(End of Addendum to 52.212-1)

FAR 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014) applies to this acquisition.

A. BASIS FOR AWARD

The award resulting from this solicitation will be made based on the comparative evaluation, identifying the overall quote that is determined to be the most beneficial to the Government (i.e., best value). For each quote received, the Government will evaluate the following factors:

Non-price factor

· Technical Approach Price factor

· Price.

All quotes shall be subject to evaluation by Government personnel. The Government intends to award based upon the initial evaluation of quotes. Consequently, Respondents are highly encouraged to quote their best solution and price in their initial submissions. However, the Government reserves the right to communicate with any or all Respondents submitting a quote, If it is determined advantageous to the Government to do so. If these communications take place, the Government is not obligated to communicate with every Respondent (note that FAR Part 15 procedures do not apply; therefore, formal discussions are not applicable).

All Respondents will be treated fairly and impartially. A Respondent may be eliminated from consideration without further communication if its quote is not among those considered most advantageous to the Government based on its initial evaluation.

Contents of the written quotes will be evaluated to determine the degree and extent to which the requirements set forth in the solicitation are satisfied or exceeded. The Government will evaluate the quote to include an acknowledgement of revisions, and any other applicable and required documents as outlined in the evaluation instructions.

A quote that is determined to be incomplete or fails to fully meet any material requirement may render a quote deficient, thus ineligible for award. If at any point during the evaluation, any aspect of a Respondent’s quote is deemed deficient, the evaluation of that quote will cease, and the Respondent’s quote will no longer be in consideration for award unless the Contracting Officer deems the continued evaluation of that quote is in the Government’s best interest.

The quotes will be evaluated strictly in accordance with their written content. Quotes which merely restate the requirement or state that the requirement will be met, without providing supporting rationale, are not sufficient and will be rated Unsatisfactory and thus, ineligible for award. Respondents who fail to meet the minimum requirements of the solicitation shall be considered nonresponsive and thus will be ineligible for award.

Respondent’s are cautioned that the award may not necessarily be made to the Respondent quoting the lowest price, or to the Respondent with the most highly rated quote. Award may be made to other than the lowest priced quote, if the Government determines that a price premium is warranted due to the merits of one or more of the non-price factors.

Any quotes that do not meet the following criteria will be eliminated from consideration (from the respective Tier):

1. All SDVOSB and VOSB concerns must be certified by SBA at the time of quote submission and small under the applicable NAICS code to qualify for Tier 1 and Tier 2, respectively to be considered an SDVOSB or VOSB. Certification by SBA alone does not meet the requirements for size standard authentication. Respondents are solely responsible for obtaining SBA Certification. The contracting officer cannot intervene with SBA regarding the processing of applications.

2. All Small Businesses must be small under the applicable NAICS code to qualify for Tier 3 and in SAM.gov following SBA guidelines for certification as a small business.

After this initial assessment, all remaining quotes will be evaluated for Technical Capability using a tiered approach based on an order of priority as established in 38 U.S.C. 8127. The review will consist of four tiers. The tiers are defined as follows:

Tier 1 - Service-Disabled Veteran-Owned Small Business (SDVOSB) Concerns Tier 2 - Veteran-Owned Small Business (VOSB) Concerns Tier 3 - Small Business Concerns Tier 4 – Large Business Concerns

I. Tier 1 quotes will be evaluated first. After an evaluation of Tier 1 quotes, if an award can be made that can be determined a best value to the United States, no additional tiers will be evaluated. If a best value determination cannot be supported to make an award in Tier 1, (in the judgment of the Contracting Officer), the Government will evaluate Tier 2 quotes for award.

II. Tier 2 quotes will be evaluated second. After evaluation of Tier 2 quotes (if needed), if award can be made that can be determined a best value to the United States, no additional tiers will be reviewed. If a best value determination cannot be supported to make an award in Tier 2, (in the judgment of the Contracting Officer), the Government will evaluate Tier 3 quotes for award.

III. Tier 3 quotes will be evaluated third. After evaluation of Tier 3 quotes (if needed), if award can be made that can be determined a best value to the United States, no additional tiers will be reviewed. If a best value determination cannot be supported to make an award in Tier 3, (in the judgment of the Contracting Officer), the Government will evaluate Tier 4 quotes for award.

IV. Tier 4 quotes will be evaluated last. If a best value determination cannot be supported to make an award in Tier 4, the Government will cancel the solicitation or request quotation revisions to achieve best value and restart the process if necessary.

Note: At least two quotes must be received within a tier for an evaluation to commence within at tier. Example(s), if two SDOVSB’s quote, the evaluation will start in tier 1. If only one SDVOSB and one VOSB quotes, it will automatically be a tier 2 evaluation. If one SDVOSB and one small business quotes, it will automatically be a tier 3 evaluation. If only one SDOVBS quotes and all other quotes are from large business, it will automatically be a tier 4 evaluation.

The quotes will be evaluated as follows:

B. EVALUATION APPROACH

1. VOLUME I TECHNICAL APPROACH

The Government will evaluate quotes based on the following:

Understanding of the Problem - The quote will be evaluated to determine the extent to which it demonstrates a clear understanding of all features involved in solving the problems and meeting the requirements presented in the SOO, and the extent to which uncertainties are identified and resolutions proposed. The quote will be evaluated strictly in accordance with its written content.

Feasibility of Approach - The quote will be evaluated to determine whether the Respondent's methods and approach to meeting the requirements provide the Government with a high level of confidence of successful completion. Risk relative to the proposed Technical Approach is evaluated to ascertain the likelihood of success of the proposed approach.

Completeness - The quote will be evaluated to determine whether the Respondent’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the solicitation. The quote will be evaluated to determine the extent to which each requirement has been addressed.

2. VOLUME II PRICE

The Government will evaluate price to determine whether or not it is considered fair and reasonable using price analysis techniques as prescribed in FAR 13.

The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. This includes rates applied to FAR clause 52.217-8 Option to Extend Services. As stated in the clause, if exercised, the continued performance of any services must be within the limits and at the rates specified in the contract, with the total extension of performance not to exceed 6 months; the evaluation of all rates within the base or option periods thereby constitutes the evaluation of rates for this extension of services option.

The CO and the review team will be responsible for considering the service rates, the level of effort, and the mix of labor proposed to perform a specific task. The CO will ensure the labor rates proposed are reasonable and is responsible for determining that the total price is reasonable and in accordance with the evaluation criteria.

3. VOLUME III REVISIONS & OTHER DOCUMENTS

Respondents are hereby advised that any quote-imposed terms and conditions and/or assumptions which deviate from the Government’s material terms and conditions established by the solicitation, may render the Respondent’s quote Unacceptable; thereby, ineligible for award.

Failure to acknowledge revisions may result in your quote being considered nonresponsive or unacceptable.

(End of Provision)
