About this file
This is a contractual definitions attachment for RFP 758 2700000070, a KETS (Kentucky Educational Television) Network Products and Services rebid managed by the Kentucky Department of Education (KDE) for original equipment manufacturer (OEM)-held network contracts. The document establishes standardized terminology and roles for participants in the procurement, defining the OEM as the prime contractor responsible for design, manufacturing, warranty, performance, compliance, pricing, delivery, installation, and support. The RFP encompasses network products and services, including Managed Internal Broadband Services (MIBS) that provide operation, monitoring, and management of school district internal broadband networks consistent with E-Rate program definitions. Agents and resellers are authorized to market, quote, accept orders, invoice, deliver, install, configure, and support OEM products, though liability remains with the OEM.
The attachment establishes critical pricing and compliance requirements, including the use of Manufacturer's Suggested Retail Prices (MSRP) that must be dated, traceable to authoritative OEM sources, and consistent across all channels for audit purposes. OEMs must provide comprehensive price lists detailing part numbers, descriptions, MSRP, discounts, net pricing, and clear E-Rate eligibility designations as determined by the FCC's Schools and Libraries Program administered by USAC. The document defines procurement processes including MiniBids as competitive selection mechanisms conducted by KDE or districts to determine best value, and establishes acceptance criteria requiring written acknowledgement that deliverables conform to order and contract requirements or deemed acceptance following the contractual inspection period. Definitions distinguish between business days (Monday through Friday excluding state-observed holidays) and calendar days for contractual timing purposes.
