicles.

C-2.19.2 Utility Vehicles: The Contractor shall provide utility vehicle(s) in support of performance requirements, administrative functions, and general logistics tasks of this contract.

The utility vehicle(s) shall be commercial vehicle(s), such as a pickup or van type that can be used by Contractor or other personnel within the Contractor organization. Utility vehicles shall be marked with the company logo.

C-2.19.3 Condition of Vehicles and Equipment: All vehicles utilized in the performance of this contract shall be capable of meeting all the requirements outlined in the PWS for the duration of the base and option contract performance periods. The Contractor furnished vehicles and equipment that are deemed undependable, unreliable, or incapable of meeting any requirement outlined in this PWS shall be reported to the Contracting Officer and shall be repaired, modified, overhauled, upgraded, or replaced at no cost to the government. The Contractor shall bear all risks and expense associated with the maintenance, serviceability, licensing, permits, operation, and use of the Contractor-furnished vehicles and equipment.

C-2.19.4 Fuel Product Utilized by the Contractor: The Contractor shall provide all fuel products necessary and required to operate all Contractor-owned equipment used under this contract. The Contractor shall also provide, if required, the necessary federal, state and local environmentally approved storage tank, dispensing system, meter, and security devices, and shall arrange to have those products delivered to the Contractor’s site.

C-2.19.5 Additional equipment/supplies:

• First Aid Equipment

• Administrative supplies/Computer Supplies.

• Janitorial and Housekeeping Supplies and Equipment

• Incidental Fuel Cleanup Supplies for Contractor’s own use

• Lawn and grass equipment

C-2.20 Uniforms, Clothing, and Safety Equipment: The Contractor shall provide a distinctive company uniform for personnel to wear in the performance of their duties. Uniforms shall be maintained in a clean, serviceable condition and replaced when excessive wear requires.

• The Contractor shall provide all personnel safety equipment including safety shoes, safety glasses, reflective vests, sound suppression devices, cranial protection, goggles, gloves and other identifiable special safety equipment for specific operation and maintenance procedures for personnel. Contractor shall provide spill materials and equipment (spill kits, etc.) for initial containment and cleanup of spills at all facilities.

C-2.21 Disposition of Contractor Equipment: Contractor-furnished equipment identified herein shall be used solely in the performance of the work. The Contractor shall not store equipment in excess of the contract requirements on Government property. Upon termination of the contract, all equipment shall be removed from Government property within 30 days from the date of termination. Thereafter, the Contractor shall be charged the prevailing commercial storage rate for each piece of equipment kept on installation property.

C-2.22 Report Fraud, Waste and Abuse: The Contractor shall promptly report to the contracting officer any indications of fraud, waste or abuse as well as any investigative contact (investigative/audit agency name, investigator/auditor’s name and phone number) concerning fraud, waste or abuse.

C-2.23 Notification of Correspondence and Visits: The Contractor shall immediately provide the Contracting Officer (CO) and COR copies of all correspondence and notification of any visits relating to Federal, State, or Local officials or agencies and other personnel or Contractor that visit the retail fuel facility.

MAINTENANCE

C-3.0 Maintenance: The Contractor shall be responsible for the normal and continuous use, operation, maintenance, and real time reporting of discrepancies applicable to all petroleum systems, components, facilities, buildings, and equipment listed and provided in this contract.

The Contractor shall manage, coordinate, oversee, and report as needed to ensure all required inspections, services, maintenance, and repairs of all facilities, equipment, and real property associated with this contract are performed as required to ensure compliance with all Department of Defense (DoD), federal, state, local, American Petroleum Institute (API), and Unified Facility Criteria (UFC) requirements, and the manufacturers recommendations throughout the life of the contract. This includes monitoring and tracking all maintenance being performed by Government agencies or other contractors to verify that it is requested in a timely manner, scheduled as required, coordinated with relevant offices, finished to completion, and recorded in the computerized maintenance management system database (CMMS). The contractor will report maintenance conflicts, deficiencies, and delays to the COR, QAE, and Contracting Officer as soon as possible for assistance and resolution. The contractor will maintain the buildings, facilities, and property as described in the sub-paragraphs below.

