About this file

This document is a Reseller Agreement attachment for the KETS Network Products and Services contract administered by the Kentucky Department of Education (KDE) in partnership with Original Equipment Manufacturers (OEMs) and authorized resellers. The agreement establishes the terms and conditions under which resellers may participate in providing network products and services to Kentucky K-12 public school districts under the KETS program (Master Agreement number referenced as [MA #]). The contract does not specify quantities, response dates, due dates, site visits, bidder meetings, or award dates, as this is a compliance framework document rather than a procurement solicitation. The term of the agreement aligns with the underlying KETS Network Products and Services contract held by the primary OEM vendor, and reseller participation remains effective for the duration of that contract term.

The agreement requires resellers to maintain pricing that meets or exceeds minimum discounts off Manufacturer's Suggested Retail Price (MSRP) as established by the OEM and approved under the contract, with all pricing provided to school districts being contract-compliant, transparent, equitable, and auditable. Resellers must maintain current OEM authorization, remain in good standing with the Federal ERate Program including FCC and USAC compliance, and provide quotes with clearly defined validity periods. The agreement mandates designation of a Single Point of Contact for KDE communications, a dedicated email mailbox for ERate-related correspondence, and named support personnel for ERate program support, technical support, sales, and warranty services. Non-compliance with the reseller agreement or underlying KETS contract terms may result in suspension or removal as an authorized reseller, disqualification from minibid participation, or other remedies available under the contract or applicable law.
