About this file
This is a Conflict of Interest Affidavit required for submission with bid proposals to the Maryland Department of Transportation State Highway Administration (MDOT SHA) for towing services in Queen Anne's County. The affidavit pertains to a three-year towing contract (QATOW30SB) for SHA fleet vehicles, trucks, and equipment, requiring offerors to disclose any conflicts of interest that could impair their ability to render impartial assistance or advice to the State or compromise objectivity in performing contract work. Offerors must warrant that no relevant facts or circumstances exist that would create a conflict of interest, and must disclose any such circumstances in detail, attaching additional documentation as necessary. The affidavit defines "conflict of interest" and "person" according to Maryland regulations (COMAR 21.05.08 and COMAR 21.01.02.01B(64)), encompassing offerors, contractors, consultants, subcontractors, sub-consultants, and their respective employees or agents with authority to control or supervise work.
Offerors are required to immediately disclose in writing to the procurement officer any actual or potential conflicts of interest that arise after the affidavit date, including detailed descriptions of actions taken or proposed to avoid, mitigate, or neutralize such conflicts. The affidavit must be submitted under penalty of perjury and signed by an authorized representative. The towing services contract includes hourly rates for light duty, medium duty, heavy duty, and equipment towing, with separate rates for after-hours and severe weather service, plus flat fees for rotator involvement; billing applies from yard departure until return with a maximum one-hour travel time allowance. Payment options include credit card for invoices under $5,000 (without processing fees), checks via mail with net 15 terms, or free ACH direct deposit.