C-3.1 Preventive Maintenance (PM): PM is defined as maintenance work to preserve a facility by preventing its deterioration; such as, but not limited to, operator maintenance, systems maintenance, corrosion control, grounds keeping, pressure washing, cleaning, spot painting, housekeeping, lubricating, tightening nuts and bolts, etc. Under the DLA Energy Recurring Maintenance and Minor Repair (RM/MR) Program, the USACE-Huntsville provides a separate RM/MR contract to perform PM tasks that are listed as system maintenance (SM) in accordance with Appendix C of UFC 3-460-03 and PWS paragraph C-3.3 below. The Contractor will perform all PM not listed as SM in the UFC 3- 460-03. The contractor shall devote adequate effort to identifying future deficiencies and potential deficiencies in order to prioritize PM efforts. PM includes performing, at a minimum, the services recommended by the manufacturer or in accordance with commercially accepted practices, as well as the effort required to keep a facility, a piece of equipment or system functioning. While the government does not plan to dictate specific PM requirements or practices, the contractor’s PM program shall provide a systematic approach to planning, scheduling, documenting, reporting, and managing (labor, materials and time) to perform those actions that contribute to the uninterrupted functioning of the fuel terminal.

C-3.1.1 Minor Painting and Spot Painting: The Contractor shall accomplish minor painting as part of its housekeeping requirements. Minor painting shall consist of painting pumps, valves, pipelines and applying color code bands as prescribed by Military Standard Identification Methods for Bulk Petroleum Products Systems, MIL-STD-161, except for the requirement of paragraph 5.1.1 of MIL- STD-161 which requires such markings on the storage tanks. Spot painting is painting needed to protect equipment, pipes, tanks, buildings, fences, etc., or to keep the major portion of the paint in good condition. Spot painting is repainting of equipment, etc., when paint has chipped or loosened from painted surface. When more than 25% of the surface requires painting, this will not be considered spot painting. All vertical surfaces above 10 feet from existing secure footing which require spot painting shall be accomplished by the Contractor. Paint and primer used shall be oil-based type suitable for use on metal, exterior surfaces and shall be matching or compatible with existing surface paint.

C-3.2 Operator Maintenance (OM): The contractor will perform required fuel facility maintenance in accordance with UFC 3-460-03 Petroleum Fuel Systems Maintenance, dated 10 Nov 2017. Maintenance tasks for fuel system components are separated into Operator Maintenance (OM) and Systems Maintenance (SM). Appendix C of UFC 3-460-03 includes a list of required maintenance tasks and their associated designation as OM or SM for the Army, Navy and U.S. Marine Corps, and the Air Force. All OM described for the Army in the UFC will be performed by the contractor.

C-3.3 Systems Maintenance (SM): SM is normally performed by qualified personnel of base facility maintenance, facility operating contracts, or maintenance contracts for recurring maintenance and repair. Under the DLA Energy Recurring Maintenance and Minor Repair (RM/MR) Program, the USACE-Huntsville provides a separate RM/MR contract to perform all SM in accordance with the UFC 3-460-03. The contractor under this contract shall monitor, track, and document all maintenance performed by the RM/MR contractor and collect all documents related to the completion of SM actions and record the completion in their Computerized Maintenance Management System (CMMS) database for tracking purposes. If SM tasks are not being performed as required or sufficiently by the RM/MR contractor, the contractor will report the problem to the COR, QAE, and DLA Energy KO for assistance and resolution.

C-3.4 Repairs: The contractor will report deficiencies needing repair or maintenance required which exceeds the scope of this PWS to the COR/QAE for submittal to the RM/MR contract.

The RM/MR contractor will take action to assess emergency situations and minor repairs once the requirement is submitted by the COR/QAE and approved under the RM/MR program. The contractor for this contract will monitor, track, and document all repairs performed by the RM/MR or construction agent contractor and collect all documents related to the completion of these maintenance actions from the COR or RM/MR QAE and record the completion in their CMMS database. If repairs are not performed in a timely manner, the contractor will report the delay to the COR and DLA Energy KO for assistance and resolution.

C-3.4.1 If found to be advantageous to the government, immediate action is required, or repairs are not eligible for SRM funding, at the discretion of the KO, the contractor may provide a proposal for repairs described above for consideration by the government; provided the work does not create real property, does not require engineering design or oversight, and does not include construction. If deemed advantageous to the government and approved by the KO, these repairs may be performed under a contract modification. No work under this paragraph shall be performed prior to KO approval and issuance of a written modification.

C-3.5 Maintenance Records: Maintenance, repairs, inspections, and test findings will be electronically and manually recorded and maintained in permanent facility files.

C-3.5.1 Computerized Records: The Contractor is required to keep maintenance records using a Computerized Maintenance Management System (CMMS) at the DFSP for all locations. Within 60 days of commencing performance, the contractor shall develop and maintain an electronic database on all systems and components, in order to track scheduled work, deficiencies and problem areas needing corrective work. Record keeping includes all noted deficiencies found and work performed at the fuel facility;

even if performed by another organization or contractor. Information obtained from the RM/MR contractor, daily/weekly/monthly inspections and operator findings will be inputted into the CMMS as needed and used to schedule the required maintenance as appropriate. Records will be maintained for the duration of the contract and turned over to the Government at the completion of the contract. In addition, the Government will be allowed unlimited/unrestricted access to the Contractor’s CMMS database.

C-3.5.2 Manual Records: The contractor shall establish maintenance records files in hard copy, in addition to the CMMS records. The hard copy records shall include, but not be limited to:

1. Facility Maintenance Plan including daily, weekly, monthly, quarterly, semi-annual, and annual maintenance requirements for each facility asset.

2. Manufacturer’s equipment manuals, warranty documents, and maintenance instructions for all equipment.

3. Guarantee/warranty on all equipment and materials furnished by the contractor.

4. As-Built Drawings, if provided by the government.

5. Make, model, size, capacity, serial number, date installed, and age of each facility asset, including real property information.

6. Hard copies of completed daily, weekly, monthly checklists which can identify the inspectors, items inspected, and deficiencies noted.

7. Up to date maintenance, inspection, and repair schedule.

8. All RM/MR maintenance reports.

9. Facility deficiency list with repair status.

10. Copies of all required permits, certifications, and regulatory inspection reports.

C-3.6 Building and Grounds Maintenance General: The Contractor shall maintain all facilities, buildings, and grounds in accordance with Base guidelines. The Contractor shall ensure buildings are clean, free of debris, and pest free.

• The Contractor shall be responsible for mowing and trimming the grounds. The Contractor shall not permit or allow fire hazards to accumulate in buildings or on grounds. The Contractor shall ensure compliance with the installation pest management plan, if the use of pesticides, herbicides, etc., are required.

• The Contractor shall not perform major repairs or make any alterations to the buildings or grounds without prior approval from the Contracting Officer.

• The Contractor shall be responsible for building preventive maintenance and janitorial services.

Each building shall be kept clean and free from debris.

• The Contractor shall replace broken window glass, repair minor roof leaks, repair minor electrical failures (e.g. change fuses, reset circuit breakers), and furnish and replace burned out light bulbs.

• The Contractor shall not permit or allow fire hazards, such as oily rags, loose paper, and trash to accumulate in any of the terminal buildings.

• The Contractor shall not permit or make any alterations to the buildings or facilities without prior permission/approval, in writing, from the Contracting Officer.

• The Contractor shall protect any vacant and unused buildings located on the terminal and ensure that the buildings are kept clean and free of debris. The Contractor may use a specific building, at the option of the Government, for protection and storage of Contractor-owned equipment provided that prior written approval is obtained from the COR. The Contractor shall not permit other non-Government activities access to the vacant buildings.

C-3.6.1 Ground Maintenance Specifics: The Contractor shall provide sufficient equipment to provide the ground maintenance. Grass, weed, brush and other vegetation within the areas defined below shall be maintained so as not to exceed 4 inches in height, including all vegetation, except ornamental trees and shrubs.

• Within the fence line of the bulk storage area and 6 feet outside the fence line at the HAAF Tank Farm.

• All areas around the refueling islands and facility buildings of the HAAF Flight line.

• Vegetation on pipeline right-of-away, 10 feet from the pipeline on both sides. Vegetation and grounds at the bulk storage area.

C-3.7 Storage Tank Cleaning: Disposal of capitalized product will follow disposition instructions listed in the latest revision of MIL-STD-3004-1. Prior to disposal of tank bottoms, the Contractor must notify the COR and CO, and obtain official written approval from the DLA Energy Regional Office, DLA Energy Quality Technical Directorate, and DLA Energy Inventory Management for proper disposition of product.
